By bidding with our auction company, you agree to the following.
-ALL SALES ARE FINAL. Everything is sold "AS IS" with no guarantees, exchanges, returns, credit, or refunds unless otherwise stated by the auctioneer. It is the bidder's responsibility to ensure they are aware of the condition of the items before bidding. If Bontrager Real Estate & Auction Service agrees to provide a guarantee, all refunds, exchanges, and returns must be requested within 7 days of the customer taking possession of the merchandise. Requests after that point may be denied. Refunds will not be considered for any item sold more than 60 days from the date the refund is requested. Bontrager Real Estate & Auction Service reserves the right to refuse refund requests for any item that has left the auction site and may have been altered or damaged after it has left. Chargebacks are not allowed. -CONDITION REPORTS given by the staff of Bontrager's Auction Service are subjective; while we strive to be honest and thorough, we will not be held responsible or liable for any errors in description. Buyers are responsible for examining and/or obtaining adequate information about the item before bidding. Bontrager Real Estate & Auction Service does not accept responsibility for the buyer's failure to examine or obtain adequate information. Merchandise is not subject to adjustments once the item has been sold. -QUANTITY: Your bid will be multiplied by the quantity of the lot you are bidding on. Bidders are expected to read descriptions and quantities carefully. There are no refunds, returns, or exchanges for failure to read and understand descriptions and quantities. -LIABILITY: Bontrager Real Estate & Auction Service and its staff will not be held responsible or liable for any errors in absentee/left bids or phone bids, nor for the possible failure to execute any bids for any reason. -PAYMENT is due in full at the close of the auction without exception. Immediately after all online auction lots have closed, the bidder's credit/debit card on file with Hibid.com will be charged. We accept Visa, MasterCard, or Discover. If your payment does not go through, we will email you a payment link from Global Pay. We do not accept payment at the auction pick-up. We do not accept personal checks. Bidders who consistently pay more than 24 hours after the close of the auction may be charged $5 per day until payment has been completed. Payments not completed within 48 hours of the close of the auction are considered abandoned bids, which are subject to disposal or resale. Failure to pay within prescribed time frames may affect a bidder's ability to participate in future auctions. -BUYER'S PREMIUM AND SALES TAX: All sales are subject to appropriate sales tax and buyer's premium. Buyer's premium is 15% of the purchase price (unless otherwise posted), regardless of the payment method used (there is no discount for paying another way). Buyer's premium is subject to sales tax. Late payment will result in a $35 late fee. Buyers with declined cards can pay via a payment link we send via email/text. If Bontrager staff must key in the payment information, the buyer's premium will be 20% instead of 15%. Credit/debit card payments will not be taken over the phone. SALES TAX EXEMPTION POLICY: It is the buyer's responsibility to ensure the required sales tax exemption paperwork is complete, correct, and on file with the auction company before the auction starts closing. If it is not, sales tax will be charged. Bontrager Auction does not provide sales tax refunds for paperwork that is submitted after the auction closes; buyers must file a claim with the state to obtain a sales tax refund. At a minimum, forms must be updated annually. We do not honor out-of-date, incomplete, or incorrect sales tax exemption forms. At the top of the NY state ST 120 form, the buyer's name and address MUST EXACTLY MATCH THE DBA on file with the state, or it will be considered invalid. Forms can be scanned to sandra@bontragerauction.com up to one hour BEFORE the auction closes. Pictures of forms sent by text or email will not be accepted because they don't print out clearly. Forms must be signed by the authorized person AND the actual auction bidder. We do not honor out-of-date, incomplete, or incorrect sales tax forms. Forms can be submitted to bontrager@bontragerauction.com up to one hour before the auction closes. -CONTRACT: By bidding in our auction, you are entering into a contract with our terms and conditions. You are accepting responsibility to perform your duties as a bidder, and agreeing that Bontrager Real Estate & Auction Service, its employees, officers, owners, representatives, agents, and consignors will not be held liable for any losses, claims, liabilities, judgments, expenses, fees, or other damages arising from the use of our services, website, auction property, and this site, including property damage, injuries, dispute with another bidder, or breach by bidder of this site. Any liability to a purchaser will not exceed the purchase price paid. Failure of the bidder to uphold the bidding agreement as described in the Auction Terms can result in suspension of bidding privileges at Bontrager Real Estate & Auction Service. -Bontrager Real Estate & Auction Service does not sell firearms or ammunition outside the United States. -EXCHANGES/RETURNS/REFUNDS: Buying from an auction is different from buying at a retail store. Bidders are buying "as-is" with no guarantees, exchanges, returns, credits, or refunds unless specifically stated by the auctioneer. All refunds, exchanges, credits, and returns must be requested within 7 days of the customer taking possession of the merchandise. Requests after that point may be denied. Bontrager Real Estate & Auction Service reserves the right to refuse refund requests for any item that has left the auction site and may have been altered or damaged after it has left. Abandoned items that have not been picked up within 14 days of the close of the auction are not subject to refunds. Refunds are issued by check. We do not issue credit or credit/debit card returns. Successful bidders sign their receipts at the time of merchandise pick up, indicating that all items are present and in satisfactory condition. -INTERNET SERVICES: Bontrager Real Estate & Auction Service will not be held responsible for any interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted, or error-free service or use of the Site. By bidding with our company, you are accepting that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. -RIGHT TO SUSPEND PRIVILEGES: Bontrager Real Estate & Auction Service has the right to void any sale, suspend bidding, or re-sell any item/lots for any other reason. -BID RETRACTION: Bids cannot be retracted once the auction begins. -MERCHANDISE PICK-UP: Buyers are responsible for making arrangements to pay for and pick up items within the time frames listed for the auction. Any variation resulting in late, early, or alternative pickup or payment will incur additional fees for removal and storage (see the "Additional Fees" section). Fees still apply even if the customer provides prior notice that they will not be able to pick up on the scheduled date. The auction company does not provide delivery services unless otherwise stated in the auction. Bontrager's Auction Service is not liable for any damage to property left on the auction premises after the auction, whether or not payment has been made. -LATE OR ALTERNATIVE PICK-UP: Alternative pick-up arrangements must be mutually agreed upon before the close of the auction. In some cases, alternate pick-up is not available and lots that are not picked up will be disposed of, donated, or sold. In such cases, refunds are not available. Buyers forfeit merchandise left 7 or more days after the auction has closed, whether or not it has been paid for. Such merchandise is subject to sale without notice, regardless of the buyer's intent to pick it up at some future date. The proceeds of the sale will cover storage, staff time, and auction fees due to the auction company, and the buyer is not eligible for a refund. -Lots must be picked up on the alternate date we give you, or within 7 days of the scheduled pick-up date, or they will be resold to recoup our time. --LOADING MERCHANDISE: Buyers are expected to load their own merchandise. Bontrager Auction Service will not be responsible for damage to vehicles or merchandise if buyers choose to have them load instead of doing it themselves. -SHIPPING: Buyer pays all shipping fees, including any tax or duty associated with shipping outside the USA. -Insurance and signature confirmation are charged on every shipment. -The auction company does not automatically ship every lot. Each lot has a "Shipping Available" or "No Shipping Available" icon. -Judgment of "size" of the lot is at the discretion of the auction company. -Buyers who deem shipping too expensive and then abandon their purchases are still responsible for payment. -In the event that Bontrager Auction agrees to ship an item described in the auction with "no shipping", Bontrager Auction will not be responsible for damages from any part of the packing or shipping process, nor will Bontrager Auction submit an insurance claim or refund on behalf of the buyer. Handling charges depend on the package's size/weight/fragility of the package unless otherwise stated. In some auctions, buyers will be responsible for paying to transport the item from the auction site to the auction house for shipping. Buyers who live outside New York State or more than 3 hours from Batavia, NY, and DO NOT want shipping for shippable items, are responsible for notifying the auction company within 18 hours of the close of the auction that they DO NOT want shipping; otherwise, it will be assumed that the items are to be shipped. -ADDITIONAL CHARGES are as listed unless otherwise stated within the auction details: - Purchased items abandoned for any reason: Minimum $20 plus the cost of disposal will automatically be charged to your card. -Moving purchases to provide any alternate pick-up arrangement: $40 per hour, prorated based on size/volume/time, with a $5 minimum, automatically charged to your card. Fees are applicable regardless of whether the customer provides prior notice. The fee mentioned will also be charged if our staff has already relocated an item to fulfill your request for pickup or shipping, but then you change your mind or choose not to proceed with the item. -Moving purchases that require shipping from an auction site to bring them to the auction center for packaging: $40 per hour, prorated based on volume/time, automatically applied to the card on file. -A pattern of paying more than 24 hours after the auction has closed will result in a $5 per day fee until payment has been made to cover staff time. -Storage at auction facility: First week is free, then $10 per week. -Packing materials needed at the auction site, provided by the auction company: 50 cents per box. -Packing/handling in preparation for shipping is dependent on staff time, materials, and size/weight/fragility of the item. The cost to pack and ship an item is separate and distinct from the amount paid to purchase it. -FEE FOR FAILURE TO PICK UP ON DESIGNATED DAY: To cover staff time we charge $40 staff/hour, prorated based on volume/time ($5 minimum), to deal with items not picked up on the scheduled date/time. Customers requesting lots be "left out" or moved for early, late, or alternate pickup, will be charged whether or not the customer gave prior notice that they couldn't attend the pick up. We do not move items from one auction dispersal location to another auction dispersal location. -ABANDONED OR FORFEITED MERCHANDISE: Once buyers pay for their merchandise, it becomes their property and responsibility. Merchandise must be removed from the auction site within the time frames prescribed in the auction details. If merchandise is abandoned, buyers are subject to fees (see additional charges section) and relinquish any ownership rights. Abandoned/forfeited property is not subject to refunds or chargebacks. -IN THE EVENT OF LEGAL PROCEEDINGS arising from this contract or the auction in connection therewith, the buyer consents to be subject to the personal jurisdiction of the courts of the State of New York, Genesee County. -FAILURE TO READ OR UNDERSTAND THE TERMS AND CONDITIONS of the auction does not exempt the bidder from following them. |
