Payment
All payments are due in immediately upon conclusion of the sale. There is no time to leave to get cash. Visa, M/C, and Discover cards are also accepted. Local checks MAY be accepted at the discretion of the Auctioneer.

The auctioneer may require any bidder to pay for their purchases at any time. This is Live Auction. Everything MUST be paid for immediately upon the conclusion of the auction.

Sales tax
Sales tax will be collected for Elbert County at 3.9%. Sales tax will be assessed on your entire purchase, including buyer's premiums. If you have a tax exempt certificate, we must have a copy on-hand BEFORE YOU BID, or you will be assessed taxes. Sales Tax will not be assessed on vehicles and trailers.

Preview and Inspection:
Preview is limited to 1 hour prior to the sale, starting at 9AM on Saturday July 30. Please inspect all lots you intent to bid on. There are no warranties or guaranties. All items are sold AS IS. YOU are responsible to inspect items BEFORE bidding. There are no refunds of any kind. By bidding, you accept the condition of the items purchased without recourse.

Warranty
Bidder agrees that all property is sold “AS-IS WHERE-IS” with no warranties express or implied and ALL SALES ARE FINAL. Property is open to thorough public inspection. All bidders understand and acknowledge that they may not be able to inspect an item as well through photos as if they examined it in person. The photos cannot show all potential damage so it is best to inspect in person. No sales will be voided due to a buyer’s failure to inspect in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Schur Success Realty & Auction may attempt to describe the merchandise in advertising, on the internet or through other means but makes no representations. In no event shall Schur Success Realty & Auction be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Schur Success Realty & Auction does not guarantee any appraisals, gradings or certifications.


Removal:
All items are required to be removed immediately the day of the sale, unless other arrangements are made with the auctioneer. Please bring packing materials, boxes, labor, and rigging equipment. Only a limited number of vehicles will be permitted on the auction site at any one time.

Reserve or Minimum Bids
The seller reserves the right to accept or reject any or all bids.

Bid Card Terms & Conditions
1) All bidders and others attending this auction agree that they have read these terms and agree to be bound by and abide by these terms thereby.
2) All property is sold "as is, where is" without any warranty or guarantee, express or implied. ALL SALES ARE FINAL. THERE ARE NO REFUNDS, EXCHANGES or REFUSALS. As the highest bidder, you are the buyer and are bound by the terms and conditions of this agreement and sale.
3) The sale price recorded by the auction clerk on his or her record sheets, either on paper or electronically, takes priority over all records and shall be the official sale price of the item sold.
4) The BUYER assumes full responsibility for any item purchased AT THE TIME IT IS SOLD, including the security of the item(s).
5) Complete and full payment for any and all purchases is due AT THE TIME AN ITEM IS SOLD. The Auctioneer may at their discretion allow bidders to wait to pay for all purchases at the conclusion of the sale. Under no circumstances shall a bidder leave the auction site without first paying in full for all purchases. Unless exempt by law, purchaser shall pay any and all applicable sales taxes.
6) Removal of any and all items shall be at the expense, liability and risk of the purchaser. All property must be removed within the time period announced by the auctioneer. Property not removed within the announced time period will revert to the seller for disposal without refund, unless specific arrangements are otherwise made with the auctioneer.
7) Announcements made at the time of the sale take precedence over any published annoucements. The auctioneer reserves the right to determine bidding increments at his or her discretion, and may reject a nominal or fractional bid. The auctioneer reserves the right to withdraw items from sale before or during the auction.
8) Persons attending the auction during preview period, the auction, or during the removal period assume all risks of damage, injury, or loss to their person and or property, and release the auctioneer and the auction firm from liability thereof. Neither the auction firm nor its principals shall be liable for any defect in or condition of premises on which the auction is held.
9) The auction firm is acting solely as the agent for the seller and is not responsible for any acts or omissions of its principals.
10) Should any litigation or mediation be commenced between the parties to this agreement, concerning this agreement or the associated auction, the bidder / buyer agrees to incur any and all legal expenses for both parties for the entire proceedings including court costs, fines, fees, and attorneys. Otherwise, the prevaling party shall be entitled to all costs and expenses from the other party.
11) The bidder / buyer agrees to reimburse the auctioneer for all expenses incurred in the collection of any debt in conjunction with this auction.
