Auction Terms & Conditions
You are required to read and agree to all terms and conditions for this auction prior to bidding. (If you do not agree please do not register to bid). All property is sold �as is, where is� without any warranty or guarantee of any kind, expressed or implied. ALL SALES ARE FINAL. There are NO REFUNDS, NO EXCHANGES or REFUSALS. By being the highest bidder on an item, you are the buyer and are bound by the terms and conditions of this sale.

All units are subject to redemption by the renter up until an hour before the auction closes.

Removal of all items shall be at the expense, liability and risk of the purchaser. All property must be removed within 72 hours after the auction (Friday November 6th at 7pm). The buyer will have a $50 refundable deposit on each unit purchased. Once the unit is swept clean with all the items removed and the key & lock returned to Bid-N-Buy Realty & Auctions Inc (5893 School Rd, Castile, NY 14427) the deposit will be returned to the buyer. Property not removed within the announced time period shall be considered abandoned and will revert to the seller for disposal without refund and the deposit is kept by the auctioneer. ALL items must be removed.

Registration:
Registration requires a credit card for verification of identification only. We will not add any charges to your credit card until auction pick up is over. Therefore, you can pay with a check or cash if you wish.

By registering for our online or live auctions you agree to all of our terms and conditions, an online registration will be considered a signed contract from the bidder who wishes to participate in our auction and that the bidder is accepting all of these terms & conditions. All registrations and bids are considered legal and binding.

Bidding:
Once you have registered now it's time to bid. Go to the view catalog. Click on an item inside the catalog that you wish to bid on. After reading the description you can now bid. Click on the "bid button". You can bid to the next increment or place a max bid. If you choose max bid the computer will bid for you up to your max amount. Preset bidding increments have been set up. As the price of an item increases the bid amount increments will increase. It is not necessary to enter a decimal point and zeros to your bid amount. The computer software will enter them for you. You can also bid live as the auction closes. 30 minutes before the auction closes click on "enter live auction" button. Place your bids as the increments increase.

Auction Closing:
Our Internet auctions use a "soft close" format. An item will close every 20 seconds after the beginning of an auction. This gives the bidder the opportunity to bid on more than one item. If there is an advance bid inside of 2 minutes to close the bidding, that item will be extended by 2 minutes. This process will continue until there is no more bidding activity.

Payment:
A 13% buyer's premium will be added to the final purchase price of each item. There will be a 3% discount for cash and check. Payment is expected on Wednesday November 4th by 6pm. We accept most major credit cards, cash & personal or business checks.
All property must be removed within 72 hours after the auction (Friday November 6th at 7pm).

Pick up information:
All buyers are expected to pay for their invoice between 9-6pm on Wednesday November 4th.
Sales Tax: 8% New York State sales tax will be charged on all purchases and buyer's premium. If you are tax exempt, you must sign a resale or farm exempt form.

NO STOP PAYMENT ORDERS OR CREDIT CARD CHARGEBACKS:
No stop payment orders or credit card chargebacks. Each bidder agrees that such bidder will not, under any circumstances, (i) issue a stop payment order with respect to any checks issued or in connection with the auction, or (ii) initiate a credit card chargeback with respect to any purchases at the auction. Each bidder further agrees that if, in violation of these terms and conditions, a stop payment order is issued or a credit card chargeback is initiated, these buyer terms & conditions will be conclusive evidence of the bidder's (i) waiver of any rights to issue a stop payment order or to initiate a credit card chargeback, and (ii) agreement not to issue a stop payment order or to initiate a credit card chargeback; and each bidder acknowledges and agrees that the auctioneers presentation of these bidder terms and conditions to the bank, credit card company, or other financial institutions against which a check was drawn or that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse any stop-payment order and/or reverse or deny any credit card chargeback, and will re-credit all amounts to, or for the account of auctioneer. If, in violation of these bidder terms and conditions, a bidder issues a stop payment order or initiates a credit card chargeback, such bidder, even if successful, will remain liable for all purchases made at the auction, and will be responsible for all costs and expense, including attorney's fees, incurred by or on behalf of auctioneer and/or seller in challenging the stop payment order or credit card chargeback and in collecting payment. Each bidder acknowledges and agrees that the covenant not to issue a stop payment order or initiate a credit card chargeback is a condition to the issuance of a bidder number to such bidder, and is being made as an inducement for the auctioneer to accept such bidder's bidder registration, to issue a bidder number, and to permit the bidder to bid at the auction. Each bidder acknowledges and agrees that the auctioneer is relying on the covenant not to issue a stop payment order or to initiate a credit card chargeback in accepting such bidder's bidder registration, in issuing a bidder number, and in permitting the bidder to bid at the auction. All items are sold in as/is condition with no warranties implied or expressed. By signing this you agree to all these terms and conditions.

IT IS IN YOUR BEST INTEREST TO ATTEND AN OPEN HOUSE TO VIEW THE CONDITION OF ANY LOT YOU WISH TO BUY. OUR CONSIGNERS BRING ITEMS TO SELL AND EXPECT A CHECK AT THE END OF THE AUCTION. WE WILL IN NO WAY ACCEPT ANY ITEM RETURNED DUE TO DESCRIPTION OR CONDITION! BY REGISTERING AND BIDDING ON THIS AUCTION YOU AGREE TO THESE TERMS.***
