ONLINE-ONLY AUCTION TERMS & CONDITIONS

**BUYER'S PREMIUM & SALES TAX**

A 15% Buyer's Premium will be added to all successful bids. Applicable sales tax will be charged unless a current and valid Blanket Exemption Certificate is on file with the Auction Company prior to the close of the auction.

**PAYMENT TERMS**

**Invoice totals of $1000.00 or less will be charged to the credit card on file at the conclusion of the auction.**

**Invoice totals over $1000.00 must be paid by wire transfer or cash at the scheduled pickup. Credit cards will not be accepted for invoice totals exceeding $1000.00 unless specifically authorized by the Auction Company.**

Wire transfer instructions will be provided to successful bidders when applicable. The purchaser is responsible for any bank or wire transfer fees. Payment must be made in full before any purchased property will be released.

**SHIPPING**

The Auction Company does not ship or arrange transportation of automobiles, furniture, or other large items. Buyers should contact the Auction Company prior to bidding to inquire about the availability of shipping for small items.

When shipping is approved, items may be transported to an independent third-party shipper. All packing, shipping, insurance, and related charges are the sole responsibility of the purchaser and are separate from any charges paid to the Auction Company.

Upon registration, the Bidder warrants that he or she is of legal age and has read, understands, and agrees to be bound by these Terms & Conditions. These Terms & Conditions shall govern the auction and all purchases made through it.

1. BIDDER REGISTRATION

All Bidders must complete the required bidder registration information and provide a valid credit card in order to participate in the auction.

Providing a credit card is required for registration. **YOUR CREDIT CARD WILL NOT BE CHARGED UNLESS YOU ARE A SUCCESSFUL BIDDER AND YOUR INVOICE TOTAL IS $1000.00 OR LESS, OR UNLESS OTHERWISE AUTHORIZED BY YOU.**

The Auction Company reserves the right to approve, reject, suspend, or revoke bidding privileges at its discretion.

2. BIDDING

Bidders are encouraged to monitor their bids throughout the auction. Bidders may elect to receive email notifications when they have been outbid; however, the Auction Company does not guarantee delivery of any email, text message, or other bidding notification.

Failure to receive an outbid notification does not relieve a Bidder of responsibility for bids placed.

3. MAXIMUM BIDDING

Bidders may enter a maximum bid amount, allowing the auction software to automatically bid on their behalf up to the maximum amount entered and according to the established bid increments.

4. RESERVE

All items are sold **WITH RESERVE** unless specifically stated otherwise in the individual lot description or auction information. The Auction Company and/or Seller reserves the right to accept or reject bids in accordance with applicable law.

5. SOFT CLOSE

If a bid is placed on an item during the final minute of bidding, the closing time for that item will automatically be extended by three (3) minutes. Extensions will continue until no additional bids are received during the extension period.

6. CONDITION, DESCRIPTIONS & INSPECTION

The Auction Company makes reasonable efforts to provide accurate descriptions and photographs; however, all descriptions, photographs, measurements, condition statements, quantities, serial numbers, model numbers, and other information are provided for identification and informational purposes only and are not guaranteed.

No sale shall be invalidated because of an error, omission, defect, or inaccuracy in a description or photograph.

Photographs may occasionally include items not included in the lot. Coins, currency, rulers, stands, displays, or other objects may be shown for scale or presentation purposes only and are not included unless specifically stated.

Preview and inspection opportunities are provided when possible, and all Bidders are strongly encouraged to personally inspect items prior to bidding and satisfy themselves as to condition, authenticity, age, quality, quantity, and suitability.

**ALL PROPERTY IS SOLD AS IS, WHERE IS, WITH ALL FAULTS AND WITHOUT WARRANTY OR GUARANTEE, EXPRESSED OR IMPLIED.**

The Bidder is solely responsible for determining the condition and value of an item before bidding.

7. SUCCESSFUL BIDS, INVOICING & PAYMENT

The highest accepted Bidder shall become the Purchaser. **ALL BIDS ARE FINAL AND CANNOT BE RETRACTED.**

Successful Purchasers will receive an invoice by email following the close of the auction.

**Invoice totals of $1000.00 or less:** The Purchaser authorizes the Auction Company to charge the entire invoice amount, including Buyer's Premium, applicable sales tax, and other authorized charges, to the credit card provided at registration immediately following the close of the auction.

**Invoice totals over $1000.00:** Payment must be made by **wire transfer or cash at the scheduled pickup.** Credit card payment will not be accepted for invoice totals exceeding $1000.00 unless specifically authorized by the Auction Company.

All purchases must be paid in full before merchandise will be released.

Failure to make full and timely payment may result in cancellation of the sale, forfeiture of the purchased property, suspension or termination of bidding privileges, and/or other remedies available to the Auction Company and Seller.

A 15% Buyer's Premium and applicable sales tax will be added to the successful bid price.

8. PICKUP & REMOVAL

All purchased items must be removed during the advertised pickup date and time unless prior arrangements have been approved by the Auction Company.

If an additional or special pickup appointment is required, a **minimum $50.00 fee** may be charged.

Items remaining more than three (3) days after the scheduled pickup, without prior written arrangements, may be considered abandoned. Abandoned property may be disposed of, removed, donated, or resold at the Purchaser's sole risk and expense, with no refund due to the Purchaser.

Any property that must be moved, removed, transported, or stored by the Auction Company on behalf of a Purchaser may be subject to additional moving, handling, transportation, and/or storage fees.

When shipping of a small item has been approved, a transportation/handling charge of approximately $10.00�$20.00 may be added for delivery to an independent shipper. Packing, shipping, insurance, and other charges assessed by the independent shipper are the sole responsibility of the Purchaser and are separate from the Auction Company's invoice.

9. RESPONSIBILITY FOR REMOVAL

Purchasers are responsible for providing all labor, tools, equipment, packing materials, vehicles, and assistance necessary to safely remove their purchases.

The Auction Company is not responsible for loading or assisting with the removal of purchased property unless specifically agreed otherwise.

Purchasers are responsible for any damage caused by themselves, their employees, contractors, movers, or other agents during pickup or removal. The Purchaser agrees to reimburse the Auction Company and/or property owner for the cost of repairing such damage.

10. CATALOG CHANGES & UNAVAILABLE PROPERTY

The Auction Company reserves the right to add, withdraw, combine, divide, or modify lots and catalog information at any time prior to or during the auction.

If the Auction Company is unable to deliver an awarded lot because of theft, loss, damage, clerical error, withdrawal, or any other reason, the Auction Company's liability shall be limited to the return of any monies actually paid by the Purchaser for that specific lot.

The Purchaser shall have no further claim against the Auction Company or Seller.

11. LIMITATION OF LIABILITY

By bidding and purchasing property, the Purchaser assumes all risks associated with the ownership, possession, transportation, and use of the purchased property.

To the fullest extent permitted by law, the Purchaser waives claims against the Auction Company, its employees, agents, affiliated organizations, and the Seller arising from the condition, use, misuse, transportation, operation, or ownership of the property purchased, except as otherwise required by law.

12. AUCTION PREMISES

All persons attending a preview, inspection, pickup, or other auction-related activity enter the premises at their own risk.

To the fullest extent permitted by law, the Auction Company, Seller, property owner, and their respective employees and agents shall not be responsible for personal injury, property damage, loss, theft, or accidents occurring on the auction premises.

13. FAILURE TO PAY / DEFAULT

A successful bid constitutes a binding agreement to purchase the property.

If a Purchaser fails to make payment according to these Terms & Conditions, fails to complete an authorized wire transfer, or otherwise defaults on a purchase, the Auction Company may exercise any remedy available to it, including cancellation of the transaction, resale of the property, and suspension or permanent revocation of bidding privileges.

The defaulting Purchaser may be responsible, to the extent permitted by law, for reasonable costs incurred by the Auction Company as a result of the default.

14. ACCEPTANCE OF TERMS

Registration for and participation in this auction constitutes the Bidder's acknowledgment that he or she has read, understands, and agrees to these Terms & Conditions.

By placing a bid, the Bidder agrees that each bid is binding and that, if declared the successful Purchaser, the Bidder will complete the purchase and make payment in accordance with these Terms & Conditions.
