Listing Terms and Conditions
Please pay attention to the announcement regarding pickup/removal of your items. We are under time constraints to have all items removed, so please, if you bid, plan to pick up your items at the scheduled time. WE DO NOT PROVIDE MOVERS. It is the buyer's responsibility to provide adequate equipment, packing materials and manpower to remove his or her items. For large or heavy items, we recommend hiring professional movers. We often work with K&M Movers at 803-804-6665, who may be available at buyers expense.

Online Bidding Tips: Bidding Style is Staggered & Soft Close: Each lot will close 10 or 15 Seconds after the first lot in the auction consecutively. Lots will begin closing at 7 PM and continue until the final lot has closed. If a bid is placed on a lot during the last minute of bidding, the time will be extended by one minute each time.

**** If you are bidding at the close of the Auction, please make sure to select "LIVE CATALOG VIEW" to view the auction in real time, otherwise you may need to manually refresh your computer screen. We recommend being signed into the Auction at least 15 minutes prior to closing if you wish to bid during auction closing. **** You may also enter your "Maximum Bid" to have the computer bid on your behalf up to a set amount. Registration: To participate in this auction, bidders must register and obtain an online bidder number. Anyone bidding for another person must register separately. This bidder contract is between the individual who registered to bid through this online platform (the 'bidder') and The Ligon Company.

The bidder acknowledges and agrees that the terms outlined in this registration, as well as those detailed in the auction catalog, establish the specific and complete rules of the auction. The bidder further agrees that it is their responsibility to obtain and review these rules prior to placing any bids. By participating in the auction, the bidder agrees to be legally bound by these rules.

The Ligon Company reserves the right to revoke the bidder number and bidding privileges from any registered bidder and require that the individual and their parties leave the auction site. The bidder will remain responsible for the payment of any bids placed prior to the revocation. Photography, video, and audio recording are used on the premises and may be utilized for security and/or promotional purposes.


Bidding: Bidders are to be held personally liable for any bids made with their Bidding Number. All items sell strictly AS-IS and WHERE IS. Buyers are responsible for their items from the moment that it is called sold. When you bid on the wrong item or decide an item is not suited for your use, keep in mind that ALL bidding is a binding obligation to complete a transaction. You are responsible for ALL bids placed. When in doubt about condition, completeness or suitability for intended use, please bid accordingly. You should not place a bid if you are not able to complete the transaction. While we understand there are extenuating circumstances, and we try to be accommodating within the scope of our ability, buyers who do not adhere to the terms of the auction will be banned from participating in future auctions.


Catalog: The Ligon Company has put forth every effort to provide accurate descriptions. All lots are sold as is, where is, with all faults, imperfections and errors of description. Due diligence is the responsibility of the bidder/buyer. No warranty or guarantee is expressed or implied. Please inspect all items to your satisfaction prior to bidding, as there will be no refunds, exchanges, or adjustments after the item is called sold. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. ALL MEASUREMENTS, DESCRIPTIONS AND QUANTITIES ARE APPROXIMATE AND MADE TO THE BEST OF OUR KNOWLEDGE. All sales are final.


Inspection: It is the bidder's responsibility to inspect items prior to bidding. All items are sold as-is, and no representations regarding the condition, quality, or authenticity of any item are made. If you are uncertain about an item, please do not bid. It is the buyer's responsibility to have inspected the item and determined the condition, year, model, serial number, and mileage of the item from your inspection. The Ligon Company does not guarantee any item descriptions as accurate. By agreeing to the terms of the auction you agree to the complete rules of auction.

The Auctioneer has described the Lot(s) in the catalog to the best of their ability and belief from information furnished, and is not responsible for any error or misstatement, which there may be. The Auctioneer undertakes no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact.


Payments: All accounts must be settled at the conclusion of the auction. Credit Cards will be processed the day of the auction for your purchases, plus buyer's premiums, and any taxes. Be sure to have adequate funds in your account. We accept Amex, Discover, Visa & MasterCard. A pre-auction authorization will be performed to establish available credit. Debit cards may show a hold on funds for a short period of time. NOTHING will be charged to your card until a purchase is made.

$1,000 Maximum charge to credit card. Any balance above $1,000 will require payment by cash, bank wire or certified check. The Ligon Company, at their sole discretion, reserves the right to accept credit card payments over $1,000 from vetted bidders, subject to a 3% processing fee. Any purchases over $500 will require a certified check or bank wire to ship.

Credit cards may require a credit card authorization form to be completed by the purchaser, along with verification of identity. Failure to arrange payment by the specified date will result in a $100 Late Fee. After 5 business days, if payment is not made, the purchase will be considered a breach of contract, and legal action will be taken. A recovery fee may also apply. NO ITEMS can be removed until full payment is received.


BP: There will be an 18% Buyers Premium added to the high bid to determine the selling price.



Tax / Exemptions: State sales tax will be added to the selling price. To receive exemption, dealers and retailers must have filled out and submitted the exemption forms before the close of auction. Exemption forms can be emailed to auction@theligoncompany.com.


Unpaid Balances: The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. Any debt collection or dispute proceedings will be heard in York County, SC. Each transaction necessary to collect insufficient funds will have a $100 fee imposed. Nonpayment will result in legal recourse and you will be banned from future auctions.


Pick Up / Removal: Buyers are responsible for bringing their own equipment, packing materials, and manpower for item removal. We do not provide moving assistance. If any equipment, materials, or labor are provided by The Ligon Company, the buyer will incur additional fees. For large or heavy items, we recommend hiring professional movers.

Pick-up will occur following the close of the auction during designated times and by appointment only. All items must be picked up by the specified dates listed on our website under "Dates." If you cannot remove your items by the deadline, please make prior arrangements. Items may only be removed after full payment has been received. Buyers assume full responsibility for the care of their purchases at the time of sale.

Items not picked up within 48 hours of the auction's close will be considered abandoned, and no refunds will be issued. Abandoned items may incur a disposal fee and become the property of The Ligon Company unless prior arrangements are made. We reserve the right to ship unclaimed items at the buyer's expense.

Any items left beyond the pick-up date(s) will incur fees for transport, storage and disposal. Abandoned property will be sold to cover these fees. If special arrangements must be made to accommodate a customer pickup after the removal deadline a call out fee may be charged in addition to storage fees.

Missing Items: It is the buyer's responsibility to check all contents of the package before removing it from the premises. We will not be held responsible for damaged or missing pieces once the package is in possession of the bidder. It's your responsibility to review your purchases and their condition.


Shipping: The Ligon Company can arrange packing and shipping at the buyer's expense. WE DO NOT PROVIDE INTERNATIONAL SHIPPING. All items will be insured for the purchase price. Buyer is responsible for paying postage, materials, and handling fee's when applicable. Our typical timeframe for shipping is 5-7 business days from sale. Bidder may be required to verify information on high value shipments. Any purchases over $500 will require a certified check or bank wire to ship.

Keep in mind large or breakable items will be more costly to ship. Furniture will need to be arranged at buyer's discretion, we do not make freight arrangements, or provide movers. We will send items in the most efficient and cost effective way.

If you choose not to pay the shipping costs due to expense, no refunds will be issued. The item(s) will be deemed abandoned and will be sold to cover storage, transport, and/or disposal fees.

We document the contents of each package. If we have missed an item in your shipment our documentation will show that. Please notify us within 2 business days of receiving the package if you think something is not included. DO NOT discard the original shipping box and packaging if you think something is missing or damaged.


**************Titles: IMPORTANT NOTICE: Titles will be registered in the name and/or company name you used when registering to bid in the auction. We will not change the registration information after the auction.
" Title processing will be $150 per transaction plus any other fee's required by the DMV.
" Bill of Sale, Drivers License, and other documents may be required at time of purchase. Bidder grants The Ligon Company power of attorney to sign as owner/buyer on title documentation as necessary to facilitate the transfer of ownership of titled purchases.
" Titles are processed in accordance with the South Carolina Department of Motor Vehicles. DMV laws in other states may vary and may require further processing by the Buyer. Units that do not require titles in South Carolina may have such requirements in other states. Some states may have different requirements for branding and salvaging titles. The Auctioneer/Owner is NOT responsible, and in some cases, may not be able to provide documentation required by other states.
" The Buyer may be required to go into the DMV to complete the process, in this case we will specify.
" Tax will be calculated and collected based on the state of purchase not sale. In the United States, the sales tax on vehicles varies by state, and whether or not it's capped depends on the specific state's laws. Many states impose sales tax on vehicle purchases based on the purchase price or the fair market value of the vehicle, but some states have caps or limits on the maximum amount of sales tax that can be charged for a vehicle. Any balance due will be the responsibility of the Buyer.
" No titles will be given to the winning bidder on auction day.
" If The Ligon Company cannot provide clear title within 120 days of purchase The Ligon Company will refund the purchase price including buyers premium only. The Ligon Company will not refund cost of freight, cost of any repairs or alterations made to item while in possession of the Buyer.

1. Time of Pickup - Guns will be picked up by appointment at Broad River Mercantile. Location: 171 Gadsden St, Chester, SC. (803) 385-1240 Monday - Friday: 9:00am - 6:00pm Saturday: 9:00am - 5:00pm. Your purchase(s) must be picked up within 5 business days. A $35 Transfer Fee, per firearm, will be payable to directly to Broad River Mercantile. Handguns require a waiting period, which will delay your pick-up. Guns MUST be picked up personally by the buyer, and not a buyer's representative. Buyer must bring their PAID invoice from The Ligon Company to pick up.

2. Payment - Guns MUST be paid for immediately following the auction close. Accommodations for purchasing by credit card are in place, and your credit card will be charged following the close of the Auction on the following business day. Any bidders with credit cards that are declined on reconciliation day will be charged a $35 processing fee to run another credit card- NO EXCEPTIONS!

3. Invoice - Your printable invoice does not have processing fees built in, so these will be added manually upon your item pickup.

4. Buyer's Premium - An 18% Buyer's Premium is added to all auction purchases, including firearms.

5. Registration & Background Checks - A Buyer background check will be done, per state & federal law. Allow time for this process when you pick up your gun. This form must be completed personally by the buyer at Broad River Mercantile. The Ligon Company and Broad River Mercantile reserves the right to deny the sale of a firearm to any person.

6. Handgun Waiting Period - Handgun purchases require a waiting period. Two visits�one to complete the form, and a return to pick up the gun after the waiting period.

7. Shipping & Delivery Out-of-Region - Guns that require shipping can only be sent to a licensed federal firearms dealer near the buyer. The buyer will pre-pay shipping, insurance, or special packaging costs to Broad River Mercantile. and any other costs incurred by their local participating FFL dealer. Their firearms dealer must do the registration and background check when the gun is picked up at their location.

8. Taxes & Legal Requirements - Firearms are subject to all state and local taxes, age requirements, and registration (as mentioned above).

9. Trigger Locks - Handguns cannot leave Broad River Mercantile without a trigger lock�by law. You may bring your own, or purchase one from Broad River Mercantile. Long gun trigger locks are also available for purchase�but are not mandatory.

10. ALL FIREARMS ARE SOLD "AS IS - WHERE IS" - The Ligon Company makes no warranties on any firearms, or their descriptions, even those believed to be new or in exceptional condition. It is your responsibility to inspect and test prior to bidding. Your inability or unwillingness to do so, or your own inaccurate appraisal is not reason for a return, complaint, or warranty claim. Any verbal or written representation of the firearm by The Ligon Company is limited ONLY to the item's known or visible features, and not regarding its performance, durability, or market/investment value.

11. The Ligon Company may change these terms at any time, for any reason, with reasonable advance public notice.

12. These firearms terms and conditions are additional and complimentary to the general auction terms and conditions as expressed within the The Ligon Company website.

13. Buyers who do not clearly understand these requirements and their responsibilities should call The Ligon Company at 803-366-3535 for clarification�PRIOR to bidding and buying.

14. If you are the winning bidder and do not meet the requirements to purchase a gun per State and Federal Law, you are still responsible for paying your invoice in full. No exceptions. *****************************

Internet Outages: We are not responsible for Internet nor platform outages during an online Auction. If there is a platform outage during the close of an Auction, we reserve the right to no-sell the items affected during outage and offer for resale at a later date.


Liability: The Ligon Company is not responsible for any injury, damage, or loss incurred in connection with the auction or the removal of purchased items. Injury and Damage: The bidder acknowledges responsibility for any personal injury or property damage caused by the bidder, the bidder's guests, or agents. The bidder agrees to hold The Ligon Company harmless from any personal injury to themselves or their agents and any property damage incurred on the auction premises. The bidder releases The Ligon Company and the seller from all liability related to the removal and transportation of purchases, as well as any future use of the goods purchased.


Agency, Indemnity & Jurisdiction: The Ligon Company, auctioneers, firm, broker and all parties employed by or associated with, will be acting solely as a representative of the Seller. The Buyer assumes full responsibility and liability for any claim or actions based on or arising out of injuries, death, damage, loss of property, sustained or alleged to have been sustained by Buyer, its agent, principals, associates, friends, family and/or employees, in connection with or to have arisen out of or incidental to the auction including but not limited to the performance of this contract. Regardless of whether such claims or actions are founded whole or in part upon alleged negligence or negligent misrepresentation of Seller, Auctioneer, or the employees, agents, invitees, or licensees thereof, Buyer agrees to indemnify and hold harmless Seller, Auctioneer, and their representatives, and the employees, agents, invitees and licensees thereof in respect of any such matters and agrees to defend any claim or suit or action brought against Seller, Auctioneer, and their representatives, and the employees, agents, invitees and licensees thereof. All sales are final. No credit card charge backs will be allowed. We reserve the right to refuse service to anyone. All statements made prior to the sale of any item take precedence over written material and any prior statements. The auction company is not responsible for accidents, thefts, errors or omissions. This Agreement and all documents and instruments referred to herein shall be governed by the laws of the State of South Carolina. Any disputes between the Seller and Purchaser regarding this Agreement will be decided exclusively by a Court based in York County, South Carolina.

We are under time constraints to have all items removed, so please, if you bid, plan to pick up your items at the scheduled time. WE DO NOT PROVIDE MOVERS. It is the buyer's responsibility to provide adequate equipment, packing materials and manpower to remove his or her items. For large or heavy items, we recommend hiring professional movers. We often work with K&M Movers at 803-804-6665, who may be available at buyers expense. Online Bidding Tips: Bidding Style is Staggered & Soft Close: Each lot will close 10 or 15 Seconds after the first lot in the auction consecutively. Lots will begin closing at 7 PM and continue until the final lot has closed. If a bid is placed on a lot during the last minute of bidding, the time will be extended by one minute each time. **** If you are bidding at the close of the Auction, please make sure to select "LIVE CATALOG VIEW" to view the auction in real time, otherwise you may need to manually refresh your computer screen. Anyone bidding for another person must register separately. This bidder contract is between the individual who registered to bid through this online platform (the 'bidder') and The Ligon Company. The bidder acknowledges and agrees that the terms outlined in this registration, as well as those detailed in the auction catalog, establish the specific and complete rules of the auction. The bidder further agrees that it is their responsibility to obtain and review these rules prior to placing any bids. By participating in the auction, the bidder agrees to be legally bound by these rules. The Ligon Company reserves the right to revoke the bidder number and bidding privileges from any registered bidder and require that the individual and their parties leave the auction site. The bidder will remain responsible for the payment of any bids placed prior to the revocation. Photography, video, and audio recording are used on the premises and may be utilized for security and/or promotional purposes. Bidding: Bidders are to be held personally liable for any bids made with their Bidding Number. All items sell strictly AS-IS and WHERE IS. Buyers are responsible for their items from the moment that it is called sold. When you bid on the wrong item or decide an item is not suited for your use, keep in mind that ALL bidding is a binding obligation to complete a transaction. You are responsible for ALL bids placed. When in doubt about condition, completeness or suitability for intended use, please bid accordingly. You should not place a bid if you are not able to complete the transaction. While we understand there are extenuating circumstances, and we try to be accommodating within the scope of our ability, buyers who do not adhere to the terms of the auction will be banned from participating in future auctions. The Auctioneer has described the Lot(s) in the catalog to the best of their ability and belief from information furnished, and is not responsible for any error or misstatement, which there may be. The Auctioneer undertakes no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact. Payments: All accounts must be settled at the conclusion of the auction. Credit Cards will be processed the day of the auction for your purchases, plus buyer's premiums, and any taxes. Be sure to have adequate funds in your account. We accept Amex, Discover, Visa & MasterCard. A pre-auction authorization will be performed to establish available credit. Debit cards may show a hold on funds for a short period of time. NOTHING will be charged to your card until a purchase is made. $1,000 Maximum charge to credit card. Any balance above $1,000 will require payment by cash, bank wire or certified check. The Ligon Company, at their sole discretion, reserves the right to accept credit card payments over $1,000 from vetted bidders, subject to a 3% processing fee. Any purchases over $500 will require a certified check or bank wire to ship. Credit cards may require a credit card authorization form to be completed by the purchaser, along with verification of identity. Failure to arrange payment by the specified date will result in a $100 Late Fee. After 5 business days, if payment is not made, the purchase will be considered a breach of contract, and legal action will be taken. A recovery fee may also apply. NO ITEMS can be removed until full payment is received. BP: There will be an 18% Buyers Premium added to the high bid to determine the selling price. Tax / Exemptions: State sales tax will be added to the selling price. To receive exemption, dealers and retailers must have filled out and submitted the exemption forms before the close of auction. Exemption forms can be emailed to auction@theligoncompany.com. Unpaid Balances: The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. Any debt collection or dispute proceedings will be heard in York County, SC. Each transaction necessary to collect insufficient funds will have a $100 fee imposed. Nonpayment will result in legal recourse and you will be banned from future auctions. Pick Up / Removal: Buyers are responsible for bringing their own equipment, packing materials, and manpower for item removal. We do not provide moving assistance. If any equipment, materials, or labor are provided by The Ligon Company, the buyer will incur additional fees. For large or heavy items, we recommend hiring professional movers. Pick-up will occur following the close of the auction during designated times and by appointment only. All items must be picked up by the specified dates listed on our website under "Dates." If you cannot remove your items by the deadline, please make prior arrangements. Items may only be removed after full payment has been received. Buyers assume full responsibility for the care of their purchases at the time of sale. Items not picked up within 48 hours of the auction's close will be considered abandoned, and no refunds will be issued. Abandoned items may incur a disposal fee and become the property of The Ligon Company unless prior arrangements are made. We reserve the right to ship unclaimed items at the buyer's expense. Any items left beyond the pick-up date(s) will incur fees for transport, storage and disposal. Abandoned property will be sold to cover these fees. If special arrangements must be made to accommodate a customer pickup after the removal deadline a call out fee may be charged in addition to storage fees. Missing Items: It is the buyer's responsibility to check all contents of the package before removing it from the premises. We will not be held responsible for damaged or missing pieces once the package is in possession of the bidder. It's your responsibility to review your purchases and their condition. Shipping: The Ligon Company can arrange packing and shipping at the buyer's expense. WE DO NOT PROVIDE INTERNATIONAL SHIPPING. All items will be insured for the purchase price. Buyer is responsible for paying postage, materials, and handling fee's when applicable. Our typical timeframe for shipping is 5-7 business days from sale. Bidder may be required to verify information on high value shipments. Any purchases over $500 will require a certified check or bank wire to ship. Keep in mind large or breakable items will be more costly to ship. Furniture will need to be arranged at buyer's discretion, we do not make freight arrangements, or provide movers. We will send items in the most efficient and cost effective way. If you choose not to pay the shipping costs due to expense, no refunds will be issued. The item(s) will be deemed abandoned and will be sold to cover storage, transport, and/or disposal fees. We document the contents of each package. If we have missed an item in your shipment our documentation will show that. Please notify us within 2 business days of receiving the package if you think something is not included. DO NOT discard the original shipping box and packaging if you think something is missing or damaged. **************Titles: IMPORTANT NOTICE: Titles will be registered in the name and/or company name you used when registering to bid in the auction. We will not change the registration information after the auction. " Title processing will be $150 per transaction plus any other fee's required by the DMV. " Bill of Sale, Drivers License, and other documents may be required at time of purchase. Bidder grants The Ligon Company power of attorney to sign as owner/buyer on title documentation as necessary to facilitate the transfer of ownership of titled purchases. " Titles are processed in accordance with the South Carolina Department of Motor Vehicles. DMV laws in other states may vary and may require further processing by the Buyer. Units that do not require titles in South Carolina may have such requirements in other states. Some states may have different requirements for branding and salvaging titles. The Auctioneer/Owner is NOT responsible, and in some cases, may not be able to provide documentation required by other states. " The Buyer may be required to go into the DMV to complete the process, in this case we will specify. " Tax will be calculated and collected based on the state of purchase not sale. In the United States, the sales tax on vehicles varies by state, and whether or not it's capped depends on the specific state's laws. Many states impose sales tax on vehicle purchases based on the purchase price or the fair market value of the vehicle, but some states have caps or limits on the maximum amount of sales tax that can be charged for a vehicle. Any balance due will be the responsibility of the Buyer. " No titles will be given to the winning bidder on auction day. " If The Ligon Company cannot provide clear title within 120 days of purchase The Ligon Company will refund the purchase price including buyers premium only. Buyer's Premium - An 18% Buyer's Premium is added to all auction purchases, including firearms. 5. Registration & Background Checks - A Buyer background check will be done, per state & federal law. Allow time for this process when you pick up your gun. This form must be completed personally by the buyer at Broad River Mercantile. The Ligon Company and Broad River Mercantile reserves the right to deny the sale of a firearm to any person. 6. Handgun Waiting Period - Handgun purchases require a waiting period. Two visits�one to complete the form, and a return to pick up the gun after the waiting period. 7. Shipping & Delivery Out-of-Region - Guns that require shipping can only be sent to a licensed federal firearms dealer near the buyer. The buyer will pre-pay shipping, insurance, or special packaging costs to Broad River Mercantile. and any other costs incurred by their local participating FFL dealer. Their firearms dealer must do the registration and background check when the gun is picked up at their location. 8. Taxes & Legal Requirements - Firearms are subject to all state and local taxes, age requirements, and registration (as mentioned above). 9. Trigger Locks - Handguns cannot leave Broad River Mercantile without a trigger lock�by law. You may bring your own, or purchase one from Broad River Mercantile. Long gun trigger locks are also available for purchase�but are not mandatory. 10. ALL FIREARMS ARE SOLD "AS IS - WHERE IS" - The Ligon Company makes no warranties on any firearms, or their descriptions, even those believed to be new or in exceptional condition. It is your responsibility to inspect and test prior to bidding. Your inability or unwillingness to do so, or your own inaccurate appraisal is not reason for a return, complaint, or warranty claim. Any verbal or written representation of the firearm by The Ligon Company is limited ONLY to the item's known or visible features, and not regarding its performance, durability, or market/investment value. 11. The Ligon Company may change these terms at any time, for any reason, with reasonable advance public notice. 12. These firearms terms and conditions are additional and complimentary to the general auction terms and conditions as expressed within the The Ligon Company website. 13. Buyers who do not clearly understand these requirements and their responsibilities should call The Ligon Company at 803-366-3535 for clarification�PRIOR to bidding and buying. 14. If you are the winning bidder and do not meet the requirements to purchase a gun per State and Federal Law, you are still responsible for paying your invoice in full. We are under time constraints to have all items removed, so please, if you bid, plan to pick up your items at the scheduled time. WE DO NOT PROVIDE MOVERS. It is the buyer's responsibility to provide adequate equipment, packing materials and manpower to remove his or her items. For large or heavy items, we recommend hiring professional movers. We often work with K&M Movers at 803-804-6665, who may be available at buyers expense. Online Bidding Tips: Bidding Style is Staggered & Soft Close: Each lot will close 10 or 15 Seconds after the first lot in the auction consecutively. Lots will begin closing at 7 PM and continue until the final lot has closed. If a bid is placed on a lot during the last minute of bidding, the time will be extended by one minute each time. **** If you are bidding at the close of the Auction, please make sure to select "LIVE CATALOG VIEW" to view the auction in real time, otherwise you may need to manually refresh your computer screen. Anyone bidding for another person must register separately. This bidder contract is between the individual who registered to bid through this online platform (the 'bidder') and The Ligon Company. The bidder acknowledges and agrees that the terms outlined in this registration, as well as those detailed in the auction catalog, establish the specific and complete rules of the auction. The bidder further agrees that it is their responsibility to obtain and review these rules prior to placing any bids. By participating in the auction, the bidder agrees to be legally bound by these rules. The Ligon Company reserves the right to revoke the bidder number and bidding privileges from any registered bidder and require that the individual and their parties leave the auction site. The bidder will remain responsible for the payment of any bids placed prior to the revocation. Photography, video, and audio recording are used on the premises and may be utilized for security and/or promotional purposes. Bidding: Bidders are to be held personally liable for any bids made with their Bidding Number. All items sell strictly AS-IS and WHERE IS. Buyers are responsible for their items from the moment that it is called sold. When you bid on the wrong item or decide an item is not suited for your use, keep in mind that ALL bidding is a binding obligation to complete a transaction. You are responsible for ALL bids placed. When in doubt about condition, completeness or suitability for intended use, please bid accordingly. You should not place a bid if you are not able to complete the transaction. While we understand there are extenuating circumstances, and we try to be accommodating within the scope of our ability, buyers who do not adhere to the terms of the auction will be banned from participating in future auctions. It is the buyer's responsibility to have inspected the item and determined the condition, year, model, serial number, and mileage of the item from your inspection. The Ligon Company does not guarantee any item descriptions as accurate. By agreeing to the terms of the auction you agree to the complete rules of auction. The Auctioneer has described the Lot(s) in the catalog to the best of their ability and belief from information furnished, and is not responsible for any error or misstatement, which there may be. The Auctioneer undertakes no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact. Payments: All accounts must be settled at the conclusion of the auction. Credit Cards will be processed the day of the auction for your purchases, plus buyer's premiums, and any taxes. Be sure to have adequate funds in your account. We accept Amex, Discover, Visa & MasterCard. A pre-auction authorization will be performed to establish available credit. Debit cards may show a hold on funds for a short period of time. NOTHING will be charged to your card until a purchase is made. $1,000 Maximum charge to credit card. Any balance above $1,000 will require payment by cash, bank wire or certified check. The Ligon Company, at their sole discretion, reserves the right to accept credit card payments over $1,000 from vetted bidders, subject to a 3% processing fee. Any purchases over $500 will require a certified check or bank wire to ship. Credit cards may require a credit card authorization form to be completed by the purchaser, along with verification of identity. Failure to arrange payment by the specified date will result in a $100 Late Fee. After 5 business days, if payment is not made, the purchase will be considered a breach of contract, and legal action will be taken. A recovery fee may also apply. NO ITEMS can be removed until full payment is received. BP: There will be an 18% Buyers Premium added to the high bid to determine the selling price. Tax / Exemptions: State sales tax will be added to the selling price. To receive exemption, dealers and retailers must have filled out and submitted the exemption forms before the close of auction. Exemption forms can be emailed to auction@theligoncompany.com. Unpaid Balances: The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. Any debt collection or dispute proceedings will be heard in York County, SC. Each transaction necessary to collect insufficient funds will have a $100 fee imposed. Nonpayment will result in legal recourse and you will be banned from future auctions. Pick Up / Removal: Buyers are responsible for bringing their own equipment, packing materials, and manpower for item removal. We do not provide moving assistance. If any equipment, materials, or labor are provided by The Ligon Company, the buyer will incur additional fees. For large or heavy items, we recommend hiring professional movers. Pick-up will occur following the close of the auction during designated times and by appointment only. All items must be picked up by the specified dates listed on our website under "Dates." If you cannot remove your items by the deadline, please make prior arrangements. Items may only be removed after full payment has been received. Buyers assume full responsibility for the care of their purchases at the time of sale. Items not picked up within 48 hours of the auction's close will be considered abandoned, and no refunds will be issued. Abandoned items may incur a disposal fee and become the property of The Ligon Company unless prior arrangements are made. We reserve the right to ship unclaimed items at the buyer's expense. Any items left beyond the pick-up date(s) will incur fees for transport, storage and disposal. Abandoned property will be sold to cover these fees. If special arrangements must be made to accommodate a customer pickup after the removal deadline a call out fee may be charged in addition to storage fees. Missing Items: It is the buyer's responsibility to check all contents of the package before removing it from the premises. We will not be held responsible for damaged or missing pieces once the package is in possession of the bidder. It's your responsibility to review your purchases and their condition. Shipping: The Ligon Company can arrange packing and shipping at the buyer's expense. WE DO NOT PROVIDE INTERNATIONAL SHIPPING. All items will be insured for the purchase price. Buyer is responsible for paying postage, materials, and handling fee's when applicable. Our typical timeframe for shipping is 5-7 business days from sale. Bidder may be required to verify information on high value shipments. Any purchases over $500 will require a certified check or bank wire to ship. Keep in mind large or breakable items will be more costly to ship. Furniture will need to be arranged at buyer's discretion, we do not make freight arrangements, or provide movers. We will send items in the most efficient and cost effective way. If you choose not to pay the shipping costs due to expense, no refunds will be issued. The item(s) will be deemed abandoned and will be sold to cover storage, transport, and/or disposal fees. We document the contents of each package. If we have missed an item in your shipment our documentation will show that. Please notify us within 2 business days of receiving the package if you think something is not included. DO NOT discard the original shipping box and packaging if you think something is missing or damaged. **************Titles: IMPORTANT NOTICE: Titles will be registered in the name and/or company name you used when registering to bid in the auction. We will not change the registration information after the auction. " Title processing will be $150 per transaction plus any other fee's required by the DMV. " Bill of Sale, Drivers License, and other documents may be required at time of purchase. Bidder grants The Ligon Company power of attorney to sign as owner/buyer on title documentation as necessary to facilitate the transfer of ownership of titled purchases. " Titles are processed in accordance with the South Carolina Department of Motor Vehicles. DMV laws in other states may vary and may require further processing by the Buyer. Units that do not require titles in South Carolina may have such requirements in other states. Some states may have different requirements for branding and salvaging titles. The Auctioneer/Owner is NOT responsible, and in some cases, may not be able to provide documentation required by other states. " The Buyer may be required to go into the DMV to complete the process, in this case we will specify. " Tax will be calculated and collected based on the state of purchase not sale. In the United States, the sales tax on vehicles varies by state, and whether or not it's capped depends on the specific state's laws. Many states impose sales tax on vehicle purchases based on the purchase price or the fair market value of the vehicle, but some states have caps or limits on the maximum amount of sales tax that can be charged for a vehicle. Any balance due will be the responsibility of the Buyer. " No titles will be given to the winning bidder on auction day. " If The Ligon Company cannot provide clear title within 120 days of purchase The Ligon Company will refund the purchase price including buyers premium only. Invoice - Your printable invoice does not have processing fees built in, so these will be added manually upon your item pickup. 4. Buyer's Premium - An 18% Buyer's Premium is added to all auction purchases, including firearms. 5. Registration & Background Checks - A Buyer background check will be done, per state & federal law. Allow time for this process when you pick up your gun. This form must be completed personally by the buyer at Broad River Mercantile. The Ligon Company and Broad River Mercantile reserves the right to deny the sale of a firearm to any person. 6. Handgun Waiting Period - Handgun purchases require a waiting period. Two visits�one to complete the form, and a return to pick up the gun after the waiting period. 7. Shipping & Delivery Out-of-Region - Guns that require shipping can only be sent to a licensed federal firearms dealer near the buyer. The buyer will pre-pay shipping, insurance, or special packaging costs to Broad River Mercantile. and any other costs incurred by their local participating FFL dealer. Their firearms dealer must do the registration and background check when the gun is picked up at their location. 8. Taxes & Legal Requirements - Firearms are subject to all state and local taxes, age requirements, and registration (as mentioned above). 9. Trigger Locks - Handguns cannot leave Broad River Mercantile without a trigger lock�by law. You may bring your own, or purchase one from Broad River Mercantile. Long gun trigger locks are also available for purchase�but are not mandatory. 10. ALL FIREARMS ARE SOLD "AS IS - WHERE IS" - The Ligon Company makes no warranties on any firearms, or their descriptions, even those believed to be new or in exceptional condition. It is your responsibility to inspect and test prior to bidding. Your inability or unwillingness to do so, or your own inaccurate appraisal is not reason for a return, complaint, or warranty claim. Any verbal or written representation of the firearm by The Ligon Company is limited ONLY to the item's known or visible features, and not regarding its performance, durability, or market/investment value. 11. The Ligon Company may change these terms at any time, for any reason, with reasonable advance public notice. 12. These firearms terms and conditions are additional and complimentary to the general auction terms and conditions as expressed within the The Ligon Company website. 13. Buyers who do not clearly understand these requirements and their responsibilities should call The Ligon Company at 803-366-3535 for clarification�PRIOR to bidding and buying. 14. If you are the winning bidder and do not meet the requirements to purchase a gun per State and Federal Law, you are still responsible for paying your invoice in full.
