# MP AUCTIONS

## AUCTION TERMS & CONDITIONS

By registering for and/or bidding in an MP Auctions auction, each bidder acknowledges that they have read, understand, and agree to the following Terms & Conditions.

### 1. ALL ITEMS SOLD AS-IS, WHERE-IS

All merchandise is sold **AS-IS, WHERE-IS, WITH ALL FAULTS**, with no warranties or guarantees, expressed or implied.

MP Auctions makes every reasonable effort to provide accurate descriptions and photographs; however, descriptions, photographs, measurements, quantities, model numbers, condition statements, and other information are provided as a convenience only and are not guaranteed.

**Bidders are responsible for determining the condition, age, authenticity, value, and suitability of any item before bidding.**

### 2. ALL SALES ARE FINAL

**ALL SALES ARE FINAL.**

There are **no refunds, returns, exchanges, chargebacks, credits, or adjustments** based on condition, buyer's remorse, failure to inspect, or failure to pick up merchandise.

Once you are declared the winning bidder, you are responsible for payment and removal of the item.

### 3. BUYER'S PREMIUM

A **15% Buyer's Premium** will be added to the final hammer price of all purchases.

**Example:**
Winning Bid: $100.00
15% Buyer's Premium: $15.00
Subtotal: $115.00
Applicable sales tax and other authorized charges will then be added when required.

### 4. SALES TAX

Applicable sales tax will be charged unless the buyer has a valid resale or tax-exemption certificate on file and accepted by MP Auctions before payment.

### 5. PAYMENT

Payment is due according to the instructions provided for each auction.

MP Auctions reserves the right to charge the credit card registered with the auction platform for winning purchases and other authorized charges.

Declined payments must be resolved immediately.

### 6. PICKUP – 3-DAY DEADLINE

**ALL PURCHASES MUST BE PICKED UP WITHIN THREE (3) DAYS FOLLOWING THE AUCTION UNLESS OTHER ARRANGEMENTS HAVE BEEN APPROVED BY MP AUCTIONS.**

Buyers are responsible for bringing the appropriate **labor, tools, carts, dollies, packing materials, trailers, and vehicles** necessary to remove their purchases.

MP Auctions is not responsible for loading, securing, transporting, or protecting merchandise unless specifically agreed otherwise.

### 7. ITEMS NOT PICKED UP

Any merchandise not picked up within the required **three-day pickup period** may be considered **abandoned and forfeited without refund**, unless prior arrangements have been approved by MP Auctions.

Payment of an invoice does not extend the pickup deadline.

MP Auctions reserves the right to dispose of, resell, donate, remove, or otherwise handle abandoned merchandise at its discretion.

### 8. SHIPPING AVAILABLE

Shipping is available on **select items**.

The buyer is responsible for all shipping, packing, handling, insurance, and related charges.

Large, fragile, oversized, extremely heavy, or otherwise impractical items may be designated **local pickup only**.

**Contact MP Auctions before bidding if you are unsure whether an item can be shipped.**

### 9. INSPECTION

Bidders are encouraged to inspect merchandise before bidding whenever an inspection or preview period is offered.

Failure to inspect an item does not relieve the winning bidder from the obligation to pay for and pick up the item.

### 10. BIDDING

Each bidder is responsible for bids placed under their account.

**A bid is a binding agreement to purchase the item if you are the winning bidder.**

Accidental bids, failure to read a description, failure to inspect photographs, or changing your mind are not grounds for cancellation.

### 11. INTERNET & TECHNICAL ISSUES

MP Auctions is not responsible for internet outages, slow connections, platform interruptions, computer or mobile-device problems, delayed bids, or other technical issues beyond its reasonable control.

MP Auctions reserves the right to extend, postpone, reopen, or cancel bidding when necessary because of technical problems or other circumstances affecting the integrity of the auction.

### 12. ITEM WITHDRAWAL & AUCTION CHANGES

MP Auctions reserves the right to withdraw, combine, separate, correct, or modify any lot or description when necessary.

MP Auctions also reserves the right to reject or cancel bids or bidding privileges when necessary to protect the integrity of the auction.

### 13. TITLED VEHICLES & EQUIPMENT

Vehicles, trailers, and other titled property are sold **AS-IS, WHERE-IS** unless specifically stated otherwise.

Buyers are responsible for registration, title transfer, taxes, tags, transportation, towing, insurance, and any repairs required after purchase.

### 14. REMOVAL & LIABILITY

Buyers enter the auction and pickup premises at their own risk.

MP Auctions is not responsible for injury, accident, damage, theft, or loss occurring during inspection, pickup, loading, removal, or transportation, except to the extent liability cannot legally be excluded.

Buyers are responsible for any damage they or their representatives cause to the property, building, grounds, equipment, or other merchandise during removal.

### 15. RIGHT TO REFUSE SERVICE

MP Auctions reserves the right to refuse bidding privileges or future participation to bidders who fail to pay, fail to pick up purchases, abuse auction personnel, engage in fraudulent activity, or otherwise violate these Terms & Conditions.

### 16. ACCEPTANCE OF TERMS

By registering, bidding, or purchasing through MP Auctions, the bidder acknowledges that they have **read, understand, and agree to these Terms & Conditions.**
