PORT CITY AUCTIONS & ESTATE SERVICES

By registering to bid or participating in any auction conducted by Port City Auctions & Estate Services (“Auction Company”), you agree to be bound by the following Terms & Conditions.

1. AS-IS / WHERE-IS / NO REPRESENTATIONS
All items are sold AS IS, WHERE IS, with all faults and imperfections. Port City Auctions & Estate Services makes no guarantees or warranties, express or implied, regarding the value, condition, authenticity, origin, attribution, or fitness for a particular purpose of any item.
It is the sole responsibility of the buyer to determine the value, condition, and authenticity of merchandise and to bid accordingly. The Auction Company expressly disclaims responsibility for any statements, descriptions, estimates, or opinions expressed by the auctioneer, staff, consignors, or any other party.
Buyers are strongly encouraged to attend all scheduled preview or inspection times and to thoroughly inspect items prior to bidding. Failure to inspect does not relieve the buyer of responsibility.
All sales are final. No refunds, exchanges, returns, or adjustments will be made for any reason. No chargebacks permitted.

2. BUYER’S PREMIUM
An 18% Buyer’s Premium will be added to the hammer price of all items unless otherwise stated.

3. PAYMENT TERMS
Payment is processed automatically through HiBid using the bidder’s approved payment method. If payment is declined, a $10 reprocessing fee will be applied and must be resolved prior to pickup.
Port City Auctions reserves the right to require wire transfer or certified funds for high-value purchases or new bidder accounts.

4. SALES TAX
North Carolina sales tax will be charged unless a valid NC resale certificate is emailed to info@portcityauctions.com prior to auction close. No retroactive tax refunds will be issued.

5. BIDDER RESPONSIBILITY & DUE DILIGENCE
Bidders are responsible for reviewing all descriptions, photographs, measurements, and disclosures prior to bidding. No description or representation, written or oral, shall be deemed a warranty. Bidding constitutes acceptance of the item in its present condition.

6. BIDDING IS FINAL / AUCTION INTEGRITY
All bids are binding and may not be retracted. Any attempt to manipulate bidding, including shill bidding, bid shielding, or misuse of bidder accounts, may result in immediate suspension, forfeiture of items, and permanent ban from future auctions. Port City Auctions reserves the right to remove any item from the auction at any given point for any reason prior to the conclusion of the sale.

7. AUCTIONEER & COMPANY BIDDING DISCLOSURE
The Auctioneer, Port City Auctions & Estate Services, and any employees, agents, contractors, or representatives of the Auction Company may bid on and purchase items, unless otherwise stated. Such participation is permitted under North Carolina law and does not constitute unfair or deceptive practice.

8. PICKUP REQUIREMENTS
All items must be picked up only during the designated pickup date and time. No alternate pickup arrangements are permitted unless approved in writing prior to the start of pickup.

9. LATE PICKUP & STORAGE FEES
Late pickup will incur storage fees as follows:
• $5 per lot per day
• $10 per furniture or oversized item per day
Storage fees begin immediately after pickup ends and must be paid prior to item release.

10. OFFSITE AUCTION TRANSPORT
For offsite auctions, transport to 3911 Market Street, Wilmington, NC will incur:
• $10 per lot
• $50 per oversized/heavy item (over 2 feet in any dimension or over 30 lbs)
Transport must be approved prior to pickup day.

11. SHIPPING POLICY – SHIPPING SAINT ONLY
Port City Auctions & Estate Services exclusively utilizes Shipping Saint for all in-house shipping services. No other shipping services or carriers will be accepted or facilitated by the Auction Company.
Buyers may arrange alternate pickup options, including third-party carriers or personal pickup, only with written approval prior to the designated pickup date and time. Unapproved arrangements will be denied.
Shipping invoices must be paid within 7 days, or items will be forfeited. Buyer assumes all shipping risk and cost once items are released to Shipping Saint.

12. FORFEITURE & ABANDONED PROPERTY
Items not picked up, shipped, or approved for transport after pickup ends are forfeited with no refund. Items unclaimed after 7 days are deemed abandoned and may be resold, donated, or disposed of at the sole discretion of Port City Auctions.

13. LOADING & REMOVAL
Buyers must bring adequate help and proper packaging. Staff will not load items. Once items leave the premises, the buyer accepts the condition permanently.

14. NEW BIDDERS & ACCOUNT RESTRICTIONS
Buyers with negative HiBid feedback may be denied participation. New bidders with accounts less than 6 months oldmay be required to wire transfer purchases over $500.

15. DEFAULT & NON-PAYMENT
Failure to complete payment constitutes default. Port City Auctions may cancel the sale, resell items without notice, retain deposits, assess administrative or relisting fees, and report the bidder to HiBid and affiliated platforms.

16. CONDITION DISPUTES
No price adjustments, credits, or refunds will be issued for condition disputes after auction close. All concerns must be addressed prior to bidding.

17. SAFETY & LIABILITY
All persons enter auction premises and pickup locations at their own risk. Port City Auctions is not responsible for accidents, injuries, or damage to persons, vehicles, or property.

18. FORCE MAJEURE
Port City Auctions shall not be liable for delays or cancellations caused by events beyond its control, including weather, natural disasters, power outages, system failures, or governmental actions. Pickup dates may be modified as necessary.

19. PRIVACY POLICY & CONSENT TO CONTACT
By registering to bid, the bidder consents to this Privacy Policy and authorizes Port City Auctions & Estate Services to contact the bidder by email, phone, and/or postal mail.
Information collected through auction registration may include name, address, email, phone number, and bidding history. Information may be used to present services, market upcoming auctions, and carry out contractual obligations including billing and collections.
Personal information will not be sold or rented and will only be shared as necessary for payment processing, shipping services, or where required by law.

20. GOVERNING LAW & DISPUTES
All disputes are decided solely by Port City Auctions & Estate Services, and all decisions are final. These Terms & Conditions are governed by the laws of the State of North Carolina.

21. SEVERABILITY
If any provision of these Terms & Conditions is found unenforceable, the remaining provisions shall remain in full force and effect.

BIDDER ACKNOWLEDGMENT
I acknowledge that I have read, understand, and agree to all Terms & Conditions of Port City Auctions & Estate Services.
