AGREEMENT TO TERMS

By registering for and participating in this auction, you ("Buyer") acknowledge that you have read, understood, and agree to be bound by all terms and conditions set forth herein.

This agreement constitutes a legally binding contract between the Buyer and Sunrise Antiques & Auctioneers and applies to this auction and any future auctions in which you participate.

This agreement shall be governed by the laws of the State of New Jersey. Any disputes shall be resolved exclusively in the state or federal courts located in Burlington County, New Jersey. By bidding, you consent to jurisdiction and waive any objection to venue.

AUCTION NATURE & LOT CONDITION

THIS IS AN AUCTION. ALL LOTS ARE SOLD "AS IS, WHERE IS," WITH ALL FAULTS, AND WITH NO GUARANTEES OR WARRANTIES, EXPRESS OR IMPLIED.

Buyers are solely responsible for inspecting lots and/or asking questions prior to bidding. We strongly encourage attending any available preview or requesting additional information.

IF A PRE-AUCTION INSPECTION IS NOT AVAILABLE, YOU ARE KNOWINGLY AND WILLINGLY BIDDING WITHOUT SUCH INSPECTION. YOU ARE NOT RELYING ON ANY REPRESENTATIONS OR WARRANTIES BY THE AUCTIONEER OR SELLER AND ARE ASSUMING ANY AND ALL RISKS ASSOCIATED WITH YOUR PURCHASE.

GOLD & SILVER: PAYMENT MUST BE MADE BY CASH OR WIRE TRANSFER ONLY

Sales Tax: 6.625% unless valid exemption is provided

Buyer�s Premium:
15% (cash/check)
20% (credit cards and all firearms)

All invoices must be paid in full on auction day.

Any unpaid balance as of 2:00 PM Sunday following the auction will be automatically charged to the credit card on file.

By bidding, you authorize Sunrise Antiques & Auctioneers to charge your card and agree not to initiate chargebacks or payment disputes without first contacting us.

SHIPPING & PICKUP TERMS

Shipping:
We DO NOT provide in-house shipping except for firearms. Buyers are responsible for arranging and paying for shipping.

Shipping Deadline:
All arrangements must be completed by Wednesday at 5:00 PM following the auction.

FORFEITURE POLICY

Failure to pick up or arrange shipping within the stated timeframes constitutes abandonment.

Buyer forfeits all rights, title, and interest in the Lot(s), and no refunds will be issued.

Sunrise Antiques & Auctioneers reserves the right to resell or dispose of forfeited items at its sole discretion.

FIREARMS TERMS

We are a licensed Federal Firearms Licensee (FFL).

NJ DOES NOT RECOGNIZE C&R LICENSES.

All firearms sales comply with federal and New Jersey law.

Shipping:
All firearms must ship to a FFL for transfer. This includes antique, black powder and air guns.

Fee:
$50 NICS processing fee

We guarantee make, model, and serial number only.

All sales are final.

Titles for vehicles released after funds clear.

Errors and omissions may occur.

Buyer agrees not to initiate disputes without first contacting Sunrise Antiques & Auctioneers.

DISPUTE / CHARGEBACK ENFORCEMENT

BY REGISTERING AND BIDDING, YOU EXPRESSLY AGREE THAT YOU WILL NOT INITIATE ANY CREDIT CARD CHARGEBACK, PAYMENT REVERSAL, OR DISPUTE WITHOUT FIRST CONTACTING SUNRISE ANTIQUES & AUCTIONEERS AND PROVIDING A REASONABLE OPPORTUNITY TO RESOLVE THE ISSUE.

ANY CHARGEBACK OR PAYMENT DISPUTE FILED IN VIOLATION OF THESE TERMS SHALL BE CONSIDERED A BREACH OF CONTRACT.

YOU AGREE THAT YOU WILL BE RESPONSIBLE FOR ALL COSTS INCURRED BY SUNRISE ANTIQUES & AUCTIONEERS IN DEFENDING SUCH ACTION, INCLUDING BUT NOT LIMITED TO ADMINISTRATIVE FEES, COLLECTION COSTS, COURT COSTS, AND ATTORNEY�S FEES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
