________________________________________ AUCTION DETAILS All auctions are conducted online by John T. Henry Auction Co., LLC. All items are sold to the highest bidder and are subject to a 13% buyer's premium and applicable sales tax unless a valid resale certificate is on file prior to bidding. A credit card on file will be processed immediately following the auction for up to $750. Any remaining balance must be paid in full. For shipped orders, buyers will receive a secure payment link via Global Payments to complete their invoice. No items will be shipped until payment is made in full. High-value or flagged invoices may require payment by wire transfer at the auctioneer's discretion prior to release or shipment of items. ________________________________________ PAYMENT AUTHORIZATION By registering for this auction, the bidder authorizes John T. Henry Auction Co., LLC to charge the credit card on file for all purchases, including buyer's premiums, taxes, and applicable fees. The bidder agrees that this authorization is ongoing and applies to all invoices. Failure to complete payment does not invalidate the transaction or the bidder's obligation to pay. ________________________________________ ADDITIONAL INFORMATION Removal of items is the buyer's responsibility. Buyers must bring their own help, tools, and transportation. Items not picked up by the stated deadline will be considered abandoned property and may be resold with no refund. John T. Henry Auction Co., LLC does not provide transportation, moving, or loading services. Payment must be completed in full prior to removal or shipment of any items. ________________________________________ TRANSFER OF OWNERSHIP Ownership of items transfers to the buyer immediately upon being declared the winning bidder. All risk of loss, damage, or theft passes to the buyer at that time, regardless of pickup or shipping status. ________________________________________ SHIPPING, TRANSFER & FORFEITURE POLICY All items designated for shipping will be removed from the auction site and transported to the auction company�s facility. Items are picked up from the auction site on Tuesday of the week following the auction, at which time they are transferred to the third-party shipper, Carolina Relocation Services LLC (CRS), for packing and shipment.Once items are transferred to CRS, they are considered released from the auction company and are in the possession of the shipper on behalf of the buyer. The auction company will settle with the consignor at that time.By requesting shipping, the buyer agrees to pay all shipping, handling, and packing charges directly to CRS. Failure or refusal to pay shipping charges will result in forfeiture of all merchandise with no refund. Forfeited items become the property of the shipper, who may dispose of or resell them at their discretion.All sales remain final. Chargebacks and payment disputes are strictly prohibited. ________________________________________ THIRD-PARTY SHIPPING DISCLAIMER All shipping is handled by a third-party provider. John T. Henry Auction Co., LLC is not responsible for shipping damage, delays, lost items, or shipping costs. Any claims related to shipping must be made directly with the shipping provider. ________________________________________ REGISTRATION AND BIDDING TERMS All bidders must register and agree to these terms prior to bidding. All items are sold AS IS, WHERE IS, with all faults and no guarantees. Descriptions, titles, and photographs are provided as a convenience only. Some descriptions may be generated or assisted by artificial intelligence (AI). While efforts are made to ensure accuracy, errors or omissions may occur. Photos are for reference only. Color, condition, and details may vary. Bidder inspection is strongly encouraged. By bidding, bidders acknowledge they have either inspected the items or waived their right to do so and are relying solely on their own judgment. All sales are final. No refunds, returns, or exchanges will be permitted. Bids may be canceled or denied at the auctioneer's discretion, including for suspected fraud, prior non-payment, excessive chargebacks, or violation of any terms. ________________________________________ ORDER HOLD & CANCELLATION The auctioneer reserves the right to hold, delay, or cancel any order due to suspected fraud, verification issues, non-payment, or violation of terms. ________________________________________ CHARGEBACKS AND PAYMENT DISPUTES By registering and bidding, the bidder expressly authorizes all charges and agrees not to initiate a chargeback or payment dispute for any reason. All transactions are final once the bidder is declared the winning bidder and payment is processed. Buyers acknowledge and agree: " Items are sold AS IS, WHERE IS " Descriptions, photos, and AI-generated content may contain errors or omissions " Shipping is a separate third-party service These acknowledgments constitute full acceptance of the transaction. Any chargeback or dispute will be considered a breach of contract. The buyer agrees to be responsible for: " A minimum $150 administrative fee " All collection costs " Attorney's fees " Any damages incurred The auction company reserves the right to submit all supporting documentation, including IP address, bidding records, invoices, and delivery confirmation. Buyers who initiate chargebacks may be permanently banned and reported for fraudulent activity. ________________________________________ BUYER VERIFICATION POLICY The auctioneer reserves the right to require identity verification at any time. Any assistance provided is a courtesy only and performed at the buyer's sole risk. John T. Henry Auction Co., LLC and its staff are not responsible for any damage to items, vehicles, or property during loading or removal, regardless of assistance provided. Buyers assume all risk of injury or damage during removal. ________________________________________ FAILURE TO PICK UP Failure to remove items within the scheduled pickup window constitutes forfeiture without refund. Auction located at 108 Rena Lane, Conway, SC 29527. This is an online-only, on-site auction featuring the historic Linden Gates. Bidding will take place online only through the auction catalog. There will be no live bidding on-site. The auction will close Sunday, May 31st, 2026 at 6PM.
These gates were featured in the book �Lost Newport: Vanished Cottages of the Resort Era� by Paul F. Miller and represent a rare opportunity to purchase an exceptional piece of architectural history. Serious buyers are encouraged to attend preview and inspect the gates in person prior to bidding.
Preview will be held Sunday, May 31st from 2PM-5PM. Private preview appointments may also be scheduled for qualified buyers unable to attend during the scheduled preview timeframe.
Payment in full is required immediately following the auction by wire transfer or cash only. No credit cards will be accepted for this auction.
Pickup will be by appointment only during the week of Monday, June 1st, 2026. Buyers are fully responsible for removal, loading, transportation, rigging, manpower, permits, and any equipment necessary for removal of the gates. Please come prepared with qualified movers and proper transportation.
A 13% buyer�s premium will be added to the final bid price. All items are sold as-is, where-is with no guarantees or warranties expressed or implied.
