TERMS AND CONDITIONS OF AUCTION
Important Notice: By registering and bidding on any item, the bidder/buyer acknowledges and accepts the following terms and conditions. Do not register or bid unless you agree to all terms and conditions in their entirety. These terms supersede any and all other printed or online terms and conditions. REGISTRATION REQUIREMENTS Eligibility: Bidders must be 18 years of age or older. Accuracy: All information provided during the registration process must be current, complete, and accurate. Discretion: Adam Breault Auctions reserves the right, at its sole discretion, to deny or revoke registration to any person or entity at any time. "AS-IS, WHERE-IS" DISCLAIMER No Warranties: All lots are auctioned "AS-IS, WHERE-IS" with all faults, imperfections, and errors. Adam Breault Auctions and the seller(s) do not provide any type of guarantee or warranty, express or implied, regarding any lot. Bidder Responsibility: While we make every effort to provide accurate catalog descriptions and high-quality photography (including occasional stock photos), it is the bidder's sole responsibility to determine the condition, authenticity, and suitability of each lot. Final Auctions: Inspection in person is highly encouraged during pre-auction viewings. Failure to inspect an item does not constitute grounds for a claim, refund, adjustment, price reduction, termination of the purchase contract, or refusal to close the auction. All auctions are final; no returns or exchanges will be accepted. CONDUCT OF THE AUCTION Auctioneer Authority: The conduct of the auction, including bidding increments, is at the sole direction and discretion of Adam Breault Auctions. Right of Refusal: We reserve the right to reject any bid for any reason, cancel the auction, or remove any item or lot prior to the close of bidding. Agency: Adam Breault Auctions acts strictly as an agent for the seller. Sellers or their agents reserve the right to bid on their own behalf to protect their investments. All decisions made by the auctioneer are final. MAXIMUM (PROXY) BIDDING How It Works: When you place a maximum bid, the current bid does not automatically jump to that amount. The auction software will automatically bid on your behalf at the next highest increment only when competing bids are placed, up to your specified maximum. Legal Contract: Placing a bid constitutes a legally binding contract. You are entirely responsible for your bidding actions and any payment obligations resulting from your winning bids. BUYER'S PREMIUM AND AUCTION TAX Buyer's Premium: Unless a specific auction states otherwise, a 15% buyer's premium will be charged on all items and lots if paying with a credit card (applied to the hammer price). A 10% buyer's premium will be charged on all items and lots if paying with cash or a local check. Check payments are accepted at pickup locations only. Every bidder/buyer pays the same buyer's premium and should bid accordingly. Michigan Auction Tax: A 6% MI Auction Tax applies to specified auctions (please check the individual auction details). Tax is collected on the hammer price only. Tax Exemptions: To qualify for farm use or resale exemptions, you must provide a valid Tax ID and completed exemption paperwork prior to the close of the auction. AUCTION CLOSING AND EXTENSIONS ("SOFT CLOSE") Stated Closing: Bidding concludes for one lot every 15 seconds in catalog order, beginning at the designated closing time. Soft Close Extension: If a bid is placed within the final two (2) minutes of an individual lot's countdown, bidding for that specific lot will automatically extend for an additional two (2) minutes. Linked Lots: Certain lots may be linked in groups; a bid on any single lot within a group may extend the countdown time for all lots in that group. Invoicing: An invoice email will be generated and sent to winning bidders after the entire auction has completely closed. PAYMENT TERMS Timeline: All purchases must be paid for in full within the scheduled removal/pickup dates. Accepted Forms: Cash, Local Checks (accepted at pickup only), Venmo, and Credit Cards via Global Pay. Credit Card Processing: All credit card payments must be manually initiated by the customer using the secure Global Pay link provided in the invoice email. Everything must be paid in full on the day of the auction or auction pickups regardless of when it is picked up. NOTE: We DO NOT automatically charge the card on file for your auction invoice. It is the buyer's responsibility to click the link and submit payment manually. Unpaid Items: Any items not paid for by the close of the scheduled pickup window must be paid via the Global Pay link immediately to avoid forfeiture of the property. Transfer of Risk: Purchases become the full responsibility of the buyer at the time of payment. The buyer assumes all risk of loss or damage to property from that moment forward. ITEM PICKUP AND REMOVAL Deadlines: Winning bidders must pick up their items within the designated removal dates for that specific auction unless prior arrangements are made. Clearance: No items will be released until Adam Breault Auctions has received and verified full payment. Forfeiture and Resale: Any items not removed by the conclusion of the stated removal period will be forfeited back to Adam Breault Auctions. We reserve the right to resell abandoned property with no refunds or credits issued to the original buyer. Loading: Buyers are solely responsible for the rigging, packing, loading, and safe removal of all purchased items. Auction staff will not provide loading assistance. Non-Pickup Penalty Exception: If you fail to pick up your items on the designated load-out day and do not contact us, the credit card used during registration will then be automatically billed for the auction amount. SHIPPING POLICIES Carrier: Shipping is available via UPS. Alternatively, winning bidders may provide their own prepaid shipping labels upon request at the conclusion of the auction. Fees: Buyers are responsible for actual shipping charges plus a $10 handling/packaging fee per package. Insurance: Shipments include automatic carrier insurance up to $100. It is the buyer's sole responsibility to request and pay for additional insurance if desired. International Shipments: Bidders outside the United States must provide all necessary shipping labels and customs documentation. Damaged Shipments: Adam Breault Auctions provides no refunds or adjustments for items damaged during transit (especially glassware). Shipping is entirely at the buyer's risk. Restrictions: We cannot ship oversized, fragile, or hazardous items, including but not limited to: grandfather clocks, machinery, tools/equipment containing gas or oil, large furniture, storage totes, clean-outs, and mystery boxes/lots. Please contact us prior to bidding to verify shipping eligibility for large or oddly shaped items. Fulfillment Timeline: Invoices must be paid in full prior to packaging. Shipping orders are typically processed and shipped within 14 to 21 days from the close of the auction. TECHNICAL ISSUES AND MALFUNCTIONS In the event of server, software, internet, or other online technical difficulties, Adam Breault Auctions reserves the right to extend, pause, continue, or close the bidding. Neither Adam Breault Auctions nor the software provider shall be held responsible for missed bids, connectivity drops, or platform failures. SUSPENSION AND PERMANENT BANNING Bidders will be suspended or permanently banned from all future Adam Breault Auctions online auction events for providing fraudulent registration information or failing to honor payment and item removal obligations. INDEMNIFICATION The winning bidder agrees to indemnify, defend, and hold harmless sellers, auctioneers, auction company owners, directors, and employees from any and all claims, liabilities, judgments, damages, losses, and legal fees arising out of or connected with the auction, item removal, or shipping process.
