**BY PLACING A BID, BIDDER CERTIFIES THAT THEY HAVE READ AND WILL ABIDE BY ALL TERMS AND CONDITIONS AS STATED BELOW.
**IT IS THE BUYER'S RESPONSIBILITY TO UNDERSTAND ALL THE TERMS AND CONDITIONS PRIOR TO BIDDING.
**ON-LINE BIDDING
This is a timed, Online-only Auction; the highest bid online when the bidding closes will be the winning bid for the item.
This auction will incorporate a "SOFT CLOSE". Bidding within the last minute before the closing of an item will extend the bidding time by an additional minute. This prevents individuals from placing a bid on an item at the last second to prevent others from bidding more.
**BUYERS PREMIUM: Buyer's premiums do apply on all on-line purchases. Buyer's premiums are determined by the auction and the rates can be found posted in several lots in the auction catalog. **ITEMS SOLD "AS IS, WHERE IS"
All items are sold "AS IS, WHERE IS" with no warranty or guarantees, expressed or implied, by the seller or Koons Auctions. Bidders accept all auction items/property "WITH ALL FAULTS", whether immediately apparent. It is strongly recommended that bidders thoroughly inspect items before placing a bid. Items are described as accurately as possible, but do not represent any guarantee by the seller or Koons Auctions.
By placing a bid, bidder signifies that they have inspected the item to their satisfaction.
**PICTURES & ITEM DESCRIPTIONS:
Multiple photos will be included in item descriptions whenever possible; however, photos may or may not fully represent the item. Lighting, surroundings and other factors can affect the perception of an item in a photo; therefore, all bidders are responsible for their own personal inspection of the item(s) before placing a bid. Photos and descriptions are to be used as a guideline only. We strongly urge bidders to attend the scheduled preview of items.
**EMAIL:
Bidders who register for any auction will be added to our mailing and email lists. By agreeing to our terms and conditions, bidders agree to opt-in to each list. Email or mail recipients may opt-out at any time.
**AUCTION SOFTWARE:
Koons Auctions will not be held liable for any software or software malfunctions.
**INVOICING:
An invoice and payment instructions will be sent to each buyer's registered email at the close of
the auction.
Please read email message completely for PAYMENT & PICKUP INSTRUCTIONS/LOCATION.
Contact us at (507) 236-2902 if you do not receive an invoice from us within 24 hours of auction close.
Payment must be received at time of checkout and pickup following the conclusion of the auction.
If payment is not received or payment arrangements made within 7 days after the conclusion of the auction, the buyer will lose all right, title and interest to the item(s), including any and all moneys.
Auction items will not be released for pickup until payment is made in full.

Koons Auctions DOES NOT run cards on file.
1) YOU WILL NEED TO FOLLOW PAYMENT PROCEDURE BELOW TO PAY AUCTION INVOICE.
2) As Soon as Possible, AFTER our in-house/in-person check out. Koons Auctions will send all unpaid invoice holders a NEW email titled: "Link to Pay Koonsauctions.hibid Invoice# (your invoice number)".
3) That Email will contain a "square invoice" which will have the 4% credit card fee added to it and will also contain a big blue "PAY INVOICE" button.
4) YOU will have to click on the "PAY INVOICE" button to pay your auction invoice online. It will prompt you to put in your Credit card information and you just follow directions.
5) For your reference, a PDF file of the original detailed invoice will be attached at the bottom of this square invoice.
6) Also, Koons Auctions does NOT do our own shipping so NO shipping fees will be added by auction company.
7) Items will NOT be released to our shipper until after the auction invoice is paid in full.
8) If you have trouble with the link. You can contact auction company at 507-236-2902 and we will aid you in getting your invoice paid.
9) SHIPPING will be INVOICED SEPARATELY by 4Diamondshi@gmail.com with a separate square invoice. You will have to pay the shippers invoice the same way.
10) Your items will not ship until shipping invoice is paid. If you have trouble with the link. You can contact SHIPPING company at 507-848-9709 and they will aid you in getting your invoice paid.
11) ANY FAILURE TO PAY an auction OR a shipping invoice in a TIMELY (7 days following the date email was sent.) fashion. Will result in FORFEITURE of items, and any monies paid and buyer being permanently banned from future auctions.
Once auction invoice is paid, your items will be moved to the shipper.
Our shipper will get your items packed and INVOICE YOU SEPARATELY FOR SHIPPING ASAP.
We experience a high volume of shipping customers, so please be patient.
Not everyone can be first. Packages can at times take up to 30 days to reach your destination.
Shipping will be invoiced separately by Four Diamonds Home Inspection (4diamondshi@gmail.com) They will email a square invoice that you can pay on-line also.
Failure to pay your purchase invoice or shipping invoice WILL result in forfeiture of items, moneys paid and in buyer being permanently banned from future auctions.

**ITEM PICKUP:
Removal and/or transportation of item(s) won on auction shall be at the expense, liability and risk of the buyer. Any Items not removed at the allotted checkout time, unless arrangements have been made and agreed upon by seller, will be considered abandoned and the purchaser will lose all right, title and interest to the property, including any and all moneys from the buyer.
FAILURE to pickup/pay for items WILL result in buyer being PERMANENTLY BANNED from future auctions.
BRING WITH YOU: Loading HELP, Tools, Carts, Packing materials, Load straps, Chains, Binders and any other items you may need to load, pack and haul your purchases.
Some Items may need to be move up or down stairs. Bring Adequate Help with You.
**SHIPPING:
Koons Auctions does not ship items. However, SHIPPING IS AVAILABLE on most items through the independent outside shipper we work with. If you have questions if an item can be shipped. Please contact the shipper we use for shipping information. John from Four Diamonds Home Inspections 4diamondshi@gmail.com. John does a nice job and is always willing to work with customers. NO item(s) will ship until both auction invoice and shipping/handling invoice is paid in full. ***We would like to remind customers that the shipping process is slow, tedious, and not cheap. The packing of items takes time, materials, and staff. In the current times, both staff and materials are hard to come by for not only for our shipper, but also for USPS, UPS, SPEEDY and FedEx. These staffing issues are causing delays in shipping. These companies also know how to and are not afraid to charge for their services. ***While FOUR DIAMONDS (Shipper) will try to get items out as fast and as reasonable as possible. Customers should realize that not every customer's package can be the first one shipped. Due to the high volume of shipping required for our toy auctions, and the delays from shipping companies. For this reason, NO items will be packed for shipping until after payment in full has cleared! Most customers can expect to receive their package(s) from 14-30 DAYS AFTER auction invoice is paid in full.
**HANDLING FEES: Minimum Handling fee on standard sized lots, will be $8.00 for the first lot. Handling on each additional standard sized toy lot will be $1.00 per lot. Large group(ed) lots may vary from this schedule!
**SHIPPING & INSURANCE FEES: Shipping will be calculated, and each package will be insured for the invoice amount at buyer's expense. If you have shipping questions. Please contact John from Four Diamonds at 507-848-9709.
We expect customers to follow the same payment rules as Koons Auctions enforces. If a customer mistreats John, Koons Auction will ban that buyer from future auctions.

**RETURNED CHECK FEES:
A fee of $50.00 + ALL costs to recover will be assessed on returned checks and may result in the bidder being denied access to future auctions.
Be sure you can pay immediately after the conclusion of the auction and realize your bids are not conditional upon financing.

**PAYMENT PROCEDURES:
Payments will be made directly to Koons Auctions.

All Checks are to be made payable to Koons Auctions

**REJECTIONS & CANCELATIONS: Koons Auctions reserves the right to reject any and all bids. Koons Auctions reserves the right to cancel any auction at any time. Koons Auctions reserves the right to cancel the sale of any and all items to any buyer before the items are removed or shipped from our facility. Koons Auctions reserves the right to permanently ban any bidder who is troublesome in any way.
