Additional Terms and Conditions for Portable Buildings
UNITED ISD SURPLUS PORTABLE CLASSROOM AUCTION SPECIAL TERMS AND CONDITIONS United Independent School District. Ramps, Awnings, and Porch are not included in the sale.
All movers will obtain all permits and insurances required by any state or local government authority for the removal of the Portable Buildings. The successful bidders shall have 60 calendar days from the auction to remove all purchases.
It is the responsibility of each winning bidder, not the mover to ensure the areas of the portable buildings have been cleaned. When moved, areas around portables must have all debris removed. The site shall be left free of all debris and clean. Debris will include all bricks, wood or anything under or around portable.
All Utilities have been cleared, there are no electric and other utility connections. The successful bidder shall cash deposit with United Independent School District the sum of $250.00 to ensure cleanup of each portable classroom/building. Ex. Two winning portables = $500 Maximum deposit is $500. Payment for cash deposit is due on payment day. The site will be inspected to ensure all cleanup has been remedied. AMT Auction will release the $250.00 per portable, maximum $500, to the successful bidder without further claim. Failure to move a portable building will result in losing deposit and all payments There are no refunds.
The auction is for portables buildings only, any equipment pictured inside portable is not included in the sale of portable building. Movers must provide all help to relocate building, UISD is not responsible for providing any assistance, help, labor or equipment.
INSPECTION IS STRONGLY RECOMMENDED:
Condition of all portable buildings is Used.
Composite roof, Siding is wood. Glass windows may or may not be broken. Each classroom will have environmental controls with Air conditioning and Heating that may or may not work.
Cost of removing portable is the sole responsibility of buyer.

Additional Terms and Conditions for Computers, Laptops, Chrome books and IT Equipment
Computers/Laptops, Chromebooks and IT Equipment*** *Must provide DoD (U.S. Department of Defense) certificate of erasure before bidding or bidding will be blocked*
All computer equipment is TIMES the MONEY.
Conditions of Devices are good condition to damaged Items, they are used. You are purchasing the entire lot AS IS, WHERE IS, WITH ALL FAULTS and NO GUARANTEE AND NO WARRANTY.
If you do not meet these requirements, you will be blocked from bidding on Computer items. You must contact Auction with required DoD certification of destruction. You will be required to send a completed report once all devices have met the requirements of this auction.


Requirements - provide documentation for all items listed below and how you comply with these requirements. You must carry a DoD Certification of Destruction
1. Vendor must be e-Steward and/or R2 certified
2. Comply with all state and federal security, privacy, environmental, and universal and hazardous waste laws and regulations.
3. Ensure that no UISD devices are landfilled.
4. Physically destroy all software, media, and data containing devices or material from devices
5. Provide certificates of destruction for all electronics and data-containing devices that are processed.
6. Ensure all potential data-containing devices in their possession be fully protected from loss or theft prior to physical destruction.
7. Physical destruction of data-containing devices must meet or exceed NIST 800-88r1 guidelines and NAID AAA physical destruction requirements.
8. Data destruction must ensure that sensitive or proprietary information is fully protected against identity theft, Vendor must assume that all media and data-containing devices contain personal identifying information and is compliant with federal regulations governing:
o HIPAA (Health Insurance Portability and Accountability Act of 1996) safeguards and protects the security and confidentiality of health information in any form or media; electronic, paper or oral
o FACTA (Fair and Accurate Credit Reporting Act) is intended primarily to help consumers fight the growing crime of identity theft and reduce the risk of consumer fraud.
o FERPA (Family Educational Rights and Privacy Act) protects the privacy of student education records including name, SS#, DOB, address, grades, progress reports, or disciplinary action.
o GLB Act (Gramm-Leach-Bliley Act) includes provisions to protect consumers' personal financial information held by financial institutions, which include not only banks, securities firms, and insurance companies, but also companies providing many other types of financial products and services to consumers.


Auction Terms & Conditions by registration or bidding you agree, unequivocally and without any exception, to all of terms and conditions, including announcements made prior to the auction. You must be 18 years old to register and bid at the Auction.

1.Payment is due Friday, July 31st, after the auction until 4 pm, and on Saturday, August 1st, from 9 am to 4 pm. All bank wires must be completed within three days. All Non-payments will be barred from all future Auctions. We report all non-payments to the auction platforms Hibid.

2. BUYER'S PREMIUM: 12% is In Effect for All Items. Example If You Purchase an Item For $100 Add 12% Or $12 For A Total Of $112.00 If Sales Tax Applies Then You Add Tax.

3. METHOD OF PAYMENT. Cash, MasterCard, Visa, CashApp or Bank Wire Transfer for over $3500. 8.25% Sales Tax Is Applied To All Non-Titled Items. Unless you provide a valid sale tax exemption.

7. REPRESENTATIONS: All Items Are Being Sold As-Is With No Warranty. Auctioneer Shall Not Be Responsible For Any Incorrect Description, Authenticity, Genuineness Of Or Defect In Any Lot, And Makes No Warranty In Connection Therewith. Auctioneer Makes Every Effort To Provide Accurate Information About The Items Being Sold. Errors May Occur, Either Written Or Verbal. It Is the buyer's full Responsibility To Confirm The Accuracy Of Items Offered For Sale. INSPECTION IS HIGHLY RECOMMENDED.

8. ALL SALES ARE FINAL: A Successful Bid At Auction, Whether Live Or Online, Constitutes A Legally Binding Contract Of Sale. All Sales Are Final. There Will Be No Refunds, Returns Or Exchanges.

9. FAILURE TO REMOVE PURCHASES: In The Event Items Are Not Removed In The Time Frames Allotted, The Items Purchased Shall Be Deemed Abandoned And Buyer Will Lose Any Right, Title Or Interest Buyer May Have Acquired And The Items Shall Revert To United Independent School District Without Notice To Buyer. United Independent School District Reserves The Right To, At Its Discretion, Resell Such Property, Either Private Or At Public Sale if terms and conditions are not met Consider This Your Notice.

10. ACTS OF OTHERS: Persons In Attendance During Inspection, Or Removal Of Merchandise Assume All Risks Of Damage Or Loss To Persons, Property, Or Merchandise And Shall Exercise Proper Precautions At All Times For The Protection Of Persons And Property And Shall Comply With All Safety And Health Requirements As Directed By Auctioneer. Neither Auctioneer, Its Sub- Contractors, Its Agents, Its Employees Or Representatives Shall Be Liable By Reason Of Any Defect In Or About The Condition Of The Premises On Which The Auction Is Held. Buyer Specifically Releases Auctioneer, Its Agents And Representatives From All Liability Thereof.

INDEMNIFICATION: Buyer Shall Indemnify, Hold Harmless And Defend Auctioneer, Owners And Building Owners From And Against Any And All Losses, Damages, Liabilities And Claims, Including Attorney Fees, Costs And Expenses Arising Out Of Based Upon Or Resulting From: (1) Failure To Secure All Safety Equipment And To Meet All Applicable Government Safety Standards In Removing Items Purchased Or Used By Buyer, (2) Failure To Comply With Safety Instructions Issued To Buyer From Auctioneer, (3) Any Act Or Omission Of Auctioneer, Owners, Building Owners Or Their Respective Agents, Representatives Or Employees, Relating To Or Affecting The Items Bid On Or Purchased By Buyer, (4) The Claim Of Any Third Party Claiming Or Challenging Title To Any Items Purchased By Buyer Or Claiming Infringement Of Any Proprietary Interest, (5) The Claim Of Any Person Resulting From Auctioneer Offering For Sale Or Selling The Items Purchased By Buyer, (6) Any Injury To Buyer Or Any Other Person Or Property Of Any Type Whatsoever Caused During The Inspection, Dismantling, Removing Or Transporting Of Items Purchased By Buyer.

13. Errors: We Reserve The Sole Right To Settle Any Dispute Or Tie Bids Between Bidders. In The Event Of An Live/Online Error We Reserve The Sole Right To Cancel Any Winning Bid.

14. Housekeeping. Please Do Not Litter Or Leave Trash On The Grounds.

15. Auction Is Conducted with A Reserve. We reserve the right to pass any item.

16. Collusion: Practices to eliminate competition, such as collusive bidding with the intent to not pay, drive invalid bids may warrant criminal, civil or administrative action against the participant(s) and may referrer to the seller and the State Attorney General Office. Online fraud is a Felony.

17. Inventory may change at the will of United Independent School District or AMT Auction.
