BRADSHAW AUCTIONS ONLINE AUCTION TERMS & CONDITIONS

By registering for and participating in this online auction, bidders agree to all terms and conditions stated below.

1. REGISTRATION

All bidders must register with valid contact and payment information prior to bidding. The auctioneer reserves the right to deny or revoke bidding privileges at any time.

2. AS-IS / WHERE-IS

All property is sold �AS IS, WHERE IS� with no guarantees or warranties, expressed or implied. Descriptions, photographs, and information provided are believed accurate but are not guaranteed. It is the bidder�s responsibility to inspect items and determine condition, authenticity, and value before bidding.

3. BIDDING

By placing a bid, bidder enters into a legally binding contract to purchase the item if declared the winning bidder.

The auctioneer reserves the right to:
- Reject any bid
- Remove items from sale
- Reopen bidding
- Resolve bidding disputes
- Cancel or extend the auction
The auctioneer�s decisions are final.

4. AUCTIONEER AND STAFF BIDDING

The auctioneer, auction company, consignors, employees, and authorized representatives may bid on items unless prohibited by law. Any such bidding shall comply with applicable Texas law.



5. SOFT CLOSE
This auction may utilize a soft close feature. If a bid is placed shortly before a lot closes, additional time may be added to allow continued bidding.

6. BUYER�S PREMIUM

A buyer�s premium of 12% will be added to the final hammer price. Applicable Texas sales tax will be charged unless a valid resale certificate is provided before payment.

7. FFL TERMS
WHEN PURCHASING A GUN AT BRADSHAW AUCTION, A BACKGROUND CHECK WILL BE REQUIRED BEFORE TRANSFERING THE GUN. Because we sell estates and or used firearms, the buyer agrees to have any weapon checked by a certified gunsmith before firing. The buyer will assume all legality, liability, and responsibility for the purchased firearm�s condition, use & security/storage. Buyer certifies by purchasing a gun that they are legally qualified to buy and own the firearm and that there are no state or local laws preventing ownership. The owner will utilize a trigger lock to prevent accidents. The buyer understands that all guns/weapons are potentially dangerous if handled or stored improperly.
We have no established testing facility. Therefore, we assume no liability for the safe functioning of any firearm sold.
8. PAYMENT

Payment is due within the time stated by the auction company. Accepted payment methods may include credit/debit card, wire transfer, cash, cashier�s check, or other approved methods.
Failure to make payment may result in:
- Cancellation of sale
- Suspension of bidding privileges
- Legal action
- Collection costs and attorney fees

9. CREDIT CARD AUTHORIZATION

By registering, bidder authorizes the auction company to charge the card on file for purchases, buyer�s premiums, taxes, shipping, and applicable fees unless other arrangements are approved.



10. PICKUP & REMOVAL

Items must be picked up during the scheduled removal times announced by the auction company. Buyers are responsible for loading and transportation.

Unless prior arrangements have been made, Items not removed by the deadline may:
- Incur storage fees
- Be deemed abandoned
- Be resold without refund

11. SHIPPING

Shipping may be available on select items at buyer�s expense. The auction company is not responsible for damage or delays caused by carriers.

12. INTERNET FAILURE

The auction company is not responsible for missed bids, technical issues, platform outages, internet failures, or software malfunctions affecting online bidding.

13. DEFAULT

If bidder fails to pay or comply with auction terms, auctioneer may resell items and recover damages, including loss of commission, attorney fees, and associated costs.

14. LIMITATION OF LIABILITY

Auction company, employees, and sellers shall not be liable for any damages, losses, injuries, or claims arising from participation in the auction.

15. TEXAS LAW & VENUE

These Terms and Conditions shall be governed by the laws of the State of Texas. Venue for any legal dispute shall be in the county where the auction company is located.


16. ACCEPTANCE OF TERMS

Registering for and participating in this auction constitutes full acceptance of these Terms and Conditions.

THIS AUCTION CONSIST OF RESTAURANT EQUIPMENT OF THE WHEELER MERCANTILE IN TILDEN TX. WE ALSO ARE PUTTING SOME CONSIGNMENTS WITH IT THAT ARE LOCATED AT THE YARD IN GEORGE WEST. ALL THE RESTAURANT EQUIPMENT HAS NOT BEEN TESTED. THERE IS A TOP DRIVE HUNTING WAGON LOCATED AT WHEELER RANCH.
