**Terms & Conditions of Auction**

This online auction will feature a soft close beginning at 10:00 AM CSTon August 17, 2026.

Pickup/Load-Out: By appointment only from 9:30 AM � 4:30 PM on August 18, 2026 on Creek Drive Montgomery, Al. 36117. Winning bidders will receive an email from Shipping Saint with instructions to schedule pickup or request shipping on eligible items.

Bidding Terms

By registering and placing a bid, you agree to all terms and conditions outlined herein. Internet bids carry the same legal binding effect as in-person bids. All sales are final with no refunds unless otherwise stated.

All items are sold **�AS-IS, WHERE-IS�** with no warranties expressed or implied. It is the bidder�s responsibility to inspect items and determine condition, authenticity, and value prior to bidding.

Payment Terms

* Payment is due no later than 4:30 PM CST the day following the auction.
* Credit Cards will only be charged for invoices under $250.00, at the customers request. Otherwise, you can pay with cash at pick up.
* A 25% Buyer�s Premium will be added to all purchases
* A 5% discount applies to cash or pre-approved check payments (day following auction only)
* Invoices of $250+ require secured funds (cash, cashier�s check, certified funds, or wire transfer)
* Unpaid invoices may be charged to the card on file
* Sales tax will be applied unless proper exemption documentation is submitted

Failure to pay by deadline may result in account restriction or permanent denial from future auctions.

Pickup & Removal:
All items must be removed during the scheduled pickup window unless prior arrangements are approved before auction close.

* Items not picked up are subject to $25/day storage fees
* Items may be considered abandoned when storage exceeds value and become property of the auction company
* Buyer assumes full responsibility and risk of loss once item is sold

**Important:**
Bring all necessary boxes, packing materials, equipment, and help for loading. No assistance will be provided.

Shipping Terms:
* Shipping is available on select items (marked accordingly)
* Please allow 10�14 business days for processing
* All shipments will include insurance and signature confirmation

Failure to pay shipping charges will result in:

*Forfeiture of items with no refund
* No claim against auction company

No Show / Default Policy
Failure to pay for or pick up items will result in:
* Immediate disqualification from current and future auctions
* Negative reporting in the bidding platform

To reinstate bidding privileges, bidder must pay:
* Lost commission and buyer�s premium as a penalty

*Liability & Risk*
All persons attending preview, pickup, or auction site do so at their own risk. The auction company assumes **no liability for injury, loss, or damages**.

**Auction Rights**
High As The Sky Auction Company, LLC reserves the right to:
* Reject or cancel bids
* Withdraw or re-catalog items
* Restart or cancel auctions due to system or clerical issues

*Legal**
This agreement is governed by the laws of the **State of Alabama**. Disputes will be resolved through **binding arbitration**.
