A 10% nonrefundable down payment is due within forty-eight (48) hours following the close of the Auction. The sale is not contingent upon Buyer obtaining financing or upon any other contingencies. Any desired inspections must be completed prior to bidding. All information contained herein is derived from sources deemed reliable but is not guaranteed or warranted by Seller or Auctioneer. Property is sold “AS IS, WHERE IS” with no warranties expressed or implied.
Seller shall convey title to the Property by General Warranty Deed, free and clear of all liens and encumbrances, except easements, restrictions, conditions, covenants, zoning regulations, and matters of record. Real estate taxes shall be prorated to the date of closing. Closing shall occur within forty-five (45) days following execution of the Purchase Agreement unless otherwise agreed by the parties in writing. A 10% Buyer’s Premium will be added to the final high bid to determine the Total Contract Price. BIDDER APPROVAL Please note that approval is required in order to bid on this auction. Bidder approval closes one (1) hour prior to the scheduled soft close time. Example: if the soft close is scheduled for 7:00 PM, bidder approval will close at 6:00 PM. Kaufman Realty & Auctions strongly recommends completing all registration requirements and requesting approval at least twenty-four (24) hours prior to the scheduled closing time. Kaufman Realty & Auctions shall not be responsible for delays in registration, technical issues, or failure to meet approval requirements prior to bidding. PURCHASE CONTRACT & EARNEST MONEY Successful bidders will be emailed a Real Estate Auction Purchase Agreement following the conclusion of the auction. The successful bidder must execute and return the Purchase Agreement to Kaufman Realty & Auctions within forty-eight (48) hours following the close of the auction. Successful bidders shall deposit an amount equal to ten percent (10%) of the Total Contract Price by wire transfer or cashier’s check payable as directed by the Settlement Agent or Auction Company. Instructions for wire transfer and/or delivery of cashier’s checks will be provided by email. Buyer shall be responsible for all wire transfer fees. The balance of the purchase price shall be due in full at closing. Failure of the successful bidder to execute and return the Purchase Agreement and earnest money deposit within forty-eight (48) hours shall constitute a default. SOFT CLOSE At the close of bidding, the bidding platform will automatically extend the bidding period by five (5) minutes whenever a bid is placed within the final five (5) minutes of the scheduled closing time. The auction will continue in this manner until no bids are placed within the extension period.
