The Seller reserves the right to accept or reject any and all bids, and the receipt of a bid form or
the "fall of the hammer" shall not be an acceptance of a bid. Unless this is a stated absolute
auction.
Auctioneer reserves the right to change any of the terms of conduct and enforcement of sale by
announcement, written or oral, made before the auction sale or at the commencement thereof,
and such change or changes, by virtue of this clause, shall be binding on any buyer by
constructive notice.
Buyers shall have the day of the auction sale to remove the property purchased from the place
of sale. Buyers shall bear the entire risk of loss during storage prior to such removal as
provided. After the date of the auction, buyers shall be liable for all expenses of storage of any
property that was purchased but which has not been removed unless prior written arrangements
have been made
The auctioneer is an agent only and is not responsible in the event buyers or the seller at the
auction sale fail to live up to their agreement, including failure of the seller to deliver any
property purchased to buyers.
Auctioneer shall have the following rights and duties in conducting the auction sale:
(1) To withdraw the property listed for sale in this announcement before sale or before a bid for
such property is accepted.
(2) To adjourn the sale without notice at any time before any specific property is struck off,
without incurring any liability.
(3) To reject, on behalf of the seller all bids; and Auctioneer reserves the right to accept or reject
bid amounts and to determine the bid increments that will be beneficial to their client �the seller�.
(4) To announce that approval of the seller shall be a condition precedent to the consummation
of any sale.
(5) To determine the winning bidder. Auctioneer is the sole arbiter of who won the bid and
Auctioneers determination is final.
All property listed for sale in this announcement will be sold AS IS, without any warranty or
covenant on the part of the seller or auctioneer as to quality, character, condition, size, weight,
or kind, or that such property is in condition or fit to be used for the purpose for which it was
originally intended. No claim for any allowance on any of the grounds will be considered after
the property is struck off to a bidder by the auctioneer.
Neither the auctioneer nor the seller may give any warranty, express or implied, as to quality or
description of the property listed for sale in this announcement. Neither the auctioneer nor the
seller shall be liable for the quality of the property listed for sale in this announcement or for any
faulty description of the property, in any catalogue, advertisement, or other medium employed
for announcing this sale. Buyers shall not be entitled to rescission, damages, or any other
remedy on account of the quality of the property listed for sale in this announcement, or the
faulty description of the property.
Auctioneer(s), Auction Staff reserves the right to bid and make purchase during this auction.
Auctioneer reserves the right to bid on behalf of their client the Seller. Auction
Company/Auctioneers will not be held liable for lag time speed of the of internet bidding or miss

bids by the internet or live streaming of the auction, onsite or internet bidding.
Auctioneer(s), Auction Company may have a vested interest in the item(s) selling in today�s
auction.
Payment: Method of payment: Cash, Personal/Business Check pre-approved prior to auction.
Credit Cards (3.5% of gross purchase will be added for a convenience fee) � other terms &
conditions may apply. A wire transfer is requested for online purchase greater than $500.
A buyer�s premium will be in effect for online purchases and retained by the auction company.
State sales tax may apply to purchases @ 7.25% all exempt buyers must provide exempt form
& ID.
Buyers are responsible for State sales tax and transfer fees for all titled vehicles.
Buyers are responsible for all supplies, labor, and cost of shipping of the items bought in today�s
auction.
Auction Company/Auctioneer and Seller is not responsible for any inspections or condition of
items selling.

� All items are only guaranteed between the seller and the buyer. Auctioneers guarantee no
item.
� All items sell in their current condition �AS IS�
� All items auctioned are sold with reserve. Reserves are the responsibility of the seller. See fee
schedule in contract for buy backs. Auctioneers/Auction Staff reserves the right to bid and make
purchases during today�s auction.
� Auctioneers, Preble County Fairgrounds and Staff are not responsible for accident pertaining
to injury, nor lost, stolen or damaged items or to items during unloading and loading of items.
� Auctioneer reserves the right to accept or reject bid amounts and to determine the bid
increments that will be beneficial to their client �the seller�.
� No tires accepted for consignment.
� Titled vehicles must have a title available at signing of contract in the name of individual
signing the contract. All questions as to condition will be referred to the Seller. We strongly
suggest that you inspect the condition and title. The buyer is responsible for transfer taxes. The
buyer will sign a vehicle release form stating that under no circumstance the Auction Company
represented condition and title. Auction Company-Auctioneer will not provide Insurance to any
vehicle. All titled items including trailers will be sold separately unless stated by the seller. The
seller is responsible for disconnecting all trailers.
� All items with an engine must have fuel and battery. Fuel charge is $5 per gallon. If the engine
does not start auction company does not take responsibility.
� Acceptable forms of payment: Cash, Check with available funds. (Out of State checks must be
pre-approved) Credit Card w/3.5% convenance fee, Wire transfer with a $25 fee.
� All invoiced purchases must be paid on the day of the auction. Any person wishing to deduct
purchases or buy back fees from items sold must be informed to the auction clerk at check out
the day of the auction.
� Internet bidding is available at WalnutHarvestAuctions.com and equipmentfacts.com. Buyer�s
Premium is charge for the convenience of this service to all internet buyers. Internet buyers
must abide by the terms and hours of pick up. Special arrangements may be made by
contacting the Auctioneer.
*Buyer's Premiun 0-$1000 is 15%...for items $1,001 to $10,000 ...10%
For items $10,001 and greater Buyer's Premiun is 5% with cap of $6,000
� By signing and agreeing to these Terms and Conditions, you verify your address, use of credit
card, with no return or charge backs to credit card.
� All Internet buyer forms of payment must be by wire transfer by 5:00 P.M. on Monday March
23rd, 2026. No credit cards will be accepted for online purchases. Pre-approved checks and
cash paid in person the day of the Auction. The Auction Company does not assume any liability
to the speed/lag time of the internet, whomever the auctioneer recognizes as the bidder. Online
buyer�s will be charged a buyer�s premium per sliding scale with cap of $6,000.00
