REVIEW THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING THE SITE OR BY PARTICIPATING IN THE ONLINE AUCTION, YOU AGREE TO THESE TERMS AND CONDITIONS AND MAKE REPRESENTATIONS AS SET OUT HEREIN. THESE TERMS AND CONDITIONS ARE LEGALLY BINDING AND IF YOU VIOLATE ANY OF THEM, R&B SMITH'S AUCTION SERVICE, AND ITS EMPLOYEES, AGENTS AND REPRESENTATIVES OR THE OWNER/SELLER MAY SEEK LEGAL RELIEF, INCLUDING BUT NOT LIMITED TO, REPORTING YOUR CONDUCT TO APPROPRIATE LAW ENFORCEMENT ENTITIES. PLEASE NOTE THAT THESE TERMS INCLUDE AN AGREEMENT BY WHICH YOU INDEMNIFY OWNER/SELLER AND AUCTION COMPANY.


REGISTRATION:

All person(s) desiring to bid must register prior to the auction to get a bidder number. REGISTRATION IS FREE. A valid credit or debit card number is required as a security measurement, and it should be in the bidder's name. THIS IS AN ONLINE AUCTION ONLY. Some lots may have extended bidding, as this applies to all online auction lots. Posted closing times and displays of auction current time are approximate, Auction Terms & Conditions


INSPECTION / DESCRIPTION OF ITEMS:

Inspections begin April 8, 2026 by appointment between 9am-3pm CST.. All lots can be viewed and bidders are encouraged to contact Ohio Valley Towing and Auto Repair to inspect items. It is the responsibility of the buyer to have inspected thoroughly the merchandise and to have satisfied him or herself as to its condition and value and to bid based soley upon that live preview and or inspection. . All items are sold �as is, where is� with no warranty, either expressed or implied. R&B Smith's Auction Service shall not be responsible for the correct description, authenticity, genuineness, or defect in any lot and makes no warranty in connection therewith. No stock photos are used in this auction to describe any item or to lead a bidder to believe he or she is bidding on the item in a stock photo. All items are shown with an in-house photos to determine condition and value. The Description is used solely to describe the item, and does not imply any warranties or guarantees of condition. Any additional description (if applies) will be our opinion based condtion of the item, and also implies no warranties or guarantees on the condition. We do not fully inspect every item and advise you to do so on auction inspection day. No allowance, refund or set aside will be made on account of any incorrectness, error, imperfection, defect or damage. Any Buyer Discrepancies must be reported at the Seller's Physical Location at time of removal. No Exceptions. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type.





ALL PAYMENTS must be made to R&B Smith's Auction Service. Payment(s) can be made by phone or in person with cash, check, Visa, or MasterCard. We also accept paypal.

PICK UP TIME is Saturday April 18, from 8:00am CST-2:00pm. Vehicles not picked up will result in $25.00 daily storage fee. Vehicles not picked up in 30 days from auction date will become property of OHVT and no refund will be issued.

ATTENTIONS BUYERS: You are responsible for the removal of any item(s) purchased. You are further responsible to furnish the necessary assistance to remove/load any item purchased.

Buyers who do not pick up purchases by the removal deadline will incur late Fees in the amount of $25 Per Per Day.

PAYMENT DEADLINE is before 5:00pm CST, the day following auction closure . NO EXCEPTIONS!. Any invoice not paid for by the deadline will be charged full invoice price to the Credit card you provided for auction registration. There will be no charge backs, stop payments or refunds.

PREMIUM AND PAYMENTS:

Buyer�s premium: a 10% buyer premium will be charged. Payment must be made in full by 5:00pm CST on the day following the auction. Invoices remaining unpaid after the payment deadline, will be charged to the credit card on file for Buyer. Buyer will not be invoiced for the items until the entire online auction is over. Failure to pay will result in a permanent ban from all future auctions, and pursuit of all legal remedies available. The buyer agrees that any item successfully bid upon will be paid for by the buyer, following the conclusion of the auction, if bidder is an individual acting on behalf of a corporation registered as the bidder, the individual bidder shall be jointly and severally liable with the corporation for payment of the purchase price plus applicable fees and taxes. Indiana 7% sales tax will be collected. Buyer is responsible for $15.00 state title fee.





Auction Terms
" Vehicles stored by Ohio Valley Towing LLC that are not claimed by the registered or legal owner are sold at public auction.
" Auctions are held at Ohio Valley Towing's storage facility, located at 12679 N. State Road 245, Lamar, IN 47550
" A list of vehicles eligible to be auctioned is posted at least 15 days in advance at the Tell City newspaper and on their website. Please note that vehicles can be claimed by owners until 9:00 AM the day of the auction and auctions can be rescheduled.
Auction policies:
" This is an online auction, however floor/phone bids will be accepted
" Vehicles can be removed from the premises only by a licensed driver, trailered, or tow truck.

Purchase procedures:
" Winning bidders are obligated to complete the purchase as agreed. Bad bidders will be flagged as such
and funds will be sought through legal actions
" Minimum bid is $200.00 Auction fees may apply, see Auction Fees.
" No refunds or exchanges. No exceptions.
" Balance of auction purchase may be paid by cash, check, credit, or debit. (Visa, MasterCard, American Express, and Discover)
" All vehicles are sold "as is" "where is". Buyer acknowledges that Ohio Valley Towing LLC and R&B Smith's Auction Service makes no expressed or implied warranties about the vehicle condition, drivability, or its status. All vehicles are unregistered when sold. Abandoned vehicle title application and receipt are supplied to buyer in order to facilitate registration with Indiana BMV. This process with the Indiana BMV could take up to 4 to 6 weeks sometimes longer please beware.
" Title applications will be filled out in the name of the final bidder. If changes need to be made, you must go to the BMV and apply for a title transfer. No exceptions.
" Buyer acknowledges that the removal of an unregistered vehicle without a tow truck, dealer plate, or moving permit is unlawful and subject to penalties applied by law enforcement.
