TERMS AND CONDITIONS OF REAL ESTATE AUCTION 1. REGISTRATION: Bids will only be accepted by registered bidders. Registration begins online on April 23, 2017.
2. TERMS OF SALE: All property is sold "AS IS, WHERE IS" . Bidders should perform such independent investigation with respect to the property as they deem necessary and appropriate, ALL SALES ARE FINAL.
3. AGENCY: The auction company and its representatives represent the seller.
4. ANNOUNCEMENTS: Announcements day of sale take precedence over all prior communications, verbal and written concerning this sale.
5. BIDDING: The auctioneer will determine bid increments.
6. DEPOSIT ON REAL ESTATE: $3,000.00 down day of sale by Cash, Personal Check or Cashier's Check.
7. CLOSING DATE FOR REAL ESTATE: The balance of the purchase price is due at settlement within 45 days of auction end.
8. TRANSFER OF TITLE TO REAL ESTATE: The real estate will be conveyed by general warranty deed free and clear of liens subject, however to any recorded rights of way, easements, conditions and restrictions.
9. FINANCING: The sale of the real estate is a cash transaction and is not conditioned upon the bidder obtaining financing. Bidders should arrange any necessary financing prior to registration to bid.
10. BROCHURE: The information contained in the brochure is subject to independent verification by prospective bidders. Neither the Auction Company nor the Seller assumes any liability for its accuracy or any omissions. Boundaries contained in this brochure are approximate.
AUCTION BIDDER DEFAULT: Successful bidder not executing and returning the contract with earnest money deposit within 24 hours of auction close will be considered in default. In the event a winning bidder fails to submit the signed Contract for Sale of Real Estate and 5% deposit, the winning bidder will be charged a penalty fee of $2,500.00 on the credit card provided at auction registration. Additional default remedies are reserved by High Hopes Auction & Appraisals and the Seller as provided in the Auction Terms and Conditions and the Contract for Sale of Real Estate. High Hopes Auction & Appraisals reserves the right to sell to the second-highest bidder in the event the successful high bidder does not comply with the terms of the sale.

13 Announcements: Notices and Announcements made by High Hopes Auction Co. on the day of an Auction event are binding and take precedence over any advertisements or listings.

14. Bidding by or on Behalf of the Seller: Except in the case of an Absolute Auction, High Hopes Auction Co. may bid on Seller's behalf up to but not in excess of the Reserve Price.

15. Withdraw of Property. High Hopes Auction Co. has the right to Withdraw any Property from an Auction event, provided however, that Property offered at Absolute Auction cannot be withdrawn after a bid has been received and Proerty offered Absolute Above a Stated Price cannot be withdrawn after a bid at or in excess of the stated price has been received.
