By bidding on an item in this sale you agree to the following terms.

No statement regarding condition, kind, value, or quality of a lot, whether made orally or in writing in our catalog or elsewhere, shall be construed to be an expressed or implied warranty or representation. Any such warranty is waived. Inspect before you bid.

Bradeen Auctions reserves the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal.

Property Inspection: Items will be available for inspection at Bradeen Auctions, 9 W. Mt. Rushmore Rd. Custer, SD on Tuesday May 26th, from 11am to 1pm. See the detailed descriptions & photos in the online catalog, at www.bradeenauction.com.

---PAYMENT---

We accept cash, check, or credit card (Visa, Master Card, Discover and American Express) 3.75% swipe fee on credit card payments. *Credit Card transactions may be limited by dollar amount and a wire transfer requested at our discretion for shipping purchases. We will not charge over $900 on a credit card. You will need to set up a wire transfer. *

Cash and check payments accepted on settlement day during scheduled hours. After that time, only payment by credit card will be accepted.

Wiring instructions can be provided upon request and all wire transfers will be assessed a $10 fee.

South Dakota sales tax charged on all items except currency & titled lots.

If you have a tax-exempt license, you must have a current (within the preceding 12 calendar months) South Dakota Certificate of Exemption form on file with Bradeen Auctions or sales tax will be collected. Be prepared to fill one out at checkout.

You must contact Bradeen Auctions by phone, email, or in person during the scheduled onsite settlement if payment is other than the credit card used for registration.

You authorize Bradeen Auctions to charge your credit card if no contact has been made by the end of the scheduled settlement. Please note the buyer will also be responsible for a 3.75% credit card transaction fee, and handling/storage fees incurred by Bradeen Auctions. Any items left will be forfeited after 7 days with NO refund.

---REGISTRATION---
A credit card is required for auction registration to verify the identity of our bidders and to protect the integrity of our bidder's pool. Thank you for your cooperation.

If you believe you have registered but have not been asked to enter your credit card information YOU HAVE NOT FINISHED THE REGISTRATION PROCESS. The first lot you bid on will prompt you to enter your credit card information. Please bid early to ensure you are completely registered.

---SETTLEMENT & TRANSFER OF POSSESSION---

Property Settlement & Pickup: All items must be settled for Wednesday May 27th between 10am & 12pm at Bradeen Auctions, 9 W. Mt. Rushmore Rd. Custer, SD. No Exceptions.

Lots 100-120 are located at County Shop 25365 US Hwy 385 Custer, SD.
Lots 121-136 are located at Bradeen Auctions, 9 W. Mt. Rushmore Rd., Custer, SD.
Lots 150-154 are located at City Shop, 31 S. 3rd St., Custer, SD.
Lots 200-207 are located at City Dump, 12357 Willow Creek Rd., Custer, SD.

Cash, card and check payments accepted on settlement day during scheduled hours. After that time, only payment by credit card will be accepted.

As a successful bidder, it will be your responsibly to remove all your items by the given date. Please plan accordingly and bring the necessary assistance and vehicles/trailers required to load and haul your items.

All items must be paid in full prior to loading. You will be required to provide a copy of your paid in full receipt before you will be allowed to remove any items from the property.

---ADDITIONAL FEES & EXPENSES---

Services include payment by credit card, handling, storage, & shipping. Buyers can avoid all additional fees by paying with cash or check in person at the scheduled onsite settlement, and removing all items.

If you are unable to attend the scheduled onsite settlement the following fees will apply.

1.) Your card on file will be charged with a 3.75% credit card swipe fee. Cash and check payments only accepted on settlement day during scheduled hours.

2.) Minimum $15 handling/storage fee per bidder. Additional handling/storage expense incurred depending on size and/or volume of items.

3.) No shipping available.

4.) Items left over 7 days will be forfieted with no refund.

5.) Bradeen Auctions is not liable for damages to your items in shipping. If you would like us to add insurance on your shipment please let us know prior to packaging and we will gladly add this for you.

***ONLINE AUCTION DISCLAMER***
When using our online auction services, you are making firm commitments to purchase said item(s) and are entering into a legal and binding contract. Bids may not be cancelled or retracted for any reason. Nonpaying bidders or fraudulent bidding will subject you to legal recourse and possible criminal charges including any fraud and/or interstate commerce violations. You also acknowledge that the Internet may be an unreliable and error prone network. Bradeen Auctions will not guarantee that bids placed online will always be transmitted to or received by the auctioneer in a timely fashion. You agree to hold Bradeen Auctions and their employees harmless for any interruptions in online bidding. Further, the auctioneer has the sole discretion to accept or refuse any bid. Bradeen Auctions retains the right, at our sole discretion, to add, delete or change some or all of our online services and the terms and conditions governing their online auctions at any time without notice. Bradeen Auction further reserves the right to cancel and/or reopen the auction in the case of system failures.
