AUCTION TERMS & CONDITIONS
By registering or bidding, you agree unequivocally and without exception to all Terms & Conditions of this auction, including announcements made prior to or during the auction.
You must be at least 18 years old to register and bid at the auction.
Registration does not guarantee bidding privileges. AMT Auction Marketing reserves the right to remove or restrict bidding privileges at its discretion.

PAYMENT
Payment is due no later than Saturday, October 17 at 4:00 PM.
Non-paying bidders will be barred from participating in future AMT Auction Marketing auctions. Non-payment may also be reported to the auction platforms HiBid and Proxibid.

BUYER'S PREMIUM
A 15% Buyer's Premium is in effect for all items.
Example: If you purchase an item for $100, a 15% Buyer's Premium ($15) will be added, for a total of $115. Applicable sales tax will then be added when required.

METHODS OF PAYMENT
Accepted methods of payment:
Cash, Visa, MasterCard, Direct Deposit, or Bank Wire Transfer.
An 8.25% sales tax will be applied to all taxable, non-titled items.
A 3% fee will be added to purchases not paid by cash, direct deposit, or wire transfer.
We do not accept Discover or American Express.

The description of each item is believed to be accurate. However, everything is sold AS-IS, WHERE-IS, and onsite inspection is HIGHLY RECOMMENDED.
AMT Auction Marketing makes no warranties regarding condition, make, model, year, or description. The buyer is solely responsible for inspecting and evaluating each item before bidding.
Any condition information provided by Los Fresnos CISD has not been independently verified by AMT Auction Marketing.
All winning bids constitute acceptance of these written Terms & Conditions and any announcements made in connection with the auction.

RECEIPTS & PAPERWORK
AMT Auction Marketing will provide a paid invoice after proper payment has been received.
If paperwork provided for a purchased item is lost, a $30.00 fee per item will apply for replacement paperwork.

ITEM REMOVAL / PICKUP
All purchased items must be picked up during the designated removal period:
Saturday, October 17 - after the auction
Monday, October 19 - 9:00 AM to 3:30 PM
Tuesday, October 20 - 9:00 AM to 3:30 PM

REPRESENTATIONS
All items are sold AS-IS, WHERE-IS, WITH NO WARRANTY.
The Auctioneer shall not be responsible for any incorrect description, authenticity, genuineness, or defect in any lot and makes no warranty in connection therewith.
The Auctioneer makes every effort to provide accurate information about the items being sold. Errors may occur, whether written or verbal. It is the buyer's full responsibility to confirm the accuracy, condition, and suitability of any item offered for sale.

INSPECTION IS HIGHLY RECOMMENDED.
ALL SALES ARE FINAL
A successful bid at auction, whether live or online, constitutes a legally binding contract of sale.
ALL SALES ARE FINAL. THERE WILL BE NO REFUNDS, RETURNS, OR EXCHANGES.
FAILURE TO REMOVE PURCHASES
If purchased items are not removed within the allotted removal time, the items shall be deemed abandoned.
The buyer will lose any right, title, or interest acquired in the items, and the items shall revert to Los Fresnos CISD without further notice to the buyer.
Los Fresnos CISD reserves the right, at its discretion, to resell such property by private or public sale if these Terms & Conditions are not met.
Consider this your notice.
ACTS OF OTHERS / SAFETY
Persons attending the inspection, auction, or removal of merchandise assume all risks of damage or loss to persons, property, or merchandise and shall exercise proper precautions at all times for the protection of persons and property.
All persons shall comply with applicable safety and health requirements and with safety instructions provided by the Auctioneer.
Neither the Auctioneer, its subcontractors, agents, employees, nor representatives shall be liable by reason of any defect in or about the condition of the premises on which the auction is held.
The buyer specifically releases the Auctioneer, its agents, and representatives from liability thereof.
LICENSING
AMT Auction Marketing is a licensed auction company and auctioneering service. We are regulated by the Texas Department of Licensing and Regulation and operate under the state-issued Recovery Fund.

INDEMNIFICATION
Buyer shall indemnify, hold harmless, and defend the Auctioneer, owners, and building owners from and against any and all losses, damages, liabilities, claims, attorney fees, costs, and expenses arising out of, based upon, or resulting from:
1. Failure to secure all necessary safety equipment or meet applicable government safety standards when removing or using purchased items.
2. Failure to comply with safety instructions issued to the buyer by the Auctioneer.
3. Any act or omission of the Auctioneer, owners, building owners, or their respective agents, representatives, or employees relating to or affecting items bid upon or purchased by the buyer.
4. Any third-party claim challenging title to an item purchased by the buyer or claiming infringement of a proprietary interest.
5. Any claim resulting from the Auctioneer offering for sale or selling items purchased by the buyer.
6. Any injury to the buyer, any other person, or property of any kind occurring during the inspection, dismantling, removal, or transportation of purchased items.
ERRORS & DISPUTES
AMT Auction Marketing reserves the sole right to settle any dispute or tie bid between bidders.
In the event of a live or online bidding error, AMT Auction Marketing reserves the right to cancel any winning bid affected by the error.
HOUSEKEEPING
Please do not litter or leave trash on the grounds.
This auction is conducted with reserve. AMT Auction Marketing and/or the seller reserves the right to pass any item.
COLLUSION & FRAUD
Practices intended to eliminate or improperly manipulate competition, including collusive bidding, intentionally invalid bidding, or bidding without the intent to pay, may result in criminal, civil, or administrative action against the participant(s).
Such activity may be referred to the seller and/or the appropriate authorities.
Online fraud may constitute a felony.
INVENTORY
Inventory may be changed at the discretion of Los Fresnos CISD and/or AMT Auction Marketing.
