BASIC TERMS & CONDITIONS
1. REGISTRATION: Bids will be accepted only from registered bidders. Registration begins on site one hour prior to auction. Please bring a driver's license for identification.
2. TERMS OF SALE: All property is sold "AS IS, WHERE IS". Bidders should perform such independent investigation with respect to the property as they deem necessary or appropriate. The property is subject to Seller confirmation. ALL SALES ARE FINAL.
3. AGENCY: THE AUCTION COMPANY AND ITS REPRESENTATIVES REPRESENT THE SELLER.
4. ANNOUNCEMENTS: Announcements day of the sale take precedence over all prior communications, verbal and written, concerning the sale.
5. BIDDING: The auctioneer will determine bidding increments.
6. SEALED BID: Prospective buyers may submit a sealed bid until 10:00am (EST), the same day as auction. Contact Auction Company to obtain the terms for submitting a sealed bid.
7. BUYERS PREMIUM: A Buyer's Premium will be charged. The Buyer's Premium on real estate is three percent (3 %) of the high bid amount. The Buyer's Premium is added to the high bid amount to determine the sale price.
8. DEPOSIT: A deposit in the amount of $5,000 will be required the day of the sale. The deposit is payable by cash, cashier's check or certified check made payable to the buyer. A personal check will be approved if, prior to registration, the Buyer presents a bank letter stating the bidder is a customer of the bank and that the checking account is in good standing. Deposit must be brought to 10% of the sale price (high bid plus Buyer's Premium) by November 27, 2015.
9. CLOSING DATE FOR REAL ESTATE: The balance of the purchase price is due at settlement on or before December 31, 2015.
10. TRANSFER OF TITLE TO REAL ESTATE: The real estate will be conveyed by general warranty deed free and clear of all liens subject, however, to any recorded rights of way, easements, conditions and restrictions.
11. FINANCING: The sale of real estate is a cash transaction and is not conditioned upon the bidder obtaining financing. Bidders should arrange any necessary financing prior to registering to bid.
12. BIDDER PACKET: A Bidder Packet with information regarding the real estate is available at the inspections, upon request and at www.cowley1.com.
13. BOUNDARY LINES: Boundaries shown on aerial photographs which are provided by the Auction Company as a courtesy to Bidders are approximate.
14. LEAD-BASED PAINT: The home or structures on the property may have been built prior to 1978 and may contain lead based paint. Inspections may be performed by potential bidders prior to sale day. Applicable lead paint documents and information are available from the Auction Company. Bidders will be provided a lead paint disclosure in the Real Estate Bidder Packet and agree to waive the (10) day right to inspect after the sale.
