BRADSHAW AUCTIONS LIVE & ONLINE AUCTION TERMS AND CONDITIONS

1. AGREEMENT TO TERMS

By registering for and participating in this auction, all bidders agree to be bound by these Terms and Conditions. The auctioneer reserves the right to amend, modify, or enforce these terms at any time.

2. AS-IS / WHERE-IS

All items are sold �AS IS, WHERE IS,� with no warranties or guarantees expressed or implied. Descriptions are believed to be accurate but are not guaranteed. Buyers are responsible for inspecting all items prior to bidding.

3. BUYER RESPONSIBILITY

It is the bidder�s responsibility to determine the condition, authenticity, age, value, and suitability of all items. Failure to inspect does not relieve the buyer of responsibility for payment.

4. REGISTRATION

Valid identification and contact information are required to register. The auctioneer reserves the right to refuse registration or revoke bidding privileges at any time.

5. BIDDING

The auctioneer has sole discretion in determining the winning bidder, resolving disputes, advancing bid increments, rejecting bids, or withdrawing items from the sale.

Online bidders acknowledge that internet bidding may be subject to delays or technical failures. The auctioneer is not responsible for missed bids due to internet interruption, software malfunction, or technical issues.

6. RESERVE PRICES

Some items may be subject to reserve prices unless specifically advertised as absolute auctions.

7. AUCTIONEER AND STAFF BIDDING

The auctioneer, auction company, consignors, employees, and authorized representatives reserve the right to Bid on behalf of our sellers. They may bid on items unless prohibited by law. Any such bidding shall comply with applicable Texas law.


8. FFL TERMS
WHEN PURCHASING A GUN AT BRADSHAW AUCTION, A BACKGROUND CHECK WILL BE REQUIRED BEFORE TRANSFERING THE GUN. Because we sell estates and or used firearms, the buyer agrees to have any weapon checked by a certified gunsmith before firing. The buyer will assume all legality, liability, and responsibility for the purchased firearm�s condition, use & security/storage. Buyer certifies by purchasing a gun that they are legally qualified to buy and own the firearm and that there are no state or local laws preventing ownership. The owner will utilize a trigger lock to prevent accidents. The buyer understands that all guns/weapons are potentially dangerous if handled or stored improperly.
We have no established testing facility. Therefore, we assume no liability for the safe functioning of any firearm sold.
9. PAYMENT TERMS

Payment is due immediately upon conclusion of the auction unless otherwise announced.

Accepted payment methods may include:

- Cash
- Credit/Debit Card
- Wire Transfer
- Certified Funds
- Other approved payment methods

Returned checks or chargebacks may result in legal action and additional fees.

10. BUYER�S PREMIUM

A buyer�s premium of __10___% will be added to the final bid price for all purchases capped at $3000.

11. SALES TAX

Applicable Texas sales tax will be collected unless the buyer provides a valid resale or exemption certificate prior to payment.








12. REMOVAL OF ITEMS

THERE IS SOME EXTREMELY HEAVY IMPLEMENTS!!! IF OUR FORKLIFT CANNOT LIFT IT, YOU WILL STILL BE RESPONSIBLE FOR REMOVING YOUR PURCHASES.

All items must be removed within the stated removal period. Buyers assume full responsibility for purchased items immediately after the item is declared sold.

Unless prior arrangements have been made, Items not removed within 30 days will be considered abandoned and subject to storage fees, resale, or disposal without refund.

13. DEFAULT

If a buyer fails to pay or comply with auction terms, the auctioneer may:

- Cancel the sale
- Retain deposits
- Resell the item
- Pursue legal remedies
- Ban the bidder from future auctions

The defaulting bidder shall be responsible for any deficiency, collection costs, attorney�s fees, and damages.

14. LIABILITY

Persons attending the auction site do so at their own risk. The auctioneer, auction company, property owner, and consignors shall not be liable for accidents, injuries, theft, or damages.

15. ONLINE PLATFORM DISCLAIMER

The auctioneer is not responsible for platform outages, software errors, lost internet connection, delayed bids, or technical malfunctions affecting online bidding.

16. DISPUTES

Any dispute regarding bids or purchases shall be resolved solely by the auctioneer, whose decision shall be final.

17. COMPLIANCE WITH TEXAS LAW

This auction shall be governed by the laws of the State of Texas. Venue for any legal dispute shall be in the county where the auction company is located unless otherwise required by law.



18. ANNOUNCEMENTS

Oral announcements made on auction day take precedence over any printed or online materials.

19. NO REFUNDS

All sales are final. No refunds, returns, or exchanges will be allowed.

20. SHIPPING

Shipping, if offered, is at the buyer�s expense and risk. The auctioneer is not responsible for damage or loss during shipping.

21. ACCEPTANCE OF TERMS

By placing a bid, the bidder acknowledges they have read, understood, and agreed to all auction terms and conditions.
