ONLINE AUCTION TERMS & CONDITIONS PLEASE READ ALL TERMS & CONDITIONS CAREFULLY BEFORE BIDDING. By registering for, placing a bid in, or participating in an auction conducted by Becker Auction LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, subject to applicable law. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT BID. 1. AS-IS, WHERE-IS All items are sold AS IS, WHERE IS, WITH ALL FAULTS, without warranties or guarantees, expressed or implied, to the fullest extent permitted by law. Becker Auction LLC makes no warranty regarding the condition, completeness, authenticity, merchantability, fitness for a particular purpose, functionality, or value of any item. All items are sold in their present condition at the time of sale. 2. ACCURACY OF DESCRIPTIONS Becker Auction LLC makes reasonable efforts to provide accurate descriptions and photographs. However, descriptions are not guaranteed. The Buyer is responsible for verifying the condition, completeness, authenticity, identification, age, make, model, serial number, working condition, and suitability of any item before bidding. Descriptions may contain information supplied by consignors, estates, manufacturers, or other third parties. If a make or model number cannot be identified, Becker Auction LLC will not assume one. The presence of a serial number, model number, identification label, or original packaging does not guarantee that the contents match the information displayed. Buyers should not rely solely on descriptions or photographs when additional verification is necessary. Buyer assumptions, misunderstandings, or disagreements with subjective descriptions do not, by themselves, establish grounds for a refund. 3. BIDDER INSPECTION All bidders are strongly encouraged to inspect items before bidding. Inspection dates, times, and locations will be published in the auction information. By placing a bid, the Buyer acknowledges that they have either inspected the item to their satisfaction or voluntarily chosen not to inspect it. Failure to inspect does not relieve the Buyer of their obligations under these terms. Buyers should contact Becker Auction LLC with questions before bidding. 4. ALL SALES FINAL ALL SALES ARE FINAL. NO RETURNS, REFUNDS, OR EXCHANGES, except where required by applicable law or expressly authorized in writing by Becker Auction LLC. All winning bids are binding. The Buyer assumes responsibility for purchased items as provided in the applicable auction terms. 5. AUCTIONEER'S DISCRETION Becker Auction LLC reserves the right to reject bids, withdraw items, correct listing errors, resolve bidding disputes, reopen bidding, or cancel a sale when reasonably necessary to protect the integrity of the auction. In the event of a bidding dispute, Becker Auction LLC's determination shall govern to the extent permitted by applicable law. Becker Auction LLC reserves the right to correct clerical errors and technical mistakes. 6. PAYMENT TERMS A valid credit card is required for bidder registration unless otherwise authorized. Accepted payment methods include: " Cash " Credit cards " Debit cards " Good checks with positive identification, subject to approval " Wire transfer or ACH when required or approved BUYER'S PREMIUM A 15% Buyer's Premium applies to all purchases unless otherwise stated. A 5-percentage-point discount applies to the Buyer's Premium for qualifying cash or approved check payments, resulting in a 10% Buyer's Premium. LARGE INVOICES Invoices exceeding $1,500 must be paid by wire transfer, ACH, or cash unless Becker Auction LLC expressly approves another payment method. Becker Auction LLC reserves the right to require verified or cleared funds before releasing or shipping merchandise. SALES TAX Applicable sales tax will be collected as required by law based on the transaction and delivery location. Buyers claiming tax exemption must provide valid exemption documentation acceptable under applicable law. PAYMENT DEADLINES Invoices must be paid by the deadline specified for the auction. Unpaid invoices may result in suspension of bidding privileges, collection efforts, and other remedies permitted by law. 7. ITEM PICKUP, STORAGE & UNCLAIMED PROPERTY Buyers must pick up purchased items during the designated pickup dates and times published for each auction. Buyers are responsible for arranging transportation, labor, equipment, and loading assistance. LATE PICKUP Items not picked up during the scheduled pickup period may be subject to: " A late-pickup surcharge equivalent to an additional 20% of the hammer price. " Storage fees of $5 per calendar day. " An additional $50 fee when a separate return trip or special pickup arrangement is required. These fees apply only to the extent permitted by law and when properly disclosed as part of the auction terms. UNCLAIMED ITEMS Items remaining unclaimed for 30 days after the designated pickup deadline may be treated as abandoned only to the extent permitted by applicable law. Becker Auction LLC may pursue lawful storage, collection, disposal, or resale remedies after providing any legally required notice. Any resale proceeds and outstanding obligations will be handled in accordance with applicable law. Failure to pick up items does not automatically cancel the purchase or eliminate payment obligations. 8. SHIPPING TERMS, ADDRESS ACCURACY & DELIVERY RESPONSIBILITY Shipping is available only for items Becker Auction LLC agrees to ship. Shipping is not guaranteed for all merchandise. Shipping generally applies to smaller items, including coins, currency, cards, and other merchandise suitable for standard parcel shipment. Becker Auction LLC does not ship furniture, large or bulky items, or merchandise prohibited by applicable shipping regulations or carrier policies. NO SHIPPING IS AVAILABLE ON AMMUNITION. SHIPPING COSTS & HANDLING FEES All shipping charges, packaging costs, handling fees, insurance charges when applicable, and related expenses are the sole responsibility of the Buyer. Merchandise will not be shipped until payment has been received and cleared to Becker Auction LLC's satisfaction. ACCURACY OF SHIPPING ADDRESS The Buyer is solely responsible for providing and maintaining a complete, accurate, and deliverable shipping address in their HiBid/Auction Flex account and confirming that address before shipment. This includes the correct recipient name, street address, apartment or suite number, city, state, ZIP code, and any other information required for successful delivery. Becker Auction LLC may rely on the shipping address provided by the Buyer through the bidding platform, invoice, or written shipping instructions. Becker Auction LLC shall not be responsible for packages lost, delayed, misdelivered, returned, or delivered to an incorrect location as a direct result of inaccurate, incomplete, outdated, or otherwise incorrect shipping information supplied by the Buyer. RETURNED, REFUSED & UNDELIVERABLE PACKAGES If a package is returned, refused, or deemed undeliverable because of an incorrect or incomplete address supplied by the Buyer, the Buyer shall be responsible for all additional shipping charges, return postage, handling fees, and reshipping expenses. Becker Auction LLC is not obligated to reship merchandise until all additional charges have been paid. NO GUARANTEED REFUNDS No refund, reimbursement, replacement, or shipping credit is guaranteed for merchandise lost, delayed, returned, refused, or misdelivered due to incorrect or incomplete shipping information provided by the Buyer. Any refund, credit, or reshipment offered by Becker Auction LLC shall be determined on a case-by-case basis, subject to applicable law. CARRIER DELAYS, LOSS & DAMAGE Once a package has been properly addressed, packaged, and transferred to the shipping carrier, Becker Auction LLC is not responsible for loss, damage, misdelivery, or delays caused solely by the carrier, except where liability cannot legally be excluded. Buyers acknowledge that delivery estimates are not guaranteed. Shipping claims may be subject to the carrier's procedures, applicable insurance coverage, and governing law. BUYER ACKNOWLEDGMENT By requesting shipment, the Buyer acknowledges responsibility for verifying the accuracy of their shipping information and agrees to pay applicable shipping, handling, return, and reshipping charges. Nothing in this section eliminates rights or remedies that cannot legally be waived. 9. BUYER RESPONSIBILITY & LIABILITY Buyers are responsible for safely removing purchased merchandise. Buyers must provide adequate labor, tools, equipment, vehicles, and assistance. Becker Auction LLC employees are not obligated to load, disassemble, move, or transport merchandise. Buyers are responsible for damage they cause to property, buildings, equipment, or other merchandise during removal. Buyers must follow reasonable safety instructions while on auction premises. 10. DISPUTES & CHARGEBACKS Buyers are encouraged to contact Becker Auction LLC promptly regarding billing questions, merchandise concerns, or transaction disputes. Becker Auction LLC will make reasonable efforts to review legitimate concerns. Buyers remain responsible for valid purchases and amounts lawfully owed under these terms. Becker Auction LLC reserves the right to provide invoices, bidding records, photographs, auction terms, communications, pickup records, and shipping documentation when responding to payment disputes. Fraudulent chargebacks, knowingly false claims, or intentional payment avoidance may result in suspension of bidding privileges and lawful collection action. Nothing in these terms limits legally protected chargeback rights or other nonwaivable consumer remedies. 11. AUCTION SITE HAZARDS Auction premises may contain uneven surfaces, heavy equipment, sharp objects, machinery, vehicles, electrical hazards, and other potentially dangerous conditions. Buyers enter auction premises at their own risk to the extent permitted by law. Buyers are responsible for exercising reasonable care and following safety instructions. To the extent permitted by applicable law, Becker Auction LLC and the Seller shall not be responsible for injuries or property damage resulting from hazards or conduct for which they are not legally responsible. Nothing in this section excludes liability that cannot legally be waived. 12. GOVERNING LAW, VENUE & LEGAL FEES These Terms & Conditions shall be governed by the laws of the State of Minnesota. To the extent legally permissible, disputes arising from these terms shall be brought in a court of competent jurisdiction serving Fillmore County, Minnesota. If Becker Auction LLC prevails in an action to enforce these terms, it may seek recovery of reasonable attorney fees, court costs, and related expenses to the extent authorized by applicable law. 13. LIMITATION OF LIABILITY To the fullest extent permitted by applicable law, Becker Auction LLC, its owners, employees, representatives, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from participation in an auction. This includes claims involving lost profits, business interruption, or loss of anticipated value. For claims subject to lawful contractual limitation, Becker Auction LLC's aggregate liability shall not exceed the amount actually paid by the Buyer for the item giving rise to the claim. Nothing in this section limits liability that cannot legally be excluded or restricted. 14. SEVERABILITY If any provision of these Terms & Conditions is determined to be invalid, illegal, or unenforceable, the remaining provisions shall continue in effect to the fullest extent permitted by law. 15. AMENDMENTS TO TERMS Becker Auction LLC may publish updated Terms & Conditions for future auctions. The terms applicable to a particular auction will be those properly disclosed and accepted in connection with that auction, together with any lawful amendments. Material changes affecting existing bids or purchases will not be applied retroactively without any consent or notice required by law. No employee or representative may waive a material provision of these terms unless authorized by Becker Auction LLC. 16. EXTENDED BIDDING & CLOSING TIMES All bidding is conducted online unless otherwise stated. Lots are generally scheduled to close at a rate of six lots per minute, approximately one lot every ten seconds. EXTENDED BIDDING If a bid is placed during the final two minutes of a lot's scheduled closing period, the bidding period for that lot will extend by an additional two minutes. Extensions continue until a full two-minute period passes without another qualifying bid. Actual closing times may vary due to extended bidding, technical issues, or auctioneer adjustments. Buyers are responsible for monitoring their bids and internet connections. Becker Auction LLC does not guarantee uninterrupted access to the bidding platform. 17. PRECEDENCE OF TERMS & BIDDING PLATFORM Becker Auction LLC conducts online auctions through Auction Flex, HiBid, or other authorized platforms. These Terms & Conditions govern the relationship between Becker Auction LLC and participating bidders to the extent permitted by applicable law. Where binding platform agreements, payment processing requirements, or applicable laws impose additional or controlling obligations, those requirements shall apply. Becker Auction LLC is not responsible for platform outages or technical failures beyond its reasonable control, except where liability is imposed by law. Becker Auction LLC may postpone, extend, reopen, or reschedule bidding when reasonably necessary because of a technical disruption. 18. CONSIGNMENT & ESTATE SALES Becker Auction LLC generally conducts auctions on behalf of consignors, estates, and other sellers. Unless expressly disclosed otherwise, Becker Auction LLC acts as auctioneer or selling agent and does not own the merchandise being offered. Descriptions and representations may be based on information provided by consignors, estates, or other sources. Buyers are responsible for conducting their own due diligence before bidding. All merchandise remains subject to the AS-IS, WHERE-IS provisions and other applicable terms. 19. COINS, CURRENCY, PRECIOUS METALS & THIRD-PARTY GRADING A. THIRD-PARTY GRADED COINS & CURRENCY Coins and currency certified, authenticated, or graded by PCGS, NGC, ANACS, ICG, PCI, or any other third-party grading company are sold AS IS, WHERE IS. Grades, designations, varieties, attributions, and authentication opinions appearing on holders are those of the issuing grading company and are not independently guaranteed by Becker Auction LLC. Buyers are responsible for verifying certification numbers, holder authenticity, grading information, and relevant details before bidding. Becker Auction LLC does not guarantee that any item will receive the same grade, designation, or authentication result if resubmitted, regraded, or examined by another grading service. B. RAW & UNGRADED COINS All raw or ungraded coins and currency are sold AS IS, WHERE IS. Any statements concerning grade, condition, authenticity, variety, mintmark, composition, or value are provided for identification and informational purposes only. Becker Auction LLC does not assign certified grades to raw coins. Buyers are responsible for independently determining authenticity, grade, condition, composition, and value before bidding. C. SILVER DOLLAR ROLLS & COIN COLLECTIONS Silver dollar rolls, coin rolls, bags, bulk collections, and grouped coin lots are sold AS IS, WHERE IS. Descriptions identifying visible end coins, dates, mintmarks, or other characteristics apply only to the coins or features specifically identified in the listing. Becker Auction LLC does not guarantee the dates, mintmarks, grades, authenticity, precious-metal content, or value of coins that have not been individually identified or examined. Unless expressly stated otherwise, rolls and collections have not been individually searched, graded, or authenticated by Becker Auction LLC. Buyers acknowledge that rolls and collections may contain coins of varying dates, mintmarks, conditions, compositions, and values. D. SIGMA TESTING & PRECIOUS-METAL VERIFICATION Becker Auction LLC may use a Sigma Metalytics precious-metal verifier, scales, visual examination, or other testing methods when evaluating coins and precious metals. Testing results are provided for informational purposes only. Sigma testing and other examination methods have limitations and do not constitute a guarantee of authenticity, purity, precious-metal content, grade, or value. A passing test result does not independently establish authenticity. Becker Auction LLC does not guarantee that subsequent testing by another person, instrument, or laboratory will produce identical results. E. PHOTOGRAPHS, HOLDERS & CERTIFICATION LABELS Photographs form part of the auction listing and should be carefully reviewed before bidding. Buyers are responsible for evaluating visible condition, wear, damage, scratches, cleaning, alterations, holder condition, and other characteristics. The presence of a certification label, barcode, serial number, or holder does not constitute an independent warranty by Becker Auction LLC. F. BUYER RESPONSIBILITY & FINAL SALES Buyers are encouraged to inspect merchandise, research certification information, and ask questions before bidding. All bids are binding, and all sales are final, subject to applicable law. Disagreements regarding grading opinions, estimated values, market prices, or subsequent grading results do not, by themselves, establish grounds for a refund, return, exchange, or price adjustment. Nothing in this section excludes rights or remedies that cannot legally be waived. 20. BIDDING PRIVILEGES, ACCOUNT SUSPENSION & TERMINATION Becker Auction LLC reserves the right, subject to applicable law and binding platform requirements, to approve, deny, suspend, restrict, or permanently revoke bidding privileges. Reasons may include: " Failure to pay invoices in full. " Failure to pick up purchased items. " Returned checks, declined credit cards, or unsuccessful payments. " Fraudulent activity or false registration information. " Bid manipulation, collusion, shill bidding, or interference with an auction. " Threatening, abusive, or harassing conduct toward employees, consignors, or other bidders. " Repeated violations of auction terms. " Knowingly false or fraudulent payment disputes. " Conduct that reasonably threatens auction safety, integrity, or lawful operation. NONPAYMENT & OUTSTANDING BALANCES Bidders with unpaid invoices, returned checks, declined payments, or outstanding balances may have bidding privileges suspended until their obligations are resolved. Becker Auction LLC reserves the right to pursue lawful collection remedies. CHARGEBACKS & PAYMENT DISPUTES Becker Auction LLC may temporarily suspend bidding privileges while investigating a payment dispute when reasonably justified. Permanent restrictions may be imposed for fraudulent conduct or material violations of these terms. Legally protected payment-dispute rights remain unaffected. PERMANENT BIDDING RESTRICTIONS Bidders whose privileges have been revoked may be prohibited from participating in future Becker Auction LLC auctions. Attempting to circumvent restrictions by creating additional accounts, using another person's account, or providing false information may result in further restrictions or lawful remedies. NO GUARANTEE OF BIDDING ACCESS Registration or previous participation does not guarantee continued bidding privileges. Becker Auction LLC reserves the right to restrict participation when reasonably necessary to protect the auction process, enforce these terms, or comply with applicable law. 21. QUANTITY BIDDING - TIMES THE MONEY Some auction lots may be offered using a TIMES THE MONEY bidding format. Under this format, the amount bid is multiplied by the quantity stated in the listing. For example, a bid of $10 on a lot with a quantity of 10 results in a $100 hammer price before applicable Buyer's Premium, taxes, and fees. Buyers are solely responsible for reviewing the quantity, bidding format, and total purchase obligation before placing a bid. BIDDING ERRORS & BUYER RESPONSIBILITY A bid placed in error because the Buyer misunderstood the quantity, bid amount, or TIMES THE MONEY format does not automatically qualify for cancellation, adjustment, or refund. Buyers are responsible for carefully reviewing all lot details before submitting a bid, including: " Whether the lot is sold individually, as a group, or TIMES THE MONEY. " The number of units included in the lot. " The total purchase price resulting from the bid amount multiplied by the quantity. " Any applicable Buyer's Premium, sales tax, or additional fees. ALL BIDS ARE BINDING Once a bid has been submitted and accepted by the bidding platform, it is considered binding, subject to applicable law. Becker Auction LLC is not obligated to cancel or modify a bid because of bidder misunderstanding, accidental bidding, failure to review the lot description, or failure to understand the quantity format, except where required by law. AUCTIONEER'S DISCRETION Becker Auction LLC reserves the right to correct demonstrable bidding or listing errors, resolve quantity-related disputes, and take reasonable action to maintain the integrity of the auction, subject to applicable law. 22.
