· Proper identification showing your current residential address is required before a background check can begin. To be clear, the address on your driver’s license must match the address used during registration and must reflect your current place of residence.
· When items are not paid for or picked up, it prevents other interested bidders from having the opportunity to purchase those items and creates additional costs and delays for the Seller and our staff.

Personal Property:  A 10% Buyer's Premium & 5.5% Sales Tax will be added to the highest bid to arrive at the total purchase price.  Payment in full is required before purchases may be removed from the premises.  Payment options:  Cash, check (payable to Fowler Auction) or credit card on file (or other card).  All sales are subject to Alabama sales tax, unless you have an Alabama sales tax exemption number.  Any other state’s farm certificates are not honored in the state of Alabama, therefore, they are not honored here. Only current “For Resale” certificates (from any state) will be honored.  A sales tax number must be included in your Fowler Auction ONLINE Bidding Profile and a certificate MUST be presented to Fowler Auction for our records.  All lots are subject to owner confirmation.

It is each Bidder's responsibility to determine condition, age, genuineness, value or any other qualifying factor. Bidders who bid online and do not attend the preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is STILL each Bidder's responsibility to determine condition, age, genuineness, value or any other qualifying factor. Fowler Auction & Real Estate Services, Inc. will attempt to describe in detail each item and any pertinent information about it. Fowler Auction & Real Estate Services, Inc. will not be responsible for any errors or omissions in the description of the merchandise. Each Bidder agrees that everything is sold AS IS and that he/she MAY NOT return any item he/she purchases.

THIS AUCTION FEATURES AN AUTO BID EXTEND & STAGGERED CLOSING: When a bid is placed on an item in the final 3 minutes of bidding for that lot, bidding on that lot will automatically be extended 3 minutes from the time the bid was placed (i.e., if an auction lot scheduled to close at 6:00 receives a bid at 5:59, the close time for that lot will automatically extend to 6:02). The auto extend feature remains active until no further bids are received on a certain lot within a 3-minute time frame.  Lots will close in groups every 3 minutes.  Lots that extend will continue to remain open until there has been no bidding within a 3-minute time frame.

Each Bidder is responsible for knowing which item is being bid on. If the Bidder is unsure, he/she should inquire or not bid. When becoming the winning Bidder at auction, you have affected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor a mistake.

MAXIMUM BID: When you bid your maximum bid, the current bid price does not automatically advance to your maximum bid.  Another Bidder has to bid to increase the current price and the bidding platform will automatically bid up to your maximum in the increments specified.

Information in brochures, catalogs and/or other advertisements are from sources believed to be reliable; however, prospective purchasers are STRONGLY urged to inspect the inventory or property to satisfy themselves as to condition, model, manufacturer, year, features, mileage, survey, acres, etc. Neither the Auctioneer nor our clients make any guarantees and are not responsible for listing or advertising inaccuracies or discrepancies.

If for any reason the Buyer fails to make full payment in accordance with the terms above, the Buyer will be liable for the unpaid balance still due and owing, plus interest in the amount of twelve percent (12%) per annum from the auction date and reasonable attorney fees and expenses for collection as a result of said default.

THIS AUCTION FEATURES AN AUTO BID EXTEND

AUCTION END TIMES: Fowler Auction's Online Auctions are timed events and all bidding will close at specified time. Fowler's Online Auctions also have an auto extend feature. When a bid is placed in the final 3 minutes of bidding, the auction bidding will be automatically extended 3 minutes from the time the bid was placed (i.e., if an auction scheduled to close at 6:00 receives a bid at 5:59, the close time will automatically extend to 6:02. The auto extend feature remains active until no further bids are received within a 3 minute time frame.

A credit card is required to register to participate in this auction. Buyer has the option to pay with cash, check or credit card. However, if funds are not provided to Fowler Auction & Real Estate Service, Inc. within 24 hours of auction end time, the credit card used to register for this auction will be charged for the entire invoice total.

SERVER, SOFTWARE TECHNICAL OR INTERNET ISSUES: In the event there are technical difficulties related to the server, software, or any other online auction-related technologies, reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE NOR FOWLER AUCTION & REAL ESTATE SERVICE, INC. SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. · FFL Dealer on site.  A $15 FFL Background Check Fee will be applied to each firearm.
· ALL REGISTERED BIDDERS WHO PLAN TO BID ON A FIREARM OR AMMO MUST BE 21 YEARS OF AGE OR OLDER & MUST PASS AN FBI BACKGROUND CHECK.

· FIREARMS: All applicable gun laws will be observed. All Buyers must provide a valid identification showing age.  A FBI background check must be performed and passed before possession of any firearm will be transferred to any Buyer. If the Buyer is unable to take possession of the firearm, a 20% restocking fee will be assessed on the winning bid and the Buyer's Premium forfeited.  (In other words, if you cannot pass the background check, do not bid on firearms.)
 
· FIREARM TRANSFER: After a background check for an Alabama resident of 21 years or older has been passed, firearm(s) will be transferred to the Buyer.

Non-Alabama residents:  Please provide William Gray a copy of the destined FFL’s certificate, phone number and address.  Email this information to william@fowlerauction.com.  FFL is Buyer’s choice and firearm(s) will be shipped to that destination.  Buyer is solely responsible for any fees in addition to the FBI background check that the designated FFL charges.
