Buyer's Premium: A six percent (6%) Buyer's Premium shall be added to the final high bid to determine the total purchase price for the property.

Real Estate Auction Terms: Within forty-eight (48) hours after the close of the auction, the successful bidder shall execute the standard Purchase Agreement provided by Baker Auction & Realty, LLC and submit a deposit equal to five percent (5%) of the total purchase price. The deposit may be made by personal, business or cashier's check. The balance of the purchase price shall be due and payable at closing, which shall occur within forty-five (45) days following the auction unless otherwise agreed in writing by the parties. Seller shall convey good and merchantable title by warranty deed. Seller shall be responsible for the cost of the title search, deed preparation, and one-half (�) of the closing fee. Buyer shall be responsible for the Owner's Title Insurance Policy, any Lender's Title Insurance Policy, and all lender-related closing costs, if applicable. Real Estate Taxes will be prorated to the date of closing. Regardless of the capacity in which a bid is submitted, Baker Auction & Realty, LLC may rely upon the registered bidder for full performance of all obligations arising from the auction.

Technical Issues: This is an internet-only auction and relies upon software, servers, internet service providers, and related technology that may experience interruptions or failures. In the event of any technical malfunction, interruption, human error, platform failure, or other issue affecting the bidding process, Baker Auction & Realty, LLC reserves the sole right to extend the bidding period, suspend and resume the auction, reopen bidding, close the auction, or take any other action deemed necessary to protect the integrity of the auction. Neither Baker Auction & Realty, LLC nor the auction platform provider shall be liable for damages resulting from technical failures or interruptions.

Soft Close: This auction utilizes a Soft Close feature. If a bid is placed during the final minutes of bidding, the closing time for that lot shall automatically be extended to allow additional competitive bidding. Extensions shall continue until no further bids are received during the extension period.

Maximum Bidding: This auction also features MAXIMUM BIDDING. If you enter a maximum bid and are outbid by another bidder, the system will automatically bid on your behalf at the established bid increments up to your maximum. In the case of an auction with a system noted reserve, if the max bid amount entered is less than the reserve, the system will place the bid at the max amount. Once the reserve is met, then the system will advance the bid (by the bid increments) only when the bidder is outbid by another bidder, up to the bidders max. The system will not advance a bidder's own bid. Another bidder has to bid to increase the current price and the computer will automatically bid up to your max in the increments specified. If someone has already entered a MAX BID on a property you are bidding on, the system will automatically bid for you until you are the current high bidder or until you reach your MAX BID. If you have reached your MAX BID and are still not the current high bidder, the system will give you the opportunity to enter another MAX BID. If you are not able to be around a computer/mobile device during the closing of the auction or receive and/or read your outbid notice, we HIGHLY RECOMMEND you enter your MAX BID when bidding.
