INTERNET ONLY AUCTIONS - TERMS AND CONDITIONS (v. 8.4.2026) 345 Auction Company ("345 Auction," "we," "us," or "our") acts solely as agent for the seller(s) of property offered at auction and is not responsible for any act or omission of its principals, employees, or agents, except as expressly provided in these Terms and Conditions. By registering to bid or by placing a bid, each bidder ("Bidder") acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions in their entirety. Announcements made on the day of sale take precedence over any previously published term. Bidder further agrees that a bid placed through an internet auction platform carries the same legal effect as a bid placed in person. Bidders are strongly encouraged to direct all questions to 345 Auction prior to bidding. ALL SALES ARE FINAL. THERE ARE NO REFUNDS AND NO RETURNS, except as expressly provided herein. 1. PREVIEW AND INSPECTION Property offered for sale is available for public inspection during the dates and times specified for the applicable auction or, for auctions conducted entirely online, during normal business hours at our offices in Pueblo West, Colorado. Any person attending a preview, an auction, or a removal period assumes all risk of injury, damage, or loss to their person or property, and releases 345 Auction and its principals from all liability arising therefrom. Neither 345 Auction nor its principals shall be liable for any defect in, or condition of, the premises on which an auction or preview is held. Preview and inspection dates and times for each auction are published on the Auction Details page under the Auction Information tab. 2. PROPERTY CONDITION All property is sold "AS IS, WHERE IS," without warranty or guarantee of any kind, whether express or implied. ALL SALES ARE FINAL; THERE ARE NO REFUNDS, EXCHANGES, OR REFUSALS. The highest bidder on any item becomes the buyer ("Buyer") of that item and is bound by these Terms and Conditions. Where an auction is conducted entirely online, Bidder may inspect items during normal business hours prior to bidding; a Bidder who elects not to do so waives any claim arising from the condition, quality, quantity, or description of the item. 2.1 Guarantee of Authenticity - United States Coins and Currency 345 Auction will never knowingly offer for sale a counterfeit coin or item of currency. Any coin or currency identified as a copy, replica, or facsimile will be clearly identified as such in its description. If, within thirty (30) days of purchase, Buyer provides written notice to 345 Auction that a coin or item of currency is counterfeit, returns it in the same condition as sold, and establishes to 345 Auction's satisfaction that it is in fact counterfeit, 345 Auction, acting as agent for the consignor, will rescind the sale and refund the purchase price, exclusive of shipping charges. 345 Auction may rely on third-party grading services to assist in determining authenticity. This guarantee applies solely to coins and currency issued by the United States of America, and all determinations made by 345 Auction, whether independently or in consultation with outside experts, are final. Beginning on the thirty-first (31st) day after purchase, this guarantee is limited to a determination of authenticity only, and refund of the purchase price is not guaranteed. From time to time, coins or currency offered for sale may be accompanied by a grade designation reflecting 345 Auction staff's opinion of condition, offered solely to assist Buyers in assessing relative value. Such grade designations are not professional evaluations unless expressly attributed to a recognized grading service (e.g., PCGS, NGC, or ANACS), in which case the item's serial number will typically be included in the description or photograph. Any grade not attributed to a grading service reflects 345 Auction's opinion only and should not be relied upon for any purpose other than general comparison, and is not guaranteed to be accurate. 2.2 Precious Metals and Stones 345 Auction endeavors to describe items containing precious metals, semi-precious stones, and precious stones as accurately as possible, using appropriate tools and equipment to test, weigh, and size such items, and utilizing GIA-trained appraisers to identify and classify precious stones. Precious metal content for silver, gold, and platinum is guaranteed to be within accepted industry tolerances. Diamonds below .25 carat total weight are not guaranteed; diamonds of .25 carat total weight or greater are guaranteed to be authentic. Semi-precious stones may be identified by type or by color reference only, and all turquoise is identified generically as "turquoise" without regard to specific variety. Unless otherwise specified, all weights listed for an item include all component pieces and parts. 2.3 Firearms and Ammunition All firearms sold through 345 Auction are held off-site at the place of business of an authorized Federal Firearms Licensee ("FFL"). A successful bidder on any firearm must obtain a fully paid receipt from 345 Auction, present that receipt at the FFL's place of business, and submit to and pay for any background check required by law prior to taking possession. The FFL will arrange shipment of firearms; handguns and long guns must be shipped separately. Ammunition requiring shipment will be shipped by 345 Auction's shipping provider, as described in Section 10, in compliance with all applicable laws and carrier requirements. 2.3.1 Antique Firearms and Curio & Relic Items Certain firearms offered for sale may qualify as antique firearms, or as Curio & Relic ("C&R") items, under federal law, 18 U.S.C. � 921, and may accordingly be exempt from standard FFL transfer requirements. Where known, any such classification will be noted in the item description; however, it remains Bidder's sole responsibility to verify the legal classification of any firearm and to ensure compliance with all applicable federal, state, and local law governing its purchase, transfer, transport, and possession - including the law of Bidder's own state or country of residence, which may impose requirements more restrictive than federal law. 345 Auction's classification of an item as antique or C&R reflects its opinion based on available information and does not constitute a legal determination. 2.3.2 Military Collectibles, Edged Weapons, and Ordnance Components Auctions may include militaria such as bayonets, edged weapons, helmets, uniforms, insignia, and ammunition or ordnance components. Where applicable, such items will be described as "live" or "inert" to the best of 345 Auction's knowledge. Bidder is nonetheless solely responsible for independently verifying the live or inert status, and the legal status, of any such item prior to bidding, and for complying with all law governing its possession, transport, and, where applicable, import or export. Certain jurisdictions restrict or prohibit possession of specific edged weapons, insignia, or ordnance-related items regardless of historical or collectible significance, and Bidder bears sole responsibility for confirming legality within their jurisdiction prior to bidding. 345 Auction will not ship any item identified as live ordnance, or as an ammunition component subject to shipping restriction, except in compliance with all applicable carrier and legal requirements. 2.4 Vehicles Vehicles sold through 345 Auction may or may not be accompanied by title. Auction descriptions will indicate title status where known. At pickup, Buyer will receive a copy of the vehicle's title, if available, a bill of sale, and any relevant estate documentation. A fully executed title will be mailed to Buyer via Priority Mail, typically within fourteen (14) days of auction close. Where no title is available, Buyer will receive a bill of sale only. 3. PROPERTY DESCRIPTION; ERRORS; REMEDY 345 Auction endeavors to describe merchandise accurately in advertising, online listings, and at auction, but makes no representation as to the accuracy of any description. Bidder bears sole responsibility for determining an item's condition, age, authenticity, value, and any other factor relevant to Bidder's decision to bid. Bidders who bid remotely and do not attend any preview acknowledge that remote inspection may not be equivalent to an in-person examination. In no event shall 345 Auction be deemed to have made or implied any warranty of merchantability or fitness for a particular purpose, and 345 Auction does not guarantee any third-party appraisal, grading, or certification. Bidders with questions regarding any item are encouraged to contact 345 Auction prior to bidding. Bidder is the sole judge of value and bears sole responsibility for determining whether any item may lawfully be purchased, possessed, or used in Bidder's jurisdiction. By placing a bid, Bidder represents that they have inspected the item to their satisfaction, or have knowingly elected not to do so at their own risk. 345 Auction is not responsible for errors or omissions in the description of merchandise, except where such error constitutes a material and intentional misrepresentation of the item itself. Bidder may not return any purchased item except on that basis, and Bidder's sole remedy for a material and intentional misrepresentation is to return the item, at Bidder's expense, in the same condition in which it was shipped. If 345 Auction determines that an item was materially and intentionally misrepresented, 345 Auction will refund an amount up to Bidder's purchase price. In no event shall 345 Auction's liability to any Bidder exceed the purchase price paid for the item at issue. BIDS MAY NOT BE WITHDRAWN EXCEPT IN THE CASE OF AN OBVIOUS TYPOGRAPHICAL ERROR. BIDDERS ARE RESPONSIBLE FOR CONFIRMING THE ITEM ON WHICH THEY ARE BIDDING PRIOR TO PLACING A BID. 4. BIDDER ELIGIBILITY By registering to bid, Bidder represents that they are at least eighteen (18) years of age and legally capable of entering into a binding contract under the law of their state or country of residence. 345 Auction reserves the right to cancel any bid or sale made by a Bidder later found not to meet this requirement. 5. PAYMENT Unless Bidder has an established buying history with 345 Auction, credit cards may be charged immediately following the close of an auction. Bidders with an established history will be extended the option to pay by cash or check at pickup. New customers whose anticipated or actual purchase exceeds $250.00 may be required to remit payment by e-check or wire transfer in order to reduce the risk of credit card fraud; please contact 345 Auction for details. 345 Auction accepts cash, check, credit card, and wire transfer. Accepted credit cards are Visa, MasterCard, Discover, and American Express. Cashier's checks and personal checks may be accepted with prior authorization and identity verification, and merchandise purchased by check will be held for up to fourteen (14) days pending clearance. 345 Auction reserves the right to charge Bidder's credit card the full amount of any pre-bid or live bid at any time. Upon the close of bidding on any item, Bidder assumes full responsibility for that item. FOR INTERNET-ONLY AUCTIONS, PAYMENT IN FULL IS DUE WITHIN FORTY-EIGHT (48) HOURS OF AUCTION CLOSE, OR AS OTHERWISE SPECIFIED IN THE AUCTION DESCRIPTION; credit cards on file will be charged at the close of business on the second day following auction close. Vehicle purchases MUST be settled in CASH, Cashier's Check, or Wire Transfer. Credit Cards will not be accepted and the Buyer's Premium will not be discounted. All internet Bidders agree to pay a buyer's premium equal to eighteen and 99/100 percent (18.99%) of the hammer price of each item purchased. By way of illustration, a hammer price of $100.00 yields a buyer's premium of $18.99, for a total purchase price of $118.99. Applicable sales tax will be collected on the entire purchase price as required by Colorado law. A two percent (2%) discount on the buyer's premium is available for cash payments made within forty-eight (48) hours of auction close; no other discount applies. Bidder agrees to reimburse 345 Auction for all reasonable expenses incurred in collecting any unpaid balance owed in connection with an auction. A $30.00 fee will be charged for any declined credit card, and bidding privileges will be suspended until all amounts owed are paid in full. Buyers may also remit payment through 345 Auction's online payment option. 6. INTERNET SERVICE AND SOFTWARE 345 Auction provides internet bidding as a service and does not guarantee that such service will function without interruption or error. Bidder shall have no claim of any kind against 345 Auction, or any other party, arising from a failure of internet service before or during an auction, and 345 Auction is not responsible for any bid not received due to such failure. 345 Auction reserves the right to withdraw or re-catalog any item, and, in the event of a software malfunction or other technical issue, to extend closing times, or to pause, restart, or cancel an auction, in its sole discretion. An item's display as "sold" on the auction platform does not constitute a final sale; sales are final only upon certification by 345 Auction and issuance of an invoice to Bidder. The sale price recorded by the auction software provider is the official sale price. 345 Auction reserves the right to cancel any sale and to re-offer the item in any manner it deems appropriate. 7. BID INCREMENTS; SELLER RESERVES; ELIGIBLE BIDDERS Bids advance according to pre-set increments published on the Auction Details page under the Bid Increments tab. From time to time, 345 Auction may accept items subject to an undisclosed reserve, and both the seller and 345 Auction reserve the right to bid on such items on the seller's behalf. This is a public auction, and all qualified Bidders may participate, including owners, family members, and employees of 345 Auction. 345 Auction may reject or cancel any bid for any reason, and the auction record maintained by 345 Auction is conclusive. 8. PLACING A BID; SOFT CLOSE A Bidder may place a bid on any item at any time after the auction opens and before that item closes. Bidder may bid the next available increment or may enter a maximum bid, in which case the bidding platform will automatically bid on Bidder's behalf, in published increments, up to but not exceeding Bidder's maximum, as necessary to maintain Bidder's status as high bidder. Entering a maximum bid does not immediately raise the current bid to that maximum; the current bid rises only as necessary in response to competing bids. Bidder may increase their maximum bid at any time. By way of illustration: if the current bid on an item is $4.00 and Bidder enters a maximum bid of $10.00, the platform will place a bid of $6.00 (the next increment). If a competing Bidder then bids $8.00, the platform will automatically raise Bidder's bid to $10.00, Bidder's maximum, preserving Bidder's status as high bidder. If a competing Bidder then bids $12.00, Bidder will be outbid unless Bidder increases their maximum bid. This auction employs a "soft close" mechanism: if a bid is placed on an item within a specified interval of that item's scheduled close, the closing time for that item is extended by a specified interval, generally three (3) minutes, though this interval may vary by auction. This mechanism is intended to prevent last-second bidding ("sniping") and to ensure a fair bidding process for all participants. 9. PROPERTY PICK-UP AND REMOVAL All property must be removed from the premises by Bidder, at Bidder's own risk and expense, within the time period specified for the applicable auction. For items sold through our Pueblo West location: unless otherwise specified in the auction description, all purchased merchandise must be removed within seven (7) days of auction close, during 345 Auction's normal business hours. Unless alternate arrangements have been made with 345 Auction, or the item is being shipped, these days and hours apply without exception. Property not removed within seven (7) days of auction close will be assessed a storage charge of $10.00 per lot, per day; property not removed within fourteen (14) days of auction close will be deemed abandoned and forfeited, without refund. For items sold at any on-site location: specific removal days and times will be published in the auction description and communicated to Buyer by email, and will be strictly enforced. Bidders requiring alternate arrangements must contact 345 Auction prior to bidding, as alternate accommodations may not be available and may result in additional charges. Abandoned property reverts to the seller for disposition, and Bidder retains no claim to any item not removed within fourteen (14) days of auction close. Bidder's bidding privileges will be suspended until all outstanding storage charges are paid in full. 10. SHIPPING 345 Auction facilitates shipment of purchased items through Liberty Pack & Ship, an independently owned and operated shipping company located in Pueblo West, Colorado. Liberty Pack & Ship is not owned or controlled by 345 Auction and acts as an independent contractor, and not as an agent, partner, or employee, of 345 Auction. Certain oversized, heavy, or specialty items are instead shipped through a separately contracted freight or specialty shipping provider, which likewise acts as an independent contractor and not as an agent, partner, or employee of 345 Auction. 10.1 Shipment Damage 345 Auction is not responsible for any item damaged, lost, or delayed in shipment. Any claim relating to shipment damage, loss, or delay must be directed to, and resolved directly with, the applicable shipping provider under that provider's own policies and procedures; 345 Auction has no role in, and no liability for, the resolution of any such claim. To preserve Buyer's ability to pursue a shipment damage claim with the applicable shipping provider, Buyer should, promptly upon receipt of an item: (a) inspect the item and its packaging immediately upon delivery; (b) photograph the damaged item, its outer packaging, and all packing materials before discarding anything; (c) retain all components of the item and all packaging materials until the claim is fully resolved; and (d) report the damage to the applicable shipping provider within the timeframe required by that provider's policies. Failure to take these steps may impair or void Buyer's ability to recover on a claim with the shipping provider. Buyer acknowledges that any recovery for shipment damage, loss, or delay is governed solely by the applicable shipping provider's insurance and liability terms, and that shipping charges are, in all cases, non-refundable and remain Buyer's sole responsibility. 10.2 Shipping Procedure Following the close of an auction, 345 Auction will collect and prepare Buyer's purchased items and deliver them to Liberty Pack & Ship. 345 Auction's role in the shipping process ends upon delivery of the item to Liberty Pack & Ship; all subsequent packing, shipment, charges, tracking, delivery, and related communication are handled directly between Buyer and Liberty Pack & Ship, and are not the responsibility of 345 Auction. Liberty Pack & Ship will contact Buyer directly by telephone, email, or text message to confirm shipping charges, delivery address, and payment information, and will not ship any item prior to such confirmation. For questions regarding shipping status, charges, or delivery, Buyer should contact Liberty Pack & Ship directly at (719) 696-8111 or contact@shipliberty.com. Oversized, heavy, or specialty items requiring contracted freight service are handled separately. Where known, any such item will be identified as requiring freight shipment in the auction description, and 345 Auction will provide Buyer with the applicable freight contractor's contact information following auction close so that Buyer may arrange delivery directly with that contractor. As with standard shipments, 345 Auction's involvement ends upon delivery of the item to the freight contractor. BUYER SHOULD NOT ASSUME THAT LIBERTY PACK & SHIP OR ANY FREIGHT CONTRACTOR HAS BUYER'S CURRENT CONTACT INFORMATION, SHIPPING ADDRESS, OR PAYMENT INFORMATION ON FILE. If Buyer fails to remit payment for shipping, provides incorrect address information, or refuses delivery, Buyer forfeits the merchandise and any amounts paid, without refund, and has no claim against 345 Auction or any shipping provider. Merchandise not removed or shipped within seven (7) days of auction close will be forfeited without refund, as provided in Section 9. 11. BUYER DEFAULT If Buyer fails to pay for any item within the time specified in these Terms, 345 Auction may, in its sole discretion and without further notice, take any or all of the following actions: (a) cancel the sale of the item to Buyer; (b) resell the item at a subsequent auction or by private sale, and hold Buyer liable for any deficiency between the original sale price and the resale price, together with any additional cost of resale, including relisting fees, storage, and administrative expense; (c) charge Buyer's credit card on file for the full purchase price, applicable fees, and costs of collection; (d) suspend or permanently revoke Buyer's bidding privileges on any current or future 345 Auction sale; (e) record Buyer's non-payment or conduct on the HiBid platform, including any comment or rating visible to other auctioneers using that platform, in accordance with HiBid's policies; (f) pursue any other remedy available at law. Buyer agrees to reimburse 345 Auction for all reasonable costs of collection, including attorney's fees, incurred as a result of Buyer's default. 12. SALES TAX; RESALE EXEMPTION Applicable Colorado sales tax will be collected on all purchases unless Buyer furnishes 345 Auction with a valid, completed resale or tax-exemption certificate prior to invoicing. An exemption certificate submitted after an invoice has been paid and closed may not qualify for retroactive refund of tax already remitted. 13. BIDDER IDENTIFICATION 345 Auction may, in its sole discretion, refuse to issue a bidder number or bidding privileges to any person for any reason. Bidder agrees to furnish any identification requested by 345 Auction, including without limitation a driver's license, photocopy of a credit card, Social Security card, or passport. Bidder agrees to comply with any additional terms or conditions associated with specific items. Registration using an invalid or fraudulent credit card constitutes grounds for denial of bidding privileges. 14. PRIVACY Information collected from Bidders, including name, address, payment information, and any identification furnished under Section 13, is used solely to facilitate registration, bidding, invoicing, payment processing, and shipment of purchased items, and is not sold to third parties. Payment card information is processed through 345 Auction's third-party payment processor and is not separately retained by 345 Auction. Bidder information may be shared with 345 Auction's shipping providers solely as necessary to fulfill delivery of purchased items. 15. PHOTOGRAPHY AND RECORDING 345 Auction may photograph or record items, premises, and activity occurring during preview or pickup for purposes of advertising, cataloging, and security. By attending any preview, auction, or pickup in person, Bidder consents to such photography or recording and to its use by 345 Auction. 16. GOVERNING LAW; JURISDICTION Bidder agrees that these Terms and Conditions are governed by the law of the State of Colorado. Bidder consents to the personal jurisdiction and venue of any court of competent subject matter jurisdiction located in Pueblo County, Colorado, and agrees that service of process may be effected by mailing a certified letter containing a summons, postage prepaid, to the address Bidder provided upon registration. Should a dispute arise between 345 Auction and Bidder, Bidder waives any right to trial or hearing in a court of law and agrees to resolve the dispute through binding arbitration in Pueblo County, Colorado, before an arbitrator appointed by the President of the Colorado Auctioneers Association. 17. ENTIRE AGREEMENT; AMENDMENT These Terms and Conditions, together with any auction-specific terms, item descriptions, and announcements made prior to or during a sale, constitute the entire agreement between Bidder and 345 Auction regarding that auction, and supersede any prior or contemporaneous oral or written representation not contained herein. 345 Auction reserves the right to amend these Terms and Conditions for future auctions; the version in effect at the time a given auction opens for bidding governs that auction. 18. NOTICE Bidder is solely responsible for providing and maintaining current, accurate contact information, including mailing address, email address, and telephone number, with 345 Auction. 345 Auction will communicate with Bidders primarily by email or through the contact information on file with the applicable bidding platform. Bidder agrees to monitor email regularly during and after any auction in which Bidder participates, and acknowledges that failure to receive a communication due to outdated or inaccurate contact information does not give rise to any claim for refund, extension, or other relief. 19. SEVERABILITY If any provision of these Terms and Conditions is or becomes illegal, invalid, or unenforceable, in whole or in part, for any reason, the remaining provisions shall remain in full force and effect, and shall be construed and enforced to the fullest extent permitted by law. |

The Bagale Collection, Session V � Archives & Militaria
The Bagale Collection continues with Session V, offering another extensive selection from the lifetime collection of the late Dr. E. John Bagale, a respected Pueblo-area physician, historian, and dedicated collector whose interest in military history and militaria spanned decades.
This session brings together more than 500 lots and offers a particularly broad look at the research, reference material, archival holdings, field equipment, and militaria that formed an important part of Dr. Bagale�s collection.
A substantial portion of the auction is devoted to military books, reference works, period publications, documents, photographs, photo albums, printed material, and historical ephemera. These pieces provide an interesting complement to the physical artifacts throughout the collection and reflect the depth of research and study behind Dr. Bagale�s decades of collecting.
Collectors will also find a wide variety of German and European militaria, including field and personal equipment, headgear, uniforms and uniform components, insignia, badges, edged weapons, accessories, and related military artifacts. The auction also includes an especially strong selection of military optics and field glasses, with examples from noted makers including Carl Zeiss Jena, Leitz Wetzlar, Hensoldt, Rodenstock, Emil Busch, Goertz, and others.
As with the previous Bagale Collection auctions, the material spans multiple periods and collecting categories. The catalog includes original period pieces as well as postwar, reproduction, and reference examples where identified. We encourage bidders to carefully review individual lot descriptions and photographs and to contact us with any questions prior to bidding.
The Bagale Collection represents the accumulation of a lifetime spent collecting, studying, preserving, and researching military history. Many of these pieces remained in Dr. Bagale�s private collection for decades and are now being offered to collectors as part of this continuing series of auctions.
