It is recommended that all prospective bidders examine carefully all items in which they have an interest. While every effort is made to disclose known defects or imperfections, we are unable to guarantee the condition of any item. Please inspect all items prior to bidding. No returns or refunds. Everything is sold "as is" and "where is" without warranties or guarantees of any kind. Buyers shall rely entirely upon their own inspection and information. All sales are final. Failure to inspect the property does not relieve the bidder of responsibility for payment and removal. Any error in description does not relieve the buyer of their responsibilities. There are no refunds or returns.

Qualified statements by the auctioneer or auction company are opinions, not representations or warranties. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear, tear, imperfections or the effects of aging. Colors may not be exactly as appears. All measurements are approximate.

New Beginnings reserves the right to withdraw any lot at any time. Sellers reserve the right to bid on any and all items. Jewelry items are not returnable for any reason after they leave the auction premises; all jewelry sales are final. Dimensions and weights listed are approximate.

PICK-UP

Items paid for during designated pick up time and picked up after pick up time will be subject to a minimum $5.00 per day storage fee. Items paid for and picked up after the designation pick up time will be subject to a minimum $10.00 per day storage fee. If you are unable to pick up (or send a designate to pick up) during the pick up dates and times, you WILL be assessed a storage fee of $5.00/DAY or $10.00/DAY for each day (or portion thereof) until your items are picked up. NO EXCEPTIONS.

Winning bidders are solely responsible for removing their won lots. Before bidding, be sure you can pick up your item(s) at the designated time and location. All items shall be removed from our premises at the purchaser's expense during the designated pick up date and time. Unclaimed lots will remain the property of New Beginnings. No refunds will be issued if you fail to attend pickup to retrieve your items. You must provide your own tools, boxes, packing materials, labor and transportation to facilitate safe removal of your item(s). Plan accordingly for large or bulky items. Loading assistance for large or bulky items is available for $20 per item; cash only. New Beginnings will not be liable for any damages created or incurred by you upon the pickup or transport of your item(s).

All buyers must have a paid receipt from New Beginnings at time of pickup. Buyers making payment at the time of pick up will be issued a paid receipt at that time. Be prepared to show identification to pick up your item(s). Purchases will be released upon presentation of proof of payment.

If merchandise belonging to a purchaser is lost by fire, theft, damage or any other reason, prior to the purchaser taking possession within the specified period, the liability of New Beginnings shall be limited to the actual amount paid for the same at the auction wherein it was acquired and shall in no event include any incidental or consequential damages.

BIDDING

You must be 18 years old or older to bid in any auction. All Bidders are required to be ID verified to bid by registering with a valid credit or debit card. Bidders must register for each auction separately.

Your bid must adhere to the bid increment schedule. Bids do not include the buyer's premium, taxes, handling fees, or shipping costs. All items are subject to local sales tax. An18% buyer's premium will be added to each lot won.

By placing a bid through this website, you are entering into a legally binding contract and agree to follow through with the purchase of the item should you win the item. Once a bid has been submitted, it cannot be retracted or changed. It is your responsibility to understand the pickup and delivery options and costs for each item before you place your bid. All bids are shown in US dollars and all taxes, shipping, and handling charges are additional. A bid by any person shall be conclusive proof that the person has read these conditions of sale and has agreed to be bound by them.

At the scheduled closing date and time of a sale, lots will begin to close one lot at a time with 20 seconds between each lot closing. When an item receives a bid with less than two (2) minutes remaining until closing, the close time will be reset to two (2) minutes from the time that bid is placed and will continue to reset to two (2) minutes with each newly placed bid. The item will not close until two (2) minutes have elapsed with no additional bid activity.

Bidder agrees to hold New Beginnings harmless for the failure to execute a bid for any reason on behalf of any participants. New Beginnings owners, employees and consignors reserve the right to bid on any items in auction. Lots may be auctioned with reserve, and auctioneer may advance the bidding on behalf of the seller's reserve without further notice.

New Beginnings reserves the right to withdraw any item from the site or to amend any content on the site at any time in its sole discretion. New Beginnings will not be liable to you or any third party if we withdraw an item, amend any content on the site or deny you access to the site or the services. A lot will be sold to the highest bidder as determined by the sole and exclusive judgment of the auctioneer. The auctioneer reserves the right to reject a bid from any bidder. The auctioneer will, without liability, determine the bidding increments and maintains sole authority to resolve disputes.

PAYMENT

Payment must be received by the close of the last scheduled pick up date and time. Payment can be made online or at time of pick up. Payment can be made using credit card, debit card, or cash. All bidding and purchases are in U.S. Dollars. A 18% buyer's premium will be added to the successful bids. Cash Buyers receive a 3% discount on the BP (15% BP on cash payment). Shipping fees will be charged separately from your invoice once the cost is determined. No items may be removed until payment is made in full.

Sales tax of 8.25% will be added unless the buyer has provided a signed Sales Tax Resale Certificate or Exemption Certificate for this auction. Prospective buyers MUST email their signed resale form prior to the end of the auction to newbeginningsretale@austin.rr.com.

Any items not paid for at the end of the pickup period will be considered abandoned. If payment is not made or the credit card on file cannot be processed, New Beginnings reserves the right to resell the items to a back-up bidder without notice or, in its sole and absolute discretion, resell or dispose of the items.

New Beginnings reserves the right to charge any payment option you have on file and/or to report your account to collections for the combined total of the original invoice amount and/or any moving or disposal charges and you will be responsible for any charges incurred by New Beginnings in collecting your payment.
