Please review carefully. Participation in this auction, in person or online, constitutes acknowledgment and acceptance of all terms below.

Sale Confirmation: Property will be sold subject to the confirmation of the seller. The seller reserves the right to accept or reject any and all bids.

Pre-Auction Offers: While offers are typically reserved for auction day, the seller will consider pre-auction offers on any lot in this sale. To be considered, any pre-auction offer must be submitted on the same terms and conditions as the auction — including AS-IS, WHERE-IS condition with any and all faults, a 10% buyer's premium added to the offer price to determine the final contract price, short tax proration (buyer assumes approximately six months of real estate taxes), and buyer pays all closing costs — with no contingencies for financing or inspections. All pre-auction offers remain subject to seller confirmation, and the seller reserves the right to accept, reject, or counter any offer. An accepted pre-auction offer may result in that lot — or the entire auction — being closed and removed from bidding prior to the scheduled end time. Buyer's Premium: A 10% buyer's premium will be added to the high bid to determine the final contract price. Financing, if any, will be based on the final contract price.

Contract: The purchaser will be required to sign a Contract to Purchase immediately upon conclusion of the auction. A sample Auction Contract to Purchase Real Estate is available for review under the "Documents" tab on this site and will also be provided at auction close.

Deposit: A non-refundable deposit of 10% of the final contract price is due upon the seller's acceptance of the winning bid, delivered within 24 hours of acceptance via wire transfer to the closing agent (wiring instructions provided after acceptance). The deposit will be applied to the purchase price at closing.

Closing Agent: Talon Title Agency, Inc. in Pickerington, Ohio will act as the closing agent. Preliminary title exam work is being completed and will be provided to all potential bidders.

Closing: Closing shall occur on or before 30 days from the contract acceptance date, through Talon Title Agency, Inc.

Closing Costs: Buyer to pay ALL closing costs, including but not limited to title search, transfer taxes, deed preparation, conveyance fees, and recording fees.

Taxes: Pro-rated via the short proration method — the buyer assumes approximately six (6) months of accrued real estate taxes.

Survey: If a survey is required for transfer or recording, it will be at the buyer's expense.

Deed & Title: A marketable, insurable deed will be delivered to the buyer at closing, free of liens and back taxes.

Property Condition: Property sells in AS-IS, WHERE-IS condition, with any and all faults, and without warranties of any kind, expressed or implied, including but not limited to condition, value, square footage, acreage, zoning, permitted use, environmental status, utilities, access, or fitness for a particular purpose. There are no buyer contingencies for financing, inspections, or otherwise. Each property is sold subject to any and all easements, restrictions, covenants, conditions, leases, rights-of-way, and encumbrances of record. By placing a bid, the bidder acknowledges and accepts these terms.

Tenancy: The three South High Street properties (Lots #1, #2, and #3) are currently occupied by month-to-month tenants who are not to be disturbed. It will be the new owner's responsibility to determine whether to enter into a lease with the existing tenant, request that they vacate, or pursue another arrangement after closing.

Property Viewing: Curbside viewings and offers only — please do not disturb the tenants.

Realtor Participation

Realtor cooperation is welcome. A licensed agent who registers a buyer that successfully closes will be paid a 2% co-op commission (based on the total contract price — high bid plus buyer's premium) at closing. To qualify:
