REGISTRATION: Please register, sign a binding agreement and receive a bidder number with the cashier. All bidders must have proper, government issued identification, to register.

PAYMENT: Payment for purchases must be made on day of sale and prior to removal of any assets.

Payment may be made by cash, certified check, Visa, MasterCard & American Express. No personal or business checks

When paying by credit card, Purchaser is waiving any/all rights to initiate a credit card charge-back against the transaction and/or Gryphon Auction Group. Purchases are made AS-IS with no returns.

CHECKOUT: Bidder checkout shall not commence within the first hour of the auction. Registering bidders will have priority over those awaiting checkout.

SALES TAX: _7.5_% state sales tax will be added to all purchases. Dealers of exempt agencies must register a copy of their sales tax exempt certificate with the cashiers at the time of registration. A copy of certificate will be retained by Auctioneer. Purchasers unable to provide tax exempt certificate to Auctioneer at the time of registration must pay all applicable taxes and seek refunds through appropriate government agencies. Auctioneer will not provide tax refund.

BUYER'S PREMIUM: A 10% buyer's premium will be added to the final bid price on each item to determine the purchase price and shall be earned by the Auctioneer at the "fall of the hammer."

STATEMENTS: All statements by Auctioneer made on the day of the auction take precedence over ANY and ALL printed advertising material. A bill of sale will be made out to the recorded bidder only and no transfer will be recognized to another buyer.

OWNERSHIP: Ownership title passes upon the fall of the auctioneer's gavel, and thereafter the property is at the risk of the buyer, and neither the seller nor the auctioneer shall be responsible for the loss or damage to any article due to theft, fire, breakage, or any cause whatsoever, however occasioned.

NON-DELIVERY RESPONSIBILITY: Auctioneer shall not be responsible for non-delivery to any purchaser of any lot other than to refund deposit or sum paid on any lot, should Purchaser be entitled to said refund due to Auctioneer error.

REMOVAL OF MERCHANDISE: No merchandise may be removed in advance of full payment for all purchased assets. All merchandise must be removed by 6pm on auction day. SAME DAY REMOVAL.

Any merchandise remaining at the removal site following the removal period will be re-sold to another purchaser. Removal shall be at the sole expense, liability and risk of the Purchaser. Purchaser is responsible for providing all labor, material and equipment to properly execute removal. All gas and/or electrical connections must be disconnected by licensed electricians and/or plumbers and capped. Removal of equipment must be completed by insured removal professional. Buyer shall be liable for all costs associated with any/all removal of items purchased but abandoned at the sale site. Auction Firm does NOT provide labor or equipment for removal.

BUYER BEWARE: Buyer acknowledges that s/he has entered into this agreement as the result of a thorough inspection of the merchandise being purchased and that all merchandise is sold in an "AS-IS, WHERE-IS, and AS-INSPECTED" condition with any and all faults. While descriptions are believed to be correct, the Auctioneer and the Seller make no warranties or guarantees, expressed or implied, as to the genuineness, authenticity or merchantability of, or defect in any item, and will not be held responsible for any discrepancies or inaccuracies. No warranties are made as to the merchantability of any item or their fitness for any purpose. ALL SALES ARE FINAL. It is understood and agreed that the Auctioneer is acting as an agent only and shall in no case whatsoever be held liable by either party for the performance of any term or covenant of this agreement or for damages for non-performance thereof. Purchaser does hereby indemnify and hold harmless Auctioneer and Seller from any and all damages and claims of any type whatsoever caused during the sale or by the removal of the item(s) purchased.

DISPUTES: If any dispute arises between two or more bidders, the Auctioneer may put the item up again for sale and resell it to the highest bidder among the contesting bidders. The Auctioneer reserves the right to bid and to reject any and all bids, including any bid that is only a fractional advance over the preceding bid. Auctioneer reserves the right to restrict access to, or remove, any person or persons that may cause a disturbance to the auction. The Auctioneer has final discretion in resolving all disputes.

ADDITION AND WITHDRAWL: The Auctioneer reserves the right to withdraw any listed item from the sale, to sell items that are not listed, to group one or more lots into one or more selling lots, to subdivide into two or more selling lots and to sell any/all items in bulk.

DEFAULT: In the event the purchaser fails to pay the whole of the purchase price within the time set forth by the Auctioneer, and/or fails to comply with any of the terms and conditions of the auction, the Auctioneer may sue purchaser for damages. Purchaser agrees to pay any and all charges and expenses incurred by reason of any breach of the terms and conditions of this auction, including, without limitations, reasonable attorney fees and court costs. Any merchandise remaining at the removal site following the second removal date may be considered abandoned by the purchaser, all rights to merchandise will be forfeited, all monies retained by Auctioneer and merchandise will be re-sold immediately.
