The property listed in this catalog is offered by Epic Auctions and Estate Sales, LLC (�Epic Auctions�), as owner or as agent for the consignor(s), and is sold subject to the following Terms and Conditions of Sale (�Terms�). By registering to bid, bidding, or otherwise participating in this auction, you acknowledge that you have read, understand, and agree to be bound by these Terms in full.Epic Auctions is the sole authority for the conduct, regulation, interpretation, and enforcement of this auction and these Terms, including all pre-auction, auction-day, and post-auction processes. 1. ACCEPTANCE OF TERMS & AUCTION AUTHORITY These Terms constitute the entire agreement governing this auction. Registration to bid, receipt of a bidder number, placement of any bid, or participation in the auction in any manner constitutes full and unconditional acceptance of these Terms.Epic Auctions reserves absolute discretion to manage, conduct, regulate, interpret, and enforce all aspects of the auction. Any announcements, clarifications, corrections, or notices�whether posted online, in writing, or announced orally�are binding and form part of these Terms. 2. CONSENT TO COMMUNICATIONS By registering to bid or participating in this auction, you expressly consent to receive communications from Epic Auctions, including email messages, telephone calls, and text messages (SMS/MMS), whether transactional, informational, or marketing in nature. This consent authorizes Epic Auctions to add your contact information to its email and text marketing databases. Message and data rates may apply. Consent to receive marketing communications is not a condition of purchase. You may opt out of marketing communications at any time using the opt-out instructions provided. 3. BUYER DUE DILIGENCE & RESPONSIBILITY All bidders are solely responsible for inspecting, examining, and determining the condition, authenticity, and suitability of any item prior to bidding. By placing a bid, you affirm that you have either personally inspected the item, arranged for an inspection, relied solely on your own judgment, or knowingly waived inspection.Epic Auctions does not guarantee descriptions, condition reports, photographs, or opinions. If absolute certainty is required, bidders are encouraged to consult independent experts prior to bidding. The bidder bears full responsibility for bidding on the correct lot. 4. CATALOG, DESCRIPTIONS & OPINIONS All descriptions, photographs, condition statements, estimates, and other representations are opinions provided as a convenience to bidders and are not statements of fact or guarantees. Epic Auctions attempts to catalog and photograph lots accurately but makes no warranty regarding accuracy or completeness. Measurements and weights are approximate. The absence of a condition statement does not imply the absence of wear, damage, or defects.Neither Epic Auctions nor the consignor shall be liable for errors or omissions in any catalog, condition report, photograph, advertisement, or supplemental material. 5. AS-IS SALE WITH LIMITED REMEDY FOR MATERIAL ERROR All property is sold AS IS, WHERE IS, with all faults, and without warranties of any kind, express or implied. Descriptions, condition reports, photographs, and statements made by Epic Auctions are opinions intended as a guide for bidders and are not guarantees.Notwithstanding the foregoing, if Epic Auctions determines, in its sole discretion, that a lot was materially misdescribed due to a significant cataloging error, Epic Auctions may, as a courtesy and at its option, authorize a return or other remedy. Any request for review must be submitted in writing within fifteen (15) calendar days of the buyer�s receipt of the item.Remedies, if any, are limited to repair, replacement, return, or refund of the purchase price, as determined solely by Epic Auctions. Prior authorization is required for any return. Epic Auctions may, but is not obligated to, cover return shipping costs when a material error is confirmed.No remedy will be provided for buyer�s remorse, differences of opinion, normal wear consistent with age or use, or matters that were visible or disclosed prior to bidding.Plain-language explanation: Most items are final sales. RESERVES & SELLER BIDDING Certain lots may be subject to a confidential reserve. Epic Auctions may place bids on behalf of the seller up to the reserve amount. Once the reserve is met, all bidding is competitive. Lots may or may not be designated as having a reserve.This auction permits bids to be placed by the auctioneer, employees of the auctioneer, the seller, or agents of the seller, as disclosed herein. 7. AUCTIONEER DECISIONS & BID RECOGNITION The auctioneer has sole discretion to recognize bids, advance bidding increments, reopen bidding, resolve disputes, or determine the winning bidder. The auctioneer�s authority includes the right to void or reopen any lot when necessary to preserve the fairness or integrity of the auction.In the event of a dispute, the auctioneer�s decision is final and binding. Epic Auctions� records shall be conclusive in all matters.Plain-language explanation: The auctioneer makes the final decision on bids and auction results. 8. ABSENTEE, TELEPHONE & ONLINE BIDDING Epic Auctions may, as a courtesy, execute absentee or telephone bids but assumes no liability for failure to execute such bids or for errors or omissions. All bidding methods are subject to the same Buyer�s Premium and Terms. 9. TECHNOLOGY FAILURE, PLATFORM INTERRUPTION & AUCTION RESTART AUTHORITY Epic Auctions is not responsible for failures, delays, interruptions, errors, or omissions caused by internet connectivity issues, software malfunctions, platform outages, data transmission failures, latency, or third-party service providers, whether partial or complete, and whether known at the time or discovered after the fact.If Epic Auctions determines, in its sole discretion, that a technology failure materially affected bidding activity, bidder access, bid visibility, or the fairness or integrity of the auction, Epic Auctions reserves the absolute right to pause, extend, reopen, void bids, declare previously sold lots unsold, restart the auction in whole or in part, reschedule the auction, or re-offer affected lots.This authority applies even if lots were previously declared sold. 10. WITHDRAWAL OF PROPERTY Epic Auctions reserves the right to withdraw any property from the auction prior to the close of bidding for any reason. 11. BUYER�S PREMIUM & TAXES All successful bids are subject to a 25% Buyer�s Premium. Applicable sales tax will be charged unless valid exemption documentation is provided prior to auction close. Sales tax is not refundable once payment is processed. 12. PAYMENT TERMS & METHODS Payment in full is due no later than 5:00 PM on the second business day following the auction. Title does not pass until payment has cleared.Accepted methods include Visa, MasterCard, Discover, American Express, and wire transfer. Epic Auctions may require wire transfer or certified funds at its discretion. Declined payments may be subject to a $50 fee. 13. STRICT NO-CHARGEBACK POLICY BUYERS ARE EXPRESSLY PROHIBITED FROM INITIATING CHARGEBACKS OR PAYMENT DISPUTES WITH ANY CREDIT CARD COMPANY, INCLUDING AMERICAN EXPRESS, FOR ANY REASON.Any buyer initiating a chargeback shall be responsible for a minimum administrative fee of $100, plus any processor, bank, or card-issuer fees imposed on Epic Auctions, to the fullest extent permitted by law.Chargebacks constitute a material breach of these Terms.Plain-language explanation: Do not dispute charges with your credit card company. Contact Epic Auctions directly if there is a problem. 14. NON-PAYMENT, DEFAULT & SECURITY INTEREST Failure to pay in full constitutes default. Epic Auctions may impose a late charge of 1.5% per thirty (30) days, cancel the sale, resell the property, recover deficiencies, block future bidding, and pursue all legal remedies.A defaulting buyer grants Epic Auctions a security interest in any buyer property in Epic Auctions� possession as collateral for amounts owed. 15. PACKING, SHIPPING & STORAGE Epic Auctions provides professional in house packing and shipping services for most small and medium sized items. Our experienced team carefully prepares each item for safe transit using appropriate materials and methods tailored to the item. Packing labor is billed at a rate of $60 per hour and is calculated based on the actual time required to properly prepare each shipment. This ensures buyers are charged fairly based on the level of care and complexity involved. Smaller items requiring only a few minutes to pack will incur minimal labor charges, while larger or more delicate groupings such as full sets or fragile collections may require additional time to ensure each piece is properly protected. All packing time is tracked and billed incrementally to provide precise, transparent, and equitable billing. In addition to labor, charges will include the cost of new shipping boxes, packing materials, insurance, and the retail cost of shipping. All packages are shipped with required insurance and signature confirmation to help ensure safe and secure delivery. Buyer provided or third party shipping labels are not accepted.Shipping and packing invoices must be paid promptly. If unpaid for five (5) calendar days, Epic Auctions is authorized to charge the credit card on file. Items remaining after fourteen (14) calendar days may incur a storage fee of $5 per lot per day. Items not removed or shipped within thirty (30) days may be considered abandoned. Epic Auctions is not responsible for the performance or conduct of third party shipping carriers. International buyers assume all risk of loss, damage, delays, and customs related issues. 16. ABANDONED PROPERTY Property not paid for or removed within thirty (30) days will be considered abandoned and disposed of without refund. 17. RISK OF LOSS Risk of loss transfers to the buyer at the close of the lot. Epic Auctions� liability is limited to the amount paid. 18. FIREARMS, AMMUNITION & REGULATED ITEMS All firearms, ammunition, knives, and other regulated items are sold subject to all applicable federal, state, and local laws. It is the buyer�s sole responsibility to know and comply with the laws of their state, county, and municipality of residence. Dealers and out-of-state purchasers must have in their possession on the day of sale signed copies of their valid Federal Firearms License (FFL) in order to accept same-day delivery of modern firearms. Purchasers acting as agents for FFL dealers must provide an original signed letter of agency as well as a signed copy of the dealer�s FFL. Epic Auctions will accept a valid Curio & Relic (C&R) Federal Firearms License (03 FFL) for firearms that legally qualify for transfer under a C&R license. It is the buyer�s responsibility to ensure the firearm qualifies for transfer under their license. Purchasers who do not possess a valid FFL will be subject to all required background checks and must complete all necessary federal and state transfer documentation. Refunds will not be issued due to a buyer�s failure to pass a required background check. If a buyer fails a background check or is otherwise legally unable to take possession of a firearm, the firearm will be resold at a future auction. The original buyer will receive the net resale proceeds, less the auction company�s commission, buyer�s premium, storage fees, and any related costs. Online buyers are responsible for payment in full before firearms will be shipped. All firearms must be shipped to the purchaser�s designated FFL dealer unless otherwise permitted by law. Certain states and local jurisdictions treat black powder arms, antique firearms, ammunition, knives, or other regulated items as firearms or otherwise restricted items. Epic Auctions will comply with the laws of the receiving state and locality for all firearms, black powder arms, ammunition, knives, and related items. If the laws of the receiving jurisdiction prohibit shipment or transfer of an item, the sale may be cancelled or the item resold at the buyer�s expense. All firearms purchased by Michigan residents require completion of Form RI-60 as required by law. All firearms and ammunition are sold as collector lots only. Fitness to fire or otherwise discharge is expressly denied. A competent gunsmith should inspect any firearm prior to use. 19. DISPUTE RESOLUTION: MEDIATION & ARBITRATION Disputes must first be addressed directly with Epic Auctions. If unresolved, mediation shall be conducted by a neutral mediation provider selected by Epic Auctions, in Michigan, under standard rules. Mediation costs are shared equally unless required otherwise by law.If mediation fails, disputes shall be resolved by binding arbitration in Michigan. Each party bears its own legal fees unless awarded otherwise. 20. LIMITATION OF LIABILITY Epic Auctions shall not be liable for incidental, consequential, or punitive damages. Liability is limited to the amount paid. 21. INTELLECTUAL PROPERTY These Terms are the intellectual property of Epic Auctions and Estate Sales, LLC.
